CITY COUNCIL
MINUTES
FEBRUARY 17, 1981
INITIATION:
1. CALL TO ORDER:
Mayor Atkins called the regular meeting of the City Council to order
at 7:34 p.m. on Tuesday, February 17, 1981, in the Council Chamber
of the City Hall.
2 INVOCATION:
The invocation was given by Father Craig Cox, St. Luke's Catholic
Church, 9451 E. Broadway.
3. The Pledge of Allegiance to the Flag was led by Mayor Atkins.
4. ROLL CALL:
Present: Councilmen- Dennis, Gillanders Merritt, Atkins
Absent: CouncilmenY Tyrell._..
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager Kimbrough, Parks and Recreation Director
Kobett, °Chris Peterson, Associate Planner, and Julie
Estrada, Temple City Times.
Councilman Dennis moved to excuse Councilman Tyrell for cause,
seconded by Councilman Merritt and carried.
5. CONSENT CALENDAR:
On motion by Councilman Merritt, seconded by Councilman Dennis,

A. APPROVAL OF MINUTES - Regular Meeting of February 3, 1981
Approved as written.
B. RECOMMENDATION FROM TRAFFIC COMMISSION - Meeting of February 4
LOWER AZUSA ROAD, SOUTH SIDE, AT GLICKMAN AVENUE - PASSENGER
LOADING ZONE
Approved Traffic Commission recommendation to place a 50 -foot
white passenger loading zone on the south side of Lower Azusa Road,
commencing 40 feet east of the east curb line prolongation of Glick-
man Avenue.
C. PLANNING COMMISSION ACTION - Meeting of February 10
Received and filed memo relating to action taken by the Planning
Commission at their regular meeting held February 10, 1981.
D. ACCEPTANCE OF WORK: LIVE OAK PARK SHADE SHELTERS
Accepted the work as complete and authorized payment in the amount
of $24,975.00, filing of Notice of Completion and release of the
10% retention at the end of the 35 -day lien period.
E. ACCEPTANCE OF PROJECT: LIVE OAK PARK PLAY APPARATUS
Accepted the work as complete and authorized payment in the amount
of $12,499.92 upon receipt of waiver of liens.

F. SANTA. ANITA.AVENUE4.- .LIVE.OAK.AVENUE TO GRAND AVENUE
APPROVAL OF PLANS AND SPECIFICATIONS
Approved the plans and specifications for the improvement of
Santa Anita Avenue and inclusion in the 1981 -82 budget.
G. APPROVAL OF FINAL MAP NO. 35584 - 6351 TEMPLE CITY BOULEVARD
Approved final map.and accepted easements offered for dedication;
approved an.agreement for sanitary sewers; found the project will
not violate any of: the. provisions.. of the. Subdivision Map Act and
instructed the City Clerk to endorse the approval on the face of
the map.
H. APPROVAL OF SURVEY MONUMENTS - TRACT NO. 35012, 9807 -9823 E. OLIVE
Approved survey monuments for Tract No. 35012 and released surety
bond in the amount of $1,000.00.

6. UNFINISHED BUSINESS:
A. PUBLIC. HEARING.: .AMENDMENT. TO TEMPLE. CITY ZONING CODE SECTION
9278.1 RELATING TO ADDITIONS TO NON - CONFORMING STRUCTURES
City Manager. Koski presented background information stating the
Planning. Commission. held.. a. study. session to discuss additions to
nonconforming.structures.at less than ordinance minimum should be
limited to side yard setbacks only, with no nonconforming additions
being.allowed-to extend into the required front or rear yard _setback.
At their.regular_meeting..held January 27, 1981, Planning Commission
held public hearing., certified the filing of a Negative Declaration
of Environmental Impact. and. adopted a resolution recommending an
amendment to.Section 9278.1 to clarify this limitation. City Council,
at their regular.meeting.held February 3, 1981, set public hearing
to consider subject amendment for February 17, 1981.
By use of the overhead projector, Associate Planner Peterson
stated- the.code presently allows encroachment for nonconforming
structures.. into the front. and rear portion of the yard, and the
proposed amendment would allow encroachment only into side yards,
beyond that a variance would be required.

