Members Present: Jeffrey Barnes, Frank D’Urso, Andre Griben, Robert Murphy, Craig Nation,

7:30 PM Commission Business
• Mr. Craig Nation recused himself from the discussion. Mr. Chris Nation, 20th Century
Homes, Inc., provided an overview of a proposed project change for the construction of a
single family home. Mr. D’Urso made a motion to approve, as an insignificant project
change, the reconfigured house footprint and the relocation of the driveway as noted in the
letter dated 18 October 2010 and identified on the site plan dated 16 October 2010 for 86
South Mill Street (188-1360). The motion was seconded by Mr. Barnes and it passed
unanimously.
• The Commission signed the following documents:
- Pulte Home Corp. of N.E. (Navarro-Robles), 5 Honeysuckle Cir – Certificate of
Compliance (188-1111)
- Gassett, 22 South Mill St – Certificate of Compliance (188-1372)
• Mr. Waldron made a motion to approve the Request for Payment dated 18 October 2010.
The motion was seconded by Mr. Barnes and it passed unanimously.

Notice of Intent-Continuation
Allary Braitsch, Eric Monkiewicz, VHB, Inc.; Peter Mezitt, Wayne Mezitt, Weston Nurseries
A discussion was held regarding the memos dated 11 October 2010 from VHB, Inc., in response
to comments from Fay Spofford and Thorndike and Lucas Environmental. It was noted that the
Notice of Intent referenced this project as the first phase to future Legacy Farms filings and a
discussion was held regarding the concern for segmentation of wetland impacts through future
phases. The Commission determined that the proposed wetland and buffer zone resource area
disturbance shall be reviewed cumulatively in any future Legacy Farm or Weston Nurseries
application filings.

Mr. D’Urso made a motion to close the hearing and issue an Order of Conditions with the
standard and noted special conditions throughout the public hearings. The motion was seconded
by Mr. Waldron and it passed unanimously.
The Commission signed a signature page for the Order of Conditions.

Steven Zieff, Legacy Farms; Eric Carty, Hopkinton Water Department
Mr. Carty provided an overview of the site visits to existing town wells that was held for the
abutters who expressed concerns about the size, noise and lighting for the proposed well
buildings. A discussion was held regarding relocating the gate for allowing access on the
roadway and about the types and amounts of chemicals to be stored on-site for the operation of
the wells. A site walk has been scheduled for further review of the wetland delineation. The
hearing was continued to 08 November 2010.

Violation Discussion
Michael Curatola, Andkra, LLC
Mr. Curatola presented and provided an overview of the existing conditions plan entitled “Sketch
Plan of Lawn Limits Lot 11 Front Street” dated 13 October 2010. A discussion was held
regarding the extent of site clearing for the installation of a lawn that occurred within the buffer
zone without a permit. Mr. Waldron made a motion to issue an Enforcement and Restoration
Order for the restoration of the area and the installation of a permanent immovable barrier along
the edge of the wetland and vernal pool buffer zones. The motion was seconded by Mr. D’Urso
and it passed unanimously.
8:40 PM Commission Business
• Mr. Barnes made a motion to approve, as an insignificant project change, the foundation
footprint changes and stormwater infiltration as noted in the email dated 18 October 2010 and
identified on the site plan dated 27 July 2010 with a final revision date of 18 October 2010
from Mr. Stephan, 18 Granite Street (188-1116). The motion was seconded by Mr. Nation
and it passed unanimously.
• Mr. Nation made a motion to approve, as an insignificant project change, the foundation
footprint changes identified on the site plan submitted on 18 October 2010 from Weston
Development Group, 0 Sanctuary Lane (188-1434). The motion was seconded by Mr. Barnes
and it passed unanimously.
• A discussion was held regarding an informal inquiry from Ms. Cunniff, 4 Coburn Road
regarding the installation of an in-ground pool within the existing lawn.

• In response to a request from the Director of the Department of Land Use Planning and
Permitting, the Commission determined to have Commission Staff review the lots NSTAR
has proposed to sell to the town and prepare recommendations for the Commission’s review.
• The Commission determined to share with other Town Hall Departments in the cost of
purchasing a portable electronic Smart Board for displaying public information during
Commission public hearings.
• A discussion was held regarding the review of the Massachusetts Department of
Transportation public meeting that was held on 14 October 2010 for the replacement of the
Route 85 roadway bridge between Hopkinton and Southborough.
