CALL TO ORDER: Mayor Atkins called the regular meeting of the City Council to order at 7:35 p.m. on Tuesday, February 3, 1981, in the Council Chamber of the City Hall. 2. INVOCATION: The invocation was given by Reverend Mike Brown, Bethlehem Evangelical Lutheran Church, 5319 N. Halifax Road. 3. The Pledge of Allegiance to the Flag was led by Mayor Atkins. 4. ROLL CALL: Present: Councilmen - Dennis, Gillanders, Merritt, Tyrell, Atkins Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Kimbrough, Chris Peterson, Associate Planner, and Julie Estrada, Temple City Times. 5. CONSENT CALENDAR: On motion by Councilman Gillanders, seconded by Councilman Merritt, Items A through F on the Consent Calendar were approved as recom- mended: A. APPROVAL OF MINUTES - Regular Meeting of January 20, 1981 Approved as written. B. RECOMMENDATION FROM PARKING COMr1ISSLON - RENEWAL OF AGREEMENT TO CROSS PEDESTRIAN MALL NO. 3 - A.W. DRIVER, 9611 LAS TUNAS. Approved subject to conditions 1 through 6 on staff memo dated January 5, 19 81 . C. RECOMMENDATION FROM PARKS AND RECREATION COMMISSION - REQUEST FOR USE OF LIVE OAK PARK, TEMPLE CITY AMERICAN LITTLE LEAGUE Approved request to use Live Oak Park to conduct a Pancake Breakfast June 6, 1981 subject to the required Certificate of Insurance. D. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of January 27 (1) PROPOSED AMENDMENT TO TEMPLE CITY ZONING CODE SECTION 9278.1 RELATING TO ADDITIONS TO NON- CONFORMING STRUCTURES. Set public hearing February 17, 1981 to consider Planning Commission recommendation. (2) PROPOSED AMENDMENT TO TEMPLE CITY ZONING CODE SECTION 9563 RELATING TO DESIGN CRITERIA REGARDING MINIMUM LOT AREA FOR CONDOMINIUM DEVELOPMENT AND MINIMUM LOT WIDTH FOR 2 -STORY Set public hearing February 17, 1981 to consider Planning Commission recommendation. (3) PLANNING COMMISSION ACTION Received and filed memo relating to the action taken by the Planning Commission at their regular meeting held January 27, 1981. RESOLUTION NO. 81 -1959: DECLARING INTENTION TO VACATE A PORTION OF NORTHEAST CORNER OF ELM AVENUE AND MUSCATEL AVENUE Adopted Resolution No. 81 -1959 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING ITS ,INTENTION TO VACATE A PORTION OF THE NORTHEAST CORNER OF ELM AVENUE AND MUSCATEL AVENUE IN SAID CITY, AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO THE PRO- POSED VACATION, setting public hearing March 3, 1981. F. RESOLUTION N0. 81- 1960: WARRANTS AND DEMANDS Adopted Resolution No. 81 -1960 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $44,561.47, DEMAND NOS. 1396 THRU 1463. 6. UNFINISHED BUSINESS: A. ORDINANCE NO. 81 -499: 2nd read. AMENDING SECTION 9460 OF THE TEMPLE CITY ZONING CODE - .Enforcement City Manager Koski presented background information, stating the City Council, at their regular meeting held January 20, 1981, held first reading on subject ordinance and referred the matter to the Planning Commission for their comment. Planning Commission reviewed the ordinance and concurred. City Attorney Martin introduced Ordinance No. 81 -499 for second reading by title only. Councilman Tyrell moved to waive further reading and adopt, seconded by Councilman Merritt and carried. B. PUBLIC HEARING: ENVIRONMENTAL IMPACT REPORT, CONDITIONAL USE PERMIT CASE NO. 80 -602 - TENTATIVE TRACT NO. 41245 9021 EMPOROR AVENUE City Manager Koski presented background information, stating the Planning Commission, at their regular meeting. held January 13, 1981, held public hearing and adopted a resolution recommending approval of the Environmental Impact Report, Conditional Use Permit and Tentative Tract No. 41245 for an 18 unit condominium development located at 9021 Emperor Avenue. City Council set public hearing February 3, 1981. The proposed development will consist of 18 condominium units in three structures, each two stories high and meets all standards for condominium construction. Councilman Merritt inquired about the drainage, stating that at one time a wash went through that property. City Manager Koski stated the water will be diverted to a pipe on the west side of the property. By use of Exhibit, Associate Planner Peterson, stated the wall along the north and east property lines will be redesigned to minimize the impact of the separation wall and that the roof on the elevations above the closet areas shall be changed to mansard roofs to match the remaining roofs, and also on the north side of all three build- in g s Councilman Tyrell moved to include the Planning Commission minutes as part of the record, seconded by Councilman Gillanders and carried. Mayor Atkins declared the public hearing open and invited anyone wishing to speak to come forward. Mr. Richard Renner, 8555 Village Lane, Rosemead, stated he had nothing to add to his application but would be happy to answer any questions Council may have. Mr. Richard Madama, 9031 Emperor Avenue, stated the developer has been very cooperative, but he was still concerned. about the tree between his property and the property in question, and inquired whether the developer could take that tree out. Mr. Madama was advised if the tree is right on the property line it would be a matter to be resolved between himself and the developer. Council Minutes, February 3, 1981 - Page 3 There being no one else come forward to :speak, Councilman Gillanders moved to close the public hearing, seconded by Councilman Merritt and carried. Councilman Gillanders moved that the City Council certify the Environmental Impact Report has been completed in conformance with the California Environmental Quality Act and the State guidelines, that it be amended to include comments at the public hearing and accepted as the final EIR which is adequate and provides reasonable information on the project and therefore approved with all findings set forth in City Attorney memo dated February 1, 1981, seconded by Councilman Dennis and carried. Councilman Dennis moved to approve Conditional Use Permit No. 80 -602 and Tentative Tract No. 41245 as set forth in Resolution No. 81- 925PC, seconded by Councilman Gillanders and carried. C. ORDINANCE N0. 