Pur ose: To inform and provide a status update on the process to amend Project Area "A" relative to the Agency's Eminent Domain authority. Recommendation: Staff respectfully requests that the Agency receive and file the presented information. 5. ACQUISITION OF THE A HUD OWNED SINGLE FAMILY DWELLING .LOCATED AT 3333 JOSEPHINE STREET, UTILIZING THE CITY OF LYNWOOD'S PURCHASE AND REHABILLTATION PROGRAM IN CONJUNCTION WITH HUD'S $1 HOME SALES TO LOCAL GOVERNMENT. Pur ose: To receive. approval from the Agency to utilize the .Purchase and Rehabilitation Program to acquire the abandoned single family dwelling located at 3333 Josephine Street for $1 (One Dollar) from the Department of Housing and Urban Development (HUD) and to establish an ongoing participation procedure for the Agency to participate in HUD's $1 Home Sales to Local Governments Program. Recommendation: Staff respectfully requests that after consideration of the above facts the Agency approve the following: . Authorize Executive Director to utilize the Purchase and Rehabilitation Program to acquire the property .located at 3333 Josephine Street from HUD and allows the Executive Director to execute the necessary documentation needed to complete the said purchase. Allowing the Executive Director the authorization to execute and submit as .needed the necessary documentation to bid on the $1 Home Sales To Local Government Program. Member Reyes stated he would like more information on the ,proposal presented. Stated he is not prepared to make a decision. . City Manager Davis stated this is Phase I,'no proposal has been submitted yet. ; Councilman Rea discussed our open door policy. Stated this .project would greatly enhance the blighted area at I-105 Freeway. Mayor Byrd stated this is just a concept and asked Councilman Richards to explain. Councilman. Reyes stated he has not heard from staff on the project Councilman Richards explained the reason of the presentation. The Developer wants to know if the City is interested in the possibility of this project. june6.2000r ';1 , • . ~ Mr. Vovos representative stated he is ready to make the investment, but wants to . know if Council. approves of their concept.. Stated this is a major doNar commitment. f Councilman Sanchez recalled someone making a presentation to Council prior, but no one came back. Stated he is .looking forward to seeing. the project come to Lynwood. Mr. Vovos representative stated they are working with Chevron and Mobil Oil about the site at Long Beach .Blvd... and Josephine. Stated this would be the central training office and that various training opportunities will be offered. ; Councilman Rea stated any developer should follow proper procedure that is to present an ENA to the City, and decisions are. done in the open for public review. Stated the decision should not be done in secret. Mayor Byrd asked Director of Community Development Chicots to explain this project. Director of Community Development Chicots discussed the Vovos project. Discussed his job training element and the fact that he owns most of the land that is required for the project. ENA. is not .really needed. Discussed some of the .projects going on at Atlantic Avenue, Lmperial Highway, and Long Beach Blvd. Councilman Reyes stated he was trying to get involved in the Redevelopment Committee. Mayor Byrd offered his seat on the committee to Councilman Reyes. City Manager Davis stated the Redevelopment Committees' intent was just to introduce the developer to the Council. Councilman Richards explained why it was not- an agenda item: Stated the ..presentation was just to explain the concept to the Council. Discussed the_mariy projects on the table, and all Agency/Council Members have the right fo participate in the decision-making. Requested the proposal be brought back to the next. meeting. F Councilman Rea stated he takes exception from Community Development Director Chicots comments, and, proposals should come with .proper documents; .PUBLIC HEARING ITEM E Item #3: Proposal to lease Agency-property It was moved by Member Richards, seconded by Member Reyes and carried to open the pubic hearing. Discussed big box idea/concept. Wants to put a retail project on that site. It was moved by Member Rea died for a lack of a second. Chairman Byrd discussed problems associated with the site. Stated Cal Trans owns the property and state that only a day care center can be built on that site. Stated if we can remove the restriction maybe the project can be reconsidered. There is a covenant on the land. Member Richards discussed Mr. Whited tenacity working on this project. Discussed recent .issues (possible child care center). Stated he would like to sort out issues and discussed possible resources available with regard to the project. Discussed County 108 monies. Chairman Byrd asked the City Manager Davis to schedule a meeting with Cal Trans and everyone involved in that piece of land. Asked to schedule a :meetirig for possibly June 14, 2000. Davis, III, Executive Director ' ~ By: Gary Chicots, Director !