Members Present: Jeffrey Barnes, Robert Murphy, Craig Nation, Marcus Waldron, Chris Lucas:

7:30 PM Commission Business
• The Commission signed the following documents:
- LePage, 112 East Main St – Certificate of Compliance (188-1432)
- LePage, 112 East Main St – ERO Certificate of Compliance
- Bethoney, 182 and 184 Fruit St – ERO Certificate of Compliance
- Fletcher, Tilton & Whipple, P.C., 171 Spring St – Certificate of Compliance (188-474)
- Jacobs, 74 Front St – Certificate of Compliance (188-532)
- Jacobs, 74 Front St – Enforcement and Restoration Order
- Jacobs, 74 Front St – ERO Certificate of Compliance
• Mr. Waldron made a motion to approve the Request for Payment dated 08 November 2010.
The motion was seconded by Mr. Barnes and it passed unanimously.
• A discussion was held regarding the lots that NSTAR has proposed to sell to the town.
• A discussion was held regarding the written request from Connorstone Engineering, dated 02
November 2010, for issuing Certificates of Compliance to the New England Laborers facility.
Mr. Waldron made a motion to issue Certificates of Compliance for New England Laborers,
37 East Street (188-774) (ERO 188-774). The motion was seconded by Mr. Barnes and it
passed unanimously.
7:45 PM Todaro, 0 and 147 Hayden Rowe Street DEP File No. 188-1463
Abbreviated Notice of Resource Area Delineation
Brian Waterman, Waterman Design Associates Inc.; Phillip Todaro, applicant/owner
Mr. Waterman presented and provided an overview of the Abbreviated Notice of Resource Area
Delineation application, resource plans entitled “Existing Conditions Plan 0 & 147 Hayden Rowe
Street” Sheet 1 dated 30 September 2010 and Existing Conditions Plan 0 & 147 Hayden
Rowe Street” Sheet 2 dated 05 April 2010. Mr. Lucas stated that he was in agreement with the
delineation.

Mr. Barnes made a motion to close the hearing and issue an Order of Resource Area Delineation.
The motion was seconded by Mr. Nation and it passed unanimously.
The Commission signed a signature page for the Order of Resource Area Delineation.

Notice of Intent-continuation

Mr. Lucas provided an overview of his memo dated 26 October 2010. Mr. Barnes made a motion
to close the hearing and issue an Order of Conditions with the standard and noted special
conditions throughout the hearings. The motion was seconded by Mr. Waldron and it passed
unanimously.
The Commission signed a signature page for the Order of Conditions.
8:05 PM Commission Business
• A discussion was held regarding the written request from Legacy Farms, East Main Street
(188-1390) dated 25 October 2010 for an extension of the Order of Resource Area
Delineation.
• Mr. Barnes made a motion to have Mr. Lucas review the Definitive Subdivision Plan for
Legacy Farms, 0 Clinton Street and provide comments to the Planning Board in response to
their request. The motion was seconded by Mr. Nation and it passed unanimously.
8:15 PM Cunniff, 4 Coburn Road RDA 2010-9
Request for Determination of Applicability
Angela and Daniel Cunniff, applicants/owners
Mr. and Ms. Cunniff provided an overview of the Request for Determination of Applicability and
a hand drawn sketch plan, on a plan by others, submitted on 09 November 2010 for the
installation of an in-ground pool. Mr. Lucas stated that the wetlands are closer than indicated on
the plan. The Commission determined not to approve the wetland delineation and discussed
conditioning the installation of a maintenance drywell outside the buffer zone for infiltrating pool
water.
Mr. Waldron made a motion to close the hearing and issue a negative Determination of
Applicability with the standard and noted special conditions, subject to the submittal of a revised
plan identifying the location of a dry well. The motion was seconded by Mr. Nation and it passed
unanimously.
The Commission signed a signature page for the Determination of Applicability.

• Mr. Waldron made a motion to cancel the public meeting scheduled for 22 November 2010.
The motion was seconded by Mr. Nation and it passed unanimously.
