HomeMy Public PortalAbout1991-019 Member moved its adoption: /2') e / i introducing the following resolution and CITY OF MEDINA RESOLUTION NO. 9 /` / RESOLUTION DENYING PERMISSION FOR HENNEPIN COUNTY TO BUILD PROPOSED COUNTY ROAD 116 THROUGH THE CITY OF MEDINA WHEREAS, the City of Medina has heretofore considered the extension of Hennepin County Road No. 116 southwesterly from Highway 55 to Highway 12 in Orono generally along the alignment of Medina Road and Willow Drive; and WHEREAS, heretofore the City of Medina approved the construction of proposed County Road 116; and WHEREAS, the City of Medina wishes to reconsider its action approving proposed County Road 116. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, that the City finds the following facts: 1. Proposed County Road 116 traverses the City in a southwesterly direction through the presently largely undeveloped central portion of the City. 2. Construction of the road will bring increased traffic, development, noise and pollution to central Medina. 3. The road will divide the City into an easterly portion and a westerly portion. 4. The construction of the road will cross a major swamp and will cause degradation of the natural environment and will disturb wildlife both in the swamp and elsewhere along the right of way. 5. The City finds that the existing major north -south roads between Highway 55 and Highway 12, being Highway 101 in the east and County Road 19 through Loretto in the west, are more than adequate to carry local and county north -south traffic. Increased traffic may be accommodated along the existing rights of way of Highway 101 and County Road 19 in ways which will not needlessly disrupt Medina. 6. The City finds that proposed County Road 116 as extended even only to Highway 12 would constitute a method of going from the Lake Minnetonka area to Rogers on Highway 94 and would thus greatly increase through traffic within the City. 7. The City is concerned that the extension of proposed County Road 116 to Highway 12 would inevitably lead to its further extension to Lake Minnetonka to connect with County Road 15, and would thus increase through traffic within the City. 8. Any new north -south road should traverse west of Lake Minnetonka to fulfill its county -wide transportation task. 9. Even if Hennepin County took over parts of Medina Road and Willow Drive, paved them and maintained them, the development of roads leading into proposed County Road 2 116, necessitated by the construction of proposed County Road 116 itself and by the increased commercial and residential development along proposed County Road 116, would cause the City to expend substantial sums funding connecting roads feeding into proposed County Road 116; thus, making illusory the idea that the County's construction and maintenance of proposed County Road 116 would save Medina money. 10. The City Council has designated most of Medina a rural residential area. Except for the Hamel area, Medina has consistently developed in a rural residential way. Consistent with that development plan is the location of Baker Park within the City of Medina. Also consistent with the rural character of Medina is the limited availability of sanitary sewer and the service of the residential areas by smaller roads. The City finds it is in the City's best interest to maintain the rural character of the City not only for the benefit of its citizens, but also to comply with Metropolitan Council requirements for rural areas and large residential lot development. 11. The construction of proposed County Road 116 would bring increased development pressure on Medina and would jeopardize not only the rural character of Medina, but potentially turn County Road 116 into a commercial strip development. Medina would lose open 3 space and green area. The loss of such green area and the increased pace of development in Medina would make Medina's stance with the Metropolitan Council, i.e., that it is largely rural, less valid. Should that be the case, the Metropolitan Council may not be as willing to give Medina in a timely manner the additional sewer units Medina needs for commercial and residential development in the immediate Hamel area and along Highway 55. 12. The City finds that there is a need for a paved road from the Hamel area to County Road 24. The City will endeavor to fund, on an equitable basis, the paving of Medina Road and/or Hamel Road, after significant citizen input, so as to provide such a paved road. Such a paved road would be helpful to provide a smoother and cleaner surface over which to travel. In the long run, paved roads are less costly to maintain than gravel roads; the dust and difficulty of travel over gravel roads in certain seasonal conditions may be a nuisance, particularly as traffic counts go up; and the money which would have been spent on feeder roads into proposed County Road 116 may be put to better use paving Medina Road and/or Hamel Road. 13. The City finds that emergency vehicle response time to central Medina is adequate at present. Such response time would not be materially changed even if proposed 4 County Road 116 were built since it so closely follows Willow Drive, Medina Road and Hunter Drive (north). The paving of Medina Road would reduce dust and bumps resulting in a smoother passage over such road. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina, Minnesota, as follows: 1. That the City does hereby withdraw its consent to the construction of proposed County Road 116 through the City of Medina and states to Hennepin County that it does not wish said road to be constructed through the City of Medina; and 2. That the City does explicitly withdraw and void its approval of the final plans and specifications for the proposed County Road 116, which approval was given at a regular meeting of the City Council on December 4, 1991; and 3. That the City does hereby withdraw any transfer of road right of way rights and/or other rights purported to be deeded by the City of Medina to Hennepin County before or after December 4, 1990 and directs the City staff to take such steps as may be necessary to reacquire any such rights whether transferred by deed or otherwise and return the same to the City; and 4. That any City resolutions, minutes, authorizations or otherwise which are contrary to the above are hereby superseded and declared void. 5 Adopted by the Council of the City of Medina this 2nd day of January, 1991.