~ .Community Development ~ ~`~~~ Louis Morales, Manager .Planning & Redevelopment Subject: INFORMATION ITEM ON A PLAN AMENDMENT TO REDEVELOPMENT PROJECT AREA "A". Purpose: To inform. and provide a status update on .the process to amend Project Area "A" to extend Agency's eminent domain authority within .the project area. Facts: 1. The original Redevelopment boundaries for Redevelopment Project Area "A" (the "Plan") were formed in July 1973 and the duration of the .Plan was until January 1, 2004. 2. The Plan has been amended several times to extend the life of the Plan. The most recent Plan amendment (Amendment No. 6) was approved on ;July 19, 1988 by the City Council under Ordinance No. 1308. 3. Amendment No. 6 Section 403.1 Eminent Domain stated that no eminent domain proceeding to acquire property within the Original Project Area arid .Project Area Expansion shall be commenced after twelve (12) years following the date of adoption of the ordinance approving Amendment No. 6. This period of time may be extended only by amendment of the Redevelopment Plan. 4. Eminent domain authority for Project Area "A" is set to expire on July 19, 2000. The proposed amendment to the Redevelopment Plan would extend the eminent domain authority of the Agency for another.twelve year period: Analysis: Staff has- initiated the amendment process and has been working with Agency Special Counsel (Kane Ballmer & Berkman) and Mike Wagner & Associates to prepare the proposed amendment. Pursuant to California Redevelopment Law the formation of a .Project Area Committee ("PAC") will be required to rev",iew and recommend either approval.. or disapproval of the proposed amendment to the City Council.. ~. The PAC will be comprised of business and property owners within they Project Area.. Staff has compiled approximately 1,700 labels for mailers and information that will be sent to all such business and property owners informing them of the intent of the Agency to move forward. with the adoption of the proposed amendment. Before the Agency conducts a joint public hearing with the City Council to approve the proposed amendment, the PAC must first meet in a series of meetings (approximately three meetings), elect officers and ultimately ~~ H:word/redevelp/imora les/emminntdma inext AGEi~'DA ITEM i recommend approval or disapproval of the proposed amendment.. if the. PAC approves the amendment a simple majority approval by the Agency/City Council will be needed to approve the proposed amendment. In the event that the PAC does not recommend approval of the proposed amendment the Agency/City Council will have to approve the amendment with a minimum of a 4/5 vote.of the City Council. The process will take approximately 90 days to complete. Don Adams, Housing Project Manager y , SUBJECT: ACQUISITION OF A HUD OWNED SINGLE FAMILY DWELLING LOCATED AT 3333 JOSEPHINE STREET, UTILIZING THE CITY OF LYNWOOD'S PURCHASE AND REHABILITATION PROGRAM IN CONJUNCTION WITH HUD'S $1 HOME SALES TO ~ LOCAL GOVERNMENT PROGRAM PURPOSE: To receive approval from the Agency to utilize the Purchase and Rehabilitation Program to acquire the abandoned single family dwelling located at 3333 Josephine Street for' $1 (One Dollar) from the Department of Housing and Urban Development (HUD) and.to establish an ongoing participation procedure for the Agency to participate in HUD's $1 Home Sales to Local Governments Program. FACTS: 1. On May 1, 2000, HUD implemented a new program called the $1 Home Sales', to Local Governments Program to expand HUD's partnership with local governments in helping to foster housing opportunities for low to moderate income families and address specific community needs. ; 2. The new program will allow the Agency to acquire HUD owned properties that HUD has previously offered to the public for sale for six months or more and are not presently under a sales contract. The properties not sold after six months will be removed from HUD's marketing inventory and offered exclusively to local governments for $1 (One Dollar) plus closing cost. 3. On .January 5,1999 .the Agency initiated the Purchase and Rehabilitation Program for the purpose of acquiring HUD owned properties, and other Real Estate Owned (REO) properties, repairing the properties and reselling the homes to low and moderate first time home buyers in the City. This program is funded with HOME funds. 4. Under HUD's new $1 HOME Sales, program the Agency has the opportunity to aacquire a two bedroom one bath single family dwelling with a lot size of 8,000 located at 3333 Josephine street -for $1 plus closing cost. The estimated cost to acquire the property;is $2501. The deadline for submitting a sale contract to HUD for this house is June 21, 2000. 