81 -500: 2nd read. PROHIBITING OCCUPANCY OF VEHICLES BETWEEN 3:00 a.m. and 5:00 a.m. IN PUBLIC PARKING LOTS AND PUBLIC RIGHTS -OF -WAY. City Attorney Martin advised that adoption of Ordinance No. 81 -500 would be based on Council's findings that a definite problem is posed by persons sleeping in automobiles which are parked along the public streets within the City; the Sheriff's Department has reported innumerable incidents of persons disturbing residential areas and creating anxiety, residential neighborhoods disturbed by this ac- tivity thereupon call the police to report a suspicious vehicle in the area; and in addition, persons who are parked in developed areas become a target for petty body bandit gangs, thus requiring the Sheriff to advise the sleeping occupant of the automobile to move along. City Attorney Martin introduced Ordinance No. 81 -500 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING SECTION 4115 TO THE TEMPLE CITY MUNICIPAL CODE for second reading by title only. Councilman Tyrell moved, based on the findings outlined by the City Attorney, to waive further reading and adopt. Ordinance No. 81 -500, seconded by Councilman Dennis and carried. 7 NEW BUSINESS: None 8. C01 IIMUNICATIO,NS : A. City Manager Koski presented a communication from Daisy Rollo concerning item pricing of groceries. Councilman Gillanders stated that following the last City Council meeting he had received in excess of 20 telephone calls and a number of letters supporting item pricing. He feels that there is potential solution by surveying the residents through the Newsletter so that people can let City Council know their feelings. If input indicates a public need throughout the community, Council could reconsider its position. Councilman Tyrell advised he had met with Patti Bates and discussed this idea, but he does not feel the survey should be limited to this one item, and he has asked her to prepare a list of possible questions and submit to Council, and then a separate page would be .included in the Newsletter which will be published in March. Mayor Atkins stated that he has been informed that other cities are wrestling with this same problem. 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Boyce O'Bannon, 10316 E. Olive Street, voiced his concern that street name signs are not visible to the motorist at night, stating this matter was discussed at a city seminar about six years ago. Mr. 0' Bannon was advised staff is in the process of investigating the availability of signs which would be more visible and the cost to replace the present signs. Council Minutes, February 3, 1981 - Page 4 Tom Breazeal, 9462 Daines Drive, stressed the importance of providing return postage for the proposed survey in order to get a good response. RECESS TO CRA: City Council recessed at 8:10 p.m. to meet as the Community Redevelopment Agency, all members being present, and approved the minutes of the regular meeting held January 20, 1981. The minutes are set forth in full in the records of the Agency. RECONVENE AS CITY COUNCIL: 10. ACTION ON REQUEST BY CRA: There was no action to be taken. 11. MATTERS FROM CITY OFFICIALS: A. Request Authorization to attend California Parks and Recreation Society Conference - San Diego, March 6 -9, 1981. Councilman Gillanders moved to approve attendance by Parks and Recreation Commission and Director Kobett to the California Parks and Recreation Society Conference in San Diego, March 6 -9, 1981, appropriate additional funds necessary and amend the adopted budget accordingly, seconded by Councilman Tyrell and carried. B. Authorization to Dispose of City Trucks Councilman Dennis moved to authorize staff to solicit bids to dispose of Units 102, 103, and 104, all as set forth in staff memo dated January 29, 1981, seconded by Councilman Gillanders and carried. C. Mayor Atkins directed Council's attention to the annual Coronation of the Camellia Festival Royalty on Friday, February 6, at Temple City High School. D. Councilman Dennis advised he would be attending the League of California Cities meeting and City Selection Committee meeting Thursday, February 5 when election will take place for a repre- sentative to County Transportation Committee and to the South Coast Air Management Committee and invited any Councilman wishing to make input to call him. E. Councilman Gillanders advised he had received a letter from Senator Richardson regarding SB 33 stating his oposition to mandatory vehicle inspection. Councilman Gillanders also advised he would be attending a meeting of SCAG Transportation and Utilities Committee meeting Thursday, February 5. F. .Councilman Tyrell advised he had attended a meeting regarding the N.I.P. program given by the Sheriff's Department February 2. 12. ADJOURNMENT: On motion by Councilman Tyrell, seconded by Mayor Atkins, meeting adjourned at 8:25 p.m. Next regular meeting of the City Council will be held Tuesday, February 17, 1981, 7:30 p.m. in the Council Chamber of the City Hall.
