HomeMy Public PortalAbout1991-14Member fib -124 1 � introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. i'% /i4- RESOLUTION GRANTING PRELIMINARY APPROVAL OF MOHAWK ESTATES SECOND ADDITION WHEREAS, Harold Pederson (Applicant) has requested preliminary approval of a plan to subdivide a tract containing 71 acres + according to the survey attached hereto as Exhibit A; and WHEREAS, the planning commission and city council have reviewed the preliminary plat submitted by the Applicant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that preliminary approval is granted for Mohawk Estates Second Addition, subject to the following conditions: 1. The Applicant must obtain the approval of the plat from the Elm Creek Watershed District under current floodplain regulations; 2. It is acknowledged that Lots 1-5, Block 1, are large enough to accommodate animal structures; 3. Approval of the plat is based on the report from Braun Engineering and the city engineer's review thereof regarding the existence of suitable on -site soils for construction of individual septic systems; 4. The final plat must dedicate to the public the right-of-way along Mohawk Drive required by the city engineer; 5. The final plat must dedicate utility easements along all lot lines and the drainage easements required by the city engineer; 6. Only Lot 4 may have a driveway off of the cul-de-sac; 7. The final plat must show the two septic sites on each lot which the Applicant has tested and shown to be satisfactory for the installation of on - site septic systems; 8. The Applicant must enter into a private road development agreement in a form satisfactory to the city attorney; 9. The Applicant must pay to the city a park dedication fee for all lots in the subdivision, except Lots 3 and 4, Block 1; 10. The Applicant must pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of reviewing the subdivision; 11. The Applicant must submit a current abstract of title or registered property abstract covering all land within the subdivision for review by the city attorney; and 12. The Applicant must submit the final plat to the city for approval within 180 days of the date of the adoption of this resolution, which final plat shall in all material respects conform to the preliminary plat, except that it must incorporate all changes and modifications required by this resolution. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina that a variance is hereby granted to increase the length of the street from 750 feet to 1,150 feet on the grounds that the configuration of the property and the location of existing buildings thereon constitute a hardship.
