HomeMy Public PortalAbout1991-43Member:a/Z.7/e_ // introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 9/-1_ RESOLUTION VACATING AN EASEMENT FOR STREET AND UTILITY PURPOSES LYING IN SECTIONS 13 AND 14, TOWNSHIP 118 NORTH, RANGE 23 WEST, HENNEPIN COUNTY, MINNESOTA WHEREAS, the City of Medina (City) has title to an easement for street and utility purposes lying in Sections 13 and 14, Township 118 North, Range 23 West, as more particularly described in Exhibit A attached hereto; and WHEREAS, the City has received a petition from the Hunterland Corporation, owner of 100 percent of the land abutting on the easement requesting that the easement be vacated; and WHEREAS, the City has publicized the public hearing held on the proposed vacation to be given to affected property owners by two weeks published and posted notice and 10 days mailed notice; and WHEREAS, the City has mailed to affected property owners a copy of the resolution proposed to be adopted at the public hearing and a copy of the petition from Hunterland Corporation; and WHEREAS, the city council held the required public hearing on June 4, 1991, at which time the council recieved testimony from all persons wishing to be heard regarding the proposed vacation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina as follows: 1. The vacation of the city's easement described in Exhibit A is found to be in the public interest and is hereby approved for the following reasons: a) The easement is excessively wide and more suitable for a roadway of a scale inappropriate for the area; b) The easement traverses environmentally sensitive areas, including a wetlands; and c) There exist alternate corridors for a north/south city road which are preferable to the location of the existing easement. 2. The clerk -treasurer is authorized and directed to prepare a notice of the completion of these proceedings for presentation to the Hennepin County auditor. The notice shall contain the name of the city, an identification of the vacation, a statement of the time of completion thereof and a description of the real estate and lands affected thereby. 3. The clerk -treasurer is also authorized and directed to take any other acts reasonably necessary to carry out the intent of the city council in this matter.
