HomeMy Public PortalAbout1991-11Member introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. (// // RESOLUTION DENYING A REQUEST FOR REZONING (GEORGE C. GUBBINS, JR.) WHEREAS, George C. Gubbins, Jr. (Applicant) has applied for rezoning of a 33 + acre tract from rural residential (RR) to rural commercial (RC); and WHEREAS, the land which is the subject of the application (Property) is located generally south of T.H. 55 and north of Pioneer Trail and is legally described on Exhibit A attached hereto; and WHEREAS, following published and mailed notice, the planning commission held a public hearing on the proposed rezoning on January 8, 1991, at which hearing the Applicant and other interested parties were allowed to address the commission orally and in writing; and WHEREAS, after due consideration, the planning commission voted to recommend against rezoning the Property as requested by the Applicant; and WHEREAS, the city council considered the matter at its meeting on January 15, 1991, at which time the Applicant addressed the council concerning the rezoning request; and WHEREAS, the city council has thoroughly reviewed the matter and has considered the testimony of all interested persons regarding the request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the City Council makes the following findings: 1. The Property is currently zoned RR, which zoning district allows low density residential uses as well as certain uses accessory thereto. 2. The City's currently effective comprehensive plan, which was adopted in 1980, guides the Property for rural residential use. 3. The new comprehensive plan, which the City adopted in 1990 and is currently under review by the Metropolitan Council, confirms that the appropriate land use for the Property is rural residential. 4. The Applicant proposes to use the site for construction of an office building, which use would require rezoning the Property to a commercial district. 5. Rezoning the Property to a commercial district would allow the Applicant or a future owner to use the Property for any one of a large number of commercial uses and, following rezoning, there would exist no method to restrict use of the Property to an office building. 6. The City is currently considering rezoning the Property and other adjacent lands to rural residential-2 (RR-2). NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina that the Applicant's request is hereby denied for the following reasons: 1. Rezoning the Property as proposed by the Applicant would be inconsistent with the City's existing and proposed comprehensive plan. 2. Rezoning the Property as requested by the Applicant would constitute spot zoning because it would create a zone which is incompatible with the zoning of surrounding property.
