HomeMy Public PortalAbout04-23-09c A Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor Daniel J. Reiman at 6:00 P.M., Thursday, April 23, 2009, Council Chambers, Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. Upon individual roll call vote the following were noted present: Councihnember Vincent Bellino " Iris Colon " Jorge Diaz " Susan Naples " Joseph W. Sitarz Noted Absent was Councilmember Randy Krum. Also noted present was Kathleen M. Barney, Municipal Clerk and Robert Bergen, Borough Attorney. The meeting was opened with a minute of silent prayer and the Pledge of Allegiance led by Mayor Daniel J. Reiman. The Clerk stated on January 5, 2009 the 2009 Annual Notice was mailed to The Home News Tribune, The Star Ledger and posted on the Bulletin Board. It was published January 8, 2009. Pledge of Allegiance STATEMENT OF MEETING NOTICE MINUTES FOR APPROVAL 1 APRIL 2<l, 2009 Minutes for Approval Cant: present, the Minutes of April 8, 2009 were approved and transcribed and engrossed by the Clerk. COMYlENDATIONS American Legion Band. Mayor Reiman asked Captain George King, Co-Captain Warren Horn and Band Manager Daniel Tornambe, representing the American Legion Marching Band, to come forward. He explained we had a special joint resolution presented by Governor Corzine and signed by Senate President Richard Codey and Joe Roberts, Speaker of the New Jersey General Assembly and that it is a joint legislative resolution sponsored by Senator Joseph Vitale and Assemblyman Wisniewski. American Legion Band Legislative Resolution Mayor Reiman then read the resolution into the record: "WHEREAS, the Senate and the General Assembly of New Jersey are pleased to salute and congratulate the Senior Marching Band of American Legion, Carteret Post #263, esteemed within the Garden State Community recognition of its noteworthy performances; and WHEREAS, under the exceptional guidance of Captain George King, Co-Captain Warren Horn and Band Manager Daniel Tornambe, the Senior Marching Band and Color Guard received the highest accolades during the Convention of Posts in Wildwood By the Sea, in September, 2008; and WHEREAS; these Gentlemen are respected for giving generously their time and energy to American Legion Carteret Post #263 and the depth of their knowledge and the brunt of their experience have contributed immeasurably to the praise for the accomplishments of the Senior Marching Band; and WHEREAS, their exemplary talents and efforts in seeking and achieving excellence have earned them and the members of the Senior Marching Band a respect and admiration of the New Legislature and the people of the State of New Jersey; 2 NOW, THEREFORE, LET IT BE RESOLVED by the Senate and General Assembly of the State of New Jersey, that this Legislature hereby salutes and congratulates the American Legion Senior Marching Band for their meritorious efforts and useful talents evidenced by their many accomplishments; BE IT FURTHER RESOLVED that a duly authehticated copy of this resolution be signed by the Senate President, former Govemor Richard Codey and the Assembly Speaker Joseph Roberts and attested to by the Senate Secretary and Assembly Clerk." Mayor Reiman said this was a long time in coming explaining this is for accomplishments achieved towards the later part of last year and we are happy to have received it and finally able to present it to them. He also explained that Senator Vitale was to have been here this evening for this presentation, but he was called away on business and so he is doing the presentation of the Senate and Assembly joint resolution to them. He then asked Councilmember Bellino to present our special meritorious awards for the Borough of Carteret. Councilmember Bellino read the words to the meritorious award into the record: "In recognition of distinguished service to the American Legion Carteret Post 263 Senior Marching Band, in continuation of its tradition of exceptional performance and its history of achievement as acknowledged throughout the State of New Jersey." Mayor Reiman congratulated them and thanked them for their contributions to Carteret and the Senior Marching Band. Mayor Reiman PRESENTATIONS Carteret Junior Wrestling Team: Mayor Reiman recognized Councilmember Diaz as the Head Coach of the team and the originator of the program. He then asked Councilmember Diaz to speak about the program. Councilmember Diaz thanked the Mayor and Council for giving the opporiunity for the team to be recognized. He then gave a short scenario on the program. He said about five years ago the school system implemented a wrestling program in the Middle School and the High School and then last fall, with the support of the Mayor and the Council and the Recreation Commission, they were granted permission to establish the first wrestling program. He said they were pleasantly surprised that approximately thirty (30) children, elementary level, from age five (5) to about ten (10) or eleven (II), participated in the program. He then introduced the coaches, Michael Disanto and Larry Phillips and went on to explain that this is a wrestling team representing