HomeMy Public PortalAbout1991-26Member introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. - RESOLUTION GRANTING A VARIANCE FOR WILLIAM R. BUSCH, JR. AND SUSAN A. BUSCH WHEREAS, William R. Busch, Jr. and Susan A. Busch (Applicants) have requested a variance to reduce the required lakeshore setback from 200 feet to 150 feet and to reduce the required setback for a septic system from 150 feet to 115 feet to construct a house at 2924 Willowood Farm Road; and WHEREAS, Sections 825.45 and 720.61 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning and septic ordinances be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicants' request and has recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicants regarding their request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for the above variances is granted, subject to the following conditions: 1. The variances granted herewith are the maximum setback variances allowed for this lot; 2. The Applicants must use a mound septic system and the primary site must be located in close proximity to the house; 3. It is noted that the location of the house above the floodplain, as stated in the surveyor's letter dated June 12, 1989, is a critical factor in the City's willingness to grant the requested variances; 4. The septic system must be pumped at least annually and the City must be notified of the date it is pumped; 5. The City's willingness to grant the requested variance is based on the work done by Steve Shirmers and a record of Mr. Schirmers' borings are made a part of the record regarding this matter; 6. The Applicants must address the installation of low water usage appliances to the satisfaction of the City's building inspector; 7. The minutes of the planning commission and city council meetings, at which this request was discussed, are to be made a part of the address file for this property; and 8. The Applicants shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this variance application. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the variances hereby granted are justified by the topography and soil conditions of the lot. DATED: /tom• / 7, 1991.