5. The agency needs to establish, through resolution, an ongoing process to allow the Executive Director the flexibility to participate in this new program to prevent the Agency/City from missing HUD's ten (10) day exclusive availability time period. ANALYSIS: HUD has established a new housing program that will assist the Agency/City's overall strategic housing .effort of removing blighted conditions in depressed neighborhoods, allow the Agency/City to acquire single family property at a significantly reduced cost, provide a home that can`be resold to a low or moderate income family at a affordable price, and offset the Agency's cost of implementing and maintaining a new housing program. The implementation of the $1 Home Sales Program opens many doors of opportunity for the community and allows HUD to dispose of their inventory of properties that they cannot otherwise sale. To be eligible to participate in this new program the City may purchase properties within the City of Lynwood boundaries and must meet the following criteria: 1. Identify the intended disposition strategy and clear public purpose goals and objectives it will pursue with properties purchased through this program; ;d~G,E1~bA IT;/HC -- . 2. Affirm that all profits from resale of these $1 homes will go to support local housing/community development initiatives; 3. Identify what specific programs or uses these profits will support; and i 4. Agree to provide HUD's Homeownership Center (HOC) Program Supports Division Directorwth a report on June 1,2000 and annually thereafter for alt properties purchased under this program. The report must include information on the ultimate, property purchaser, the amount of profit realized on the final sale and where the profit was used. i The Agency/City meets the requirement by utilizing the City of Lynwood's Purchase and Rehabilitation Program which .was established in January of 1999 to enable the City to purchase and rehabilitate properties abandoned and currently owned by the Department of Housing and Urban Development (HUD) and other bank-Real Estate Owned (REO) properties that are located in the City.. Properties once purchased will be rehabilitated and made available for immediate resale to eligible low and moderate-income households. Per HUD Requirements, proceeds from the sale of the properties will be used to replenish the program cost and to purchase other property. One area of opportunity is sales of single family real estate owned properties to local governments. The following changes to F{UD's policy 'fin' the salt of these properties will be in cf~tcct on May 1, 2000: • Special Offering of Aging Inventory Properties to Local Governments Properties which have been offered to the public for sale for six or snore months and are not presently under a sales contract will be removed from the market and offered exclusively to local governments for $1 plus closing costs. To be eligible to participate in this new sales program, local goverrunents may purchase properties within their jurisdiction and must: 1. identify the intended disposition strategy(ies) and clear public purpose goals and - objectives it will pursue with properties purchased through this program; 2. affirm that all profits from resales of these $ l homes will go to support local housing/cornmunity development initiatives; 3. identify what specific programs or uses these profits will .support; and 4. agree to provide HUD's Homeownership Center (HOC) Program Support Division Director with a report on June 1, 2000 and annually thereafter for all properties purchased under this program. The report must include information on the ultimate property purchaser, the amount of profit realized on the final sale and where the profit was used. Do not include any period of time a property has been held off the i market. The total marketing time only includes days actually listed for sale. For example,; properties temporarily removed from the market when HUD enters into a sales contract which are then relisted for sale due to the purchaser's failure to close, the days the property was temporarily held off the market are not counted toward the 180 day threshold. When the property is placed back on the market, the clock will resume ticking towards meeting the six or more months of marketing to qualify for this program. t On May l , 2000, all M&M contractors must inform the local governments of the j start of this new program. A sample letter. is attached that must be used by the M&M contractors to complete the notification process. Properties must be made available to local governments on a weekly basis with new properties being added