HomeMy Public PortalAbout1991-04Member adoption: Pitd e /% introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. //--1 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ROBERT BRADLEY WHEREAS, Robert Bradley (Applicant) has applied for a conditional use permit for a residential dog kennel on the property located at 3000 Hamel Road; and WHEREAS, the City's zoning ordinance requires a conditional use permit for the proposed use; and WHEREAS, this matter was reviewed by the planning commission on December 11, 1990, and by the City Council on January 3, 1991; and WHEREAS, it has been determined that the existence of a residential dog kennel at the above address will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit is granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The kennel must be for the Applicant's personal use only and no commercial use may be made of the structure; 2. The maximum number of adult dogs which may be kept on the property is 25. No more than 10 dogs under the age of 12 months may be kept on the property; 3. The Applicant's building may contain a maximum of 1,500 square feet and the outside runs may not exceed 6, totalling 3,000 square feet. The runs must conform to the plans submitted by the Applicant. The kennels must have a setback of at least 150 feet and be designed to minimize the noise of barking dogs; 4. The Applicant must maintain accurate records as to date, number, sire and dam of each litter whelp. Such records must be available for inspection at reasonable times; 5. Hours of operation must be 24 hours per day, 7 days per week; 6. Waste materials must be contained in a holding tank and pumped regularly in conformance with MPCA and city regulations; 7. Nuisances caused by barking dogs must be handled appropriately and immediately. A nuisance includes, but not is limited to, 10 minutes of continuous barking; 8. No dogs may be used or sold for experimental purposes; 9. The Applicant must submit an accurate site plan acceptable to the zoning administrator showing all structures, fences and dog runs on the Property; 10. The Applicant must maintain all dogs in accordance with the purebred dog breeders association standards; 11. An annual review of the property may be conducted by the city to ensure compliance with the terms and conditions of this permit; 12. The Applicant must remove the outside telephone bells if notified of complaints regarding the noise; 13. The City reserves the right to reconsider the terms and conditions of this conditional use permit or the appropriateness of the continuance of the Applicant's use at the time that a request for division of the property is considered by the City; 14. The Applicant must pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this application; 15. Any violation of the terms and conditions of this conditional use permit or of related city ordinances may be deemed to be grounds for revocation of this conditional use permit. DATED:.