Carteret that went up against other towns. He also recognized the parents who suppotied them at their games and practices and asked that they receive a round of applause. He then announced, on behalf of the Mayor, each wrestler would receive a ceriificate. Mayor Reiman then read the words to the meritorious award into the record: "For their pariicipation in Carteret's first Junior Wrestling Team promoting spirit, athletic competition as a representative of the Carteret Spotis Program and Organization presented this day, the twenty third day of April, 2009." He then presented the coaches with a meritorious award: Jorge E. Public Hearing Closed After no ftuiher discussion, upon MMS&C by Councilmembers Sitarz and Naples and unanimous affirmative vote of the five (5) Councilmembers present, the Public Hearing on the 2009 Local Municipal Budget was closed. . ORDINANCE #09-04 "CAP Ordinance to Exceed Index Rate" The Clerk stated that Ordinance #09-04 was introduced and adopted on First Reading at an Agenda Meeting of the Borough Council of the Borough of Carieret held on March 19, 2009. It was duly published in The Home News Tribune on April 10,2009 with notice that it will be considered for final passage after Public Hearing to be held on April 23, 2009 at approximately 7:00 P.M.. The Ordinance posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Public Hearing Upon MMS&C by Councilmembers Sitarz and Naples and unanimous affirmative vote of the full Council present, the Mayor declmed the Public Hearing to be opened. There were no comments from the public. Hearing Closed There being no fuliher comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C by Councilmembers Sitarz and Naples. and unanimous affirmative vote ofthe five (5) Councilmembers present. Upon MMS&C by Councilmembers Sitarz and Naples ORDINANCE #09-04 "ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIA nON LIMITS AND TO ESTABLISH A CAP BANK N.J.S.A. 40 A: 4-45.14 6 was finally Adopted. Upon individual roll call vote Councilmembers Bellino, Colon, Naples and Sitarz voted in the Affirmative. Councilmember Diaz Abstained and Councilmember. Krum was noted Absent. REIMAN Adveliised as Finally Adopted: MAY 3. 2009 Upon MMS&C by Councilmembers Sitarz and Bellino and unanimous affirmative vote of the five (5) Council members present the Public Potiion on Resolutions/Agenda Items and New Business was opened to the public. There were no comments from the public. After no furiher discussion upon MMS&C by Councilmembers Bellino and Sitarz and unanimous affilmative vote of the five (5) Councilmembers present, the public poriion of the meeting was closed. Mayor Reiman then asked if the Council had any questions on Resolutions #09-93 thru #09-101. Mayor Reiman referred to #09-96 "Supporting S-2266 Recovering Costs and Fees Associated with an ABC License Charged with a Violation." He explained as recalled in the past all cities in the state are responsible for prosecuting ABC Licenses and unfortunately only the State of New Jersey can levy fines against the violators who have ABC licenses. He said, if adopted by the Senate and the Assembly, this would provide us to recover any costs with special prosecution of these licenses and that Senator APRIL 23, 2009 ORDINANCE #09-04 Adopted Public Portion on Resolutions/Agenda Items and New Business Public Portion Closed Mayor Reiman 7 APRIL 23, 2009 Consent Agenda RESOLUTION #09-93 "Directing the Issuance of Various Raffle Licenses" RESOLUTION #09-94 "Approving Special Improvement Properties for 2009" RESOLUTION #09-95 "Professional Services- Beacon Planning and Consulting Services, Re: Various Engineering Services" RESOLUTION #09-96 "Supporting S-2266 Recovering Casts and Fees Associated with an ABC License Charged with Violation" RESOLUTION #09-97 "Authorizing Excel Environmental Resources Inc. to Apply for Grant Funding for 45-47 Ivashington Avenue" RESOLUTION #09-98 "Authorizing Excel Environmental Resources Inc. to Apply for Grant Funding for 128, 129, 130- 136.Washington Avenue" Vitale has sponsored to work with him on it and we look forward to it be adopted by the Senate and the Assembly. There were no questions from the Council. Mayor Reiman then asked for a motion on the Consent Agenda. Upon MMS&C by Councilmembers Diaz and Sitarz, all bills appearing on the prepared list, properly audited and signed, were ordered to be paid. Upon individual roll call vote Councilmembers Bellino, Colon, Diaz, Naples and Sitarz voted in the Affirmative. Councilmember Krum was noted Absent. Board of Health/Office on Aging - March 2009. Upon MMS&C by Councilmember Diaz and Naples and unanimous affirmative vote of the five (5) Councilmembers present, all Repotis were ordered to be received and placed on file. APRIL 23, 2009 RESOLUTION #09-99 "Approving Change Order No< 1 and Payment No. 2 Re: 2008 Road Program" RESOLUTION #09-100 "Authorizing Issuance of Completion-Titan PDC RESOLUTION #09-101 "Award of Bid-Hermann Avenue Reconstruction" Adopted PAYMENT OF BILLS REPORTS 9 APRIL 23, 2009 COMMITIEES BUILDINGS & GROUNDS - Committee Chairperson Naples reported