as they reach at least six months of marketing exposure. The properties must remain available exclusively for purchase by local governments for 10 ~ calendar days. A form HUD-9548, Sales Contract, must be received within this period ofd time for consideration for the $1 sale. In addition,. the local governments will be required to absorb the closing costs involved with each property sale transaction. M&M contractors are to~ensure that their websites are properly maintained to ensure accurate, up to date, information relative to property availability. • Outreach efforts by HUD and M&M contractors Many local governments are unaware of the opportunities for purchase of HUD- owned single family homes. HOC staff, in conjunction with local Community Builders, and the M&NI contractors must immediately begin conducting outreach efforts to all .local; governments within their jurisdiction.. M&M contractors must complete the notification of this new program to the local governments within one week from the date of this Notice. HOC REO staff must ensure that the M&M contractors complete this notification promptly. , • Demolition consideration. 6 It should be noted that the local government may recommend the demolition of any property which is currently available for purchase by that entity. To consider demolition, the following criteria must be met: 1. HUD's last listed price, plus the cost of rehabilitating the property to meet HUD's Minimum Property Standards (MPS) is more than 130 percent of the after rehabilitation value. The determination of rehabilitation cost and the after rehabilitation value may require the M&M contractor to procure the services of a structural engineer, appraiser; and/or special inspectors. The appraisal must include the fair market value of the land. The cost to procure the previously mentioned services will be treated as pass through expenses. ~2. The cost of demolition may not exceed the cost of rehabilitating the property to meet MPS. 3 __ ~ 3. Review the Environmental Cennpliance Record t~~ determine whether the property is listed on the National Register of Historic Places or located in a Historic District. If , the property is classified as "historic", review any conditions on the disposition of the property to determine whether demolition is permitted. If so, follow any conditions imposed in conjunction with the demolition. In the event that the M&M contractor and HUD are in agreement that the above . criteria have been satisfied, demolition of the property should be completed by the M&M contractor. HUD will pay for the demolition and clearing of the debris. Following demolition, the land should be listed for sale to the general public for 10 calendar days at its fair market value. The M&M contractors are reminded that the sales commission for vacant lots is 10 percent with a minimum of $200. Should no acceptable offers be received from the general public, the land should be offered to the local govet•runents for $1 for 10 calendar days. In the event the local governments have no interest in the land, the property would be relisted on the general listing until the property is sold. • Offering to Officer Next Door/Teacher Next Door Participants If the local governments fail to submit a sales contract within the timeframe identified above, the single unit properties should be relisted for sale exclusively to Officer Next Door/Teacher Next Door participants fora 10 calendar day period. During this time,. the property will not be offered to nonprofit organizations and units of state and local goverrunents. Best Offer Approach Should properties remain unsold after the offering of aging inventory to Officer Next Door/Teacher Next Door Program participants, the property should be relisted for sale to the general public. • Restatement of As Is Policy HOC staff and the M&M contractors are reminded that properties are sold "as is." The Department believes that an "as is" sale is the fairest, most straight forward sales method. However, even though HUD. sells its properties "as is," it is HUD's policy, as a good neighbor, to keep the properties in a safe, secure, and well-maintained manner. Specifically, HOC staff must ensure that as required by their contract, the M&M contractors: 4 . ~ ; • Routinely inspect and take all actions necessary to preserve, protect, and maintain each property in a presentable condition at all times. • Secure the property to prevent unauthorized entry using a locking system determined to be acceptable to the GTR; . Protect the property from damage from the elements, through such measures as repairing broken windows, patching roof leaks, and replacing functional shutters; • Correct ANY condition that presents a health. or safety hazard to the public or to the ; property within 24 hours of discovery.
