Member "Veil introduced the following resolution and moved its
adoption:
CITY OF MEDINAA
RESOLUTION NO. `/
RESOLUTION GRANTING A CONDITIONAL
USE PERMIT TO WALTER AND OLGA
DIACHUK FOR A HOME OFFICE
WHEREAS, Walter and Olga Diachuk (Applicants) have applied for 7�a
conditional use permit for a home office in their home at /9,;f7 _5-,�i,h1 r ,c)✓'
; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, the planning commission and city council have reviewed the
Applicants' request and have determined that granting a conditional use permit to
the Applicants will not adversely affect the development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, that a conditional use permit for a home office be granted to the
Applicants, subject to the following conditions:
1. Hours of operation are 24 hours per day, 7 days per week;
2. The only persons who may be employed on the property are the Applicants
and immediate family members who reside on the property;
3. Any exterior lighting utilized on the property must be residential in
character;
4. Site drainage must be accomplished in a manner consistent with that shown
on the plan submitted by the Applicants to the City;
5. No loudspeakers or outside telephone bell are permitted on the property;
6. The Applicants must work with the city staff to finalize plans for the
entrance to the property; and
7. The Applicants must pay to the City a fee in an amount equal to the cost of
the City to review this application.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of
the City of Medina, that this conditional use permit is personal to the Applicants
and does not run with the land and that any future owner of the property wishing to
operate a home business from the site must apply for and receive a new conditional
use permit.
