RESOLUTION NO.
RESOLUTION GRANTING PRELIMINARY
PLAT APPROVAL FOR TUCKBOROUGH
FARM THIRD ADDITION
WHEREAS, Hunterland Corp. (Applicant) has requested preliminary plat
approval for approximately 80 acres according to the survey attached hereto as
Exhibit A; and
WHEREAS, the planning commission and city council have reviewed the
preliminary plat submitted by the Applicant for compliance with City
requirements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that preliminary plat approval is granted for Tuckborough Farm
Third Addition, without a north/south collector road, subject to the following
conditions:
1. The radius of the curve on Navajo Road adjacent to Lot 1, Block 1 must be
in accordance with requirements of the city engineer;
2. The Applicant must pay park dedication fees for all lots within the
subdivision except Lots 1 and 2, Block 1;
3. It is acknowledged that Outlot A will be combined with land to the west
when such property is platted;
4. The Applicant agrees to remove the existing shed located on Outlot A prior
to final plat approval;
5. The Applicant agrees to remove the existing house located on Lot 6, Block 2
within two years of the date of final plat approval. After the house is
removed, access to the lot must be from the proposed subdivision road to
the west and not from Medina Road. In order to assure compliance with
these conditions, the Applicant must post a letter of credit with the city in
a form acceptable to the city attorney and in the amount of $10,000;
6. The Applicant must comply with the requirements of the city engineer
regarding ponding and drainage easements over Lots 3 and 8, Block 2;
7. The Applicant must dedicate to the city the trail easements required by the
city engineer;
8. It is acknowledged that Lots 1 and 2, Block 3 will gain access from Medina
Road;
9. The Applicant must dedicate to the City the right-of-way easements for
Medina Road required by the city engineer;
10. The Applicant agrees to pay the City $3,000 per lot as a contribution
towards the cost to upgrade Medina Road. The fee will be payable upon
issuance of a building permit for each of the 13 lots. In order to assure
payment of this fee, the Applicant must enter into a Petition and Waiver
agreement in a form acceptable to the city attorney;
11. The Applicant shall provide a street profile satisfactory to the city
engineer;
12. The drainage between Lots 1 and 2, Block 1 shall be to the satisfaction of
the city engineer;
13. The Applicant must obtain approval of the plat from the appropriate
watershed district;
14. The Applicant must post with the city a letter of credit in the amount of
$73,440 to assure completion of the subdivision road. If the Applicant does
not propose to complete all subdivision roads in the immediate future, the
Applicant must construct a temporary cul-de-sac on Navajo Road at the
western boundary of the subdivision and provide the city with the temporary
easements required by the city engineer;
15. The Applicant must pay to the city for administrative expenses the amount
determined by the city staff to represent the actual cost to the city of
reviewing the subdivision;
16. The Applicant must submit a current abstract of title covering all the land
within the subdivision for review by the city attorney; and
17. The Applicant must submit the final plat for approval within 180 days of the
date of the adoption of this resolution, which final plat must in all material
respects conform to the preliminary plat, except that it must incorporate all
changes and modifications required by is resolution.
