HomeMy Public PortalAbout12-8361 Create a Zoning Overlay District To Combine the Existing Land Usage in the Nile Garden Area Sponsored by: City Manager RESOLUTION NO. 12-8361 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA TO AUTHORIZE THE CITY MANAGER TO CREATE A ZONING OVERLAY DISTRICT (ZOD) TO COMBINE THE EXISTING AND PROPOSED LAND USES IN THE NILE GARDEN AREA, AND TO PRESENT THE ZONING OVERLAY DISTRICT (ZOD) ORDINANCE TO THE CITY COMMISSION FOR CONSIDERATION, AS PART OF THE STRATEGIC PLAN FOR THE NEIGHBORHOOD INITIATIVE (CNI) APPLICATION; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Opa-locka City Commission strongly supports the Opa-locka Community Development Corporation's (CDC) Choice Neighborhood Initiative (CNI) application; and WHEREAS, the City Commission of the City of Opa-locka desires to create a Zoning Overlay District (ZOD) for the Nile Gardens project area, which would be accomplished through an ordinance; and WHEREAS, the City Commission of the City of Oa-locka directs the City Manager to create a Zoning Overlay District (ZOD) Ordinance for the Nile Gardens area, to be presented to the City Commission for consideration. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka, hereby directs and authorizes the City Manager to create a Zoning Overlay District (ZOD) to combine the existing and Resolution No. 12-8361 proposed land uses within the Nile Gardens area, to be presented to the City Commission for consideration. Section 3. This resolution shall take effect immediately upon adoption. PASSED AND ADOPTED this 20th day of March, 2012. Staff Summary: The Opa-locka Community Development Corporation has requested that the City of Opa-locka pass a resolution directing the City Manager to create a ZOD to combine the existing and proposed land uses within the project area. The resolution will also direct the City Manager to bring the ZOD back to the City Commission for ratification through an Ordinance. Creating a ZOD may have a fiscal impact due to the potential need to retain professional services to create such a proposal. Proposed Action: Staff Recommends Approval of the proposed Resolution.