seasonal work being done and they also helped with Opening Day for the Little League and the Rededication of the Field to Freeholder Director Crabiel; which she felt was nicely done. FINANCE & ADMINISTRATION - Committee Chairperson Diaz reported that the Borough Finance Depariment has applied for extra ordinary aid and said our Budget will not be finalized until we hear back from the state in terms of an application. He went on to say that in addition, the Borough has also applied for fifteen (15) million dollars in aid from the Transpotiation and Equity Act and expressed hope that we will receive some funding to be used towar'ds our ferry terminal service project. Continued Progress. FIRE & DOMESTIC PREPARDNESS - Committee Chairperson Krum was noted Absent, and Mayor Reiman reported progress in the Fire Department and went on to report that the Fire Department's FMBA Division has joined with the Borough Administration to sponsor a bicycle program, to be held Saturday, April 25th and May 30th, from 10:00 A.M. until Noon at the Thomas J. Deverin Community Center. He went on to explain that it will be a bike, skateboard and scooter safety presentation, compliments of the Carieret Firefighters Mutual Benevolent Association Local 67 and that the refreshments will be provided by the Carteret Business Partnership and that our HUD Grant for Community Development Block Grant Funds will sponsoring a safety helmet giveaway and after the presentation the Fire Department will do inspections. PARKS, RECREATION & PUBLIC PROPERTY - Committee Chaitperson Bellino reported the parks open and running baseball, soccer and softball programs and went on to say they have refurbished the Carteret Avenue Field and saved, in excess of $70,000.00, by doing it in house. He then added, in reference to Fire, that Kinder Morgan donated a refurbished GMC Home 10 Tallker and the transfer will be on Wednesday, April 29th at the Carteret Fire House. Progress. POLICE: Committee Chairperson Sitarz reported a pilot program on crossing on the crosswalks by the High School. He said they had previously given out warnings, but, today is the first time summons were given out to yield for pedestrians in a crosswalk and there were a total of eighteen (I8) given out and we will be doing this again at various locations. PUBLIC WORKS: Committee Chairperson Colon reported the combined efforts of the Streets and Roads, Recycling and Sewer Departments working to re-mulch all of the landscape areas of Civic Center Pmk, the Library and around Borough Hall and power washing the Waterfront Park and cleaning and sealing the pavers in West Carteret. Progress. BOARD OF EDUCATION: Committee Chairperson Naples reported the Carteret Public Schools will be sponsoring a Pre- School Program for 2009/2010, eXplaining it will be available in every school, it will be a lottery based program with various dates for various letters of the alphabet and the information can be obtained in further detail by going to the school's website. She said an original birth certificate and four (4) proofs of residency will be needed. She made a few announcements, that Nathan Hale School would be having a Tricky Tray fundraiser tomorrow evening at 6:00 P.M. and that today she had the privilege of representing the Mayor at Private Nicholas Minuet School, explaining that every year Minue School honors Private Nicholas Minue on the day he was awarded the Congressional Medal of Honor alld then thallked the Mayor and Council for the Proclamation and their continued support, on behalf of the Minue School Community and that on Saturday, 9:00 A.M., at the Carteret High School Football Stadium, they are hosting Special Olympics and asked that everyone come out and support this and Cmieret's team in this event. Mayor Reiman added that the Special Olympics was the regional one for Middlesex County, Union County, etc. He then went on to 11 APRIL 23, 2009 COMMITIEES Cont: MAYOR., APRIL 23, 2009 MAYOR Cant: say he just received the defeated School Budget from the Boar'd of Education, which they were required to do by statute, explaining that they have engaged special auditors to review it so we can make an educated decision in the point in time when we make any cuts towards the budget, for which we have a statutory deadline to adopt by the middle of May and tl1at we will be meeting with the Board of Education Committee to review any reduction in the tax levy and to address their tax levy issues and then went on to congratulate the three (3) new members elected on the Board of Education and wished them the best of luck. Councilmember Diaz then congratulated Councilmember Bellino and the Par'ks and Recreation Department for a job well done last Saturday at Little League Opening Day. Mayor Reiman concurred and then went on to speak about the demolishing of the Toth Building, Bethlen Hall and a private home across from the Municipal Building which is pari of the preparation for the Health and Wellness Center project, for which construction should start within the next few weeks and months in expectation that it will open by January 2011.