There. being no further.staff:report, Mayor Atkins declared the
public hearing.. open_ and-_ invited_ anyone wishing to speak to the
matter_to :come forward. There being no one come forward to
speak, Councilman.Gillanders moved to close the public hearing,
seconded by Councilman Merritt and carried.
Councilman Dennis. moved to certify the Negative Declaration of
Environmental Impact, seconded by Councilman Gillanders and carried.
City Attorney.Martin introduced Ordinance No. 81 -501 AN ORDINANCE
OF THE_CITY.OF.TEMPLE.CITY AMEND.ING.SECTION 9278.1 .OF THE TEMPLE
CITY ZONING ..CODE.for.first.reading.by title only. Councilman
Dennis moved to waive further reading, seconded by Councilman
Gillaners and carried.
B. PUBLIC HEARING: AMENDMENT TO TEMPLE CITY ZONING CODE SECTION
9563 RELATING. TO DESIGN_ CRITERIA. REGARDING MINIMUM LOT AREA
FOR.. CONDOMINIUM. DEVELOPMENT. AND MINIMUM LOT WIDTH FOR 2 -STORY
CONDOMINIUM DEVELOPMENT
.City Manager Koski presented.background information stating that
the Planning.Commission.held a study session and discussed possible
revisions. to the. Condominium. ordinance which would 1) allow condo -
minium_ development on. any properly zoned lot regardless of lot
area with density requirements controlling the number of units on
a lot; 2� removed the.restrictions that two -story structures could
be constructed_only on lots of 100 feet width; and 3) would make
it possible. to. building. two -story condominiums on any approved lot
regardless. of lot width, but would limit the number of units on a
50 foot. lot. to four or less and require 80 feet of lot width for
five or.more units. The Planning. - Commission, at their regular
meeting.held January 27, 1981, adopted a resolution recommending
to the City Council an amendment to the Zoning Code on this matter.
Negative.Declaration of Environmental Impact was certified. City.
Council, at their regular meeting. held February 3, 1981, set
public hearing on this matter February 17, 1981.
There being. no. further_ staff.. report,. Mayor Atkins declared the
public hearing open and invited anyone wishing to speak to come
forward. There.being no one come forward to speak, Councilman
Gillanders moved to close the public hearing, seconded by Council-
man Merritt and carried.
Councilman. Dennis requested the. proposed ordinance be changed to
clarify that. minimum lot. width_ for. four or less units in a one -
story building. is not less. than 50 feet, and for five or more
units or for any two -story building is not less than 80 feet.
Councilman. Merritt.stated.he feels the ordinance should cover
apartment developments as.well. Councilman agreed.;and requested
Council refer the matter to the Planning Commission.
Councilman Gillanders stated that when this matter was orl,ginally
discussed.by Council they were opposed to any two -story building
on a 50 foot.lot;.that the residents have made their feelings
known that any 50 foot lot should be used for singless:tory; eon-
struction. Councilman Gillanders stated he would like to have
this matter continued for a full Council to deliberate.
Councilman Gillanders moved to continue the matter to the next regular
meeting. and. in. the interim to request a review from the Planning
Commission to consider minimum lot width for apartment construction,
seconded by Councilman Dennis and carried.
7. NEW BUSINESS:
None.
8. COMMUNICATIONS:
A. APPEAL - REQUEST FOR TIME EXTENSION TO FILE PARCEL MAP 574
City Manager -Koski presented a letter from Mr. E. Riley Mitz
Council Minutes, February 17, 1981 - Page 4
appealing. Planning. Commission..denial :for an extension. of time to
file Final Parcel.Map 574, outlining.the problems he has encountered
beyond his control.
Councilman Merritt.moved.to grant.a 90 -day extension to May 18,
1981, seconded by Councilman Gillanders and carried.
9. TIME FOR THOSE IN -THE AUDIENCE WHO WISH TO SPEAK:
No one came forward.
RECESS TO CRA:
City Council recessed at 8:05 p.m. to meet as the Community Redevelopment
Agency, Mr. Tyrell being absent, received and filed a letter from Exxon
Company, U.S.A.. relating, to the southwest corner of Rosemead Boulevard
and Las Tunas Drive and approved the minutes of the February 3, 1981,
meeting. The minutes are set forth in full in the records of the Agency.
RECONVENE AS CITY COUNCIL:

11. MATTERS FROM CITY OFFICIALS:
A. Request for Compensation for Unused Sick Leave - Don Hyler
Councilman. Dennis moved to approve request for unused sick leave
accumulated by Don Hyler prior to adoption of Ordinance No. 71 -332,
seconded by Councilman Gillanders and carried.
B. City Newsletter Questionnaire
City Council reviewed the proposed questionnaire to go out with
the March Newsletter and made appropriate changes for redraft.
C. Councilman Dennis stated he had received the staff memo relating
to bus shelters and, in his opinion, there is no need and would be
low on his list of priorities.
D. Councilman Gillanders stated he had received word that
Commissioner McCoy's son had been killed in a traffic accident
and stated the funeral would be held Friday, February 20, 1 p.m.
Councilman Gillanders also stated he had received a communication
from JPIA regarding application for membership by the Cities of
Bishop., Paramount, and Walnut. He felt Paramount is a high risk
and would not be in favor of adding that city.
E. Mayor Atkins stated the San Gabriel Valley Association of
Cities meeting will be held Thursday, February 19, in South Pasadena,
and reminded Council that the Camellia Festival will be coming up
February 27 -March 1.
12. ADJOURNMENT:
On motion by Councilman Gillanders, seconded by Councilman Merritt,
meeting. adjourned at. 8 :35 p.m. Next regular meeting of the City
Council will be. held. Tuesday,. March 3, 1981, 7:30 p.m. in the
Council Chamber of the City Hall.
