Members Present: Jeffrey Barnes, Frank D’Urso, Andre Griben, Robert Murphy, Craig Nation,

• A discussion was held regarding the written request for an Extension Permit for Orders of
Conditions from Terry, 17 Maple Street (188-1396). Mr. D’Urso made a motion to issue an
Extension Permit for Orders of Conditions for Terry, 17 Maple Street (188-1396). The
motion was seconded by Mr. Nation and it passed unanimously
• The Commission signed the following documents:
- Curatola, 67 Front St – Signature Page for Certificate of Compliance (188-1377)
- Curatola, 69 Front St – Signature Page for Enforcement and Restoration Order
- Terry, 17 Maple St – Extension Permit for Order of Conditions (188-1396)
- NE Laborers, 37 East St – Certificate of Compliance (188-774)
- NE Laborers, 37 East St – ERO Certificate of Compliance (188-774)
• Mr. Barnes made a motion to approve the Request for Payment dated 06 December 2010.
The motion was seconded by Mr. Waldron and it passed unanimously.
• A discussion was held regarding the appeal to Appeals Court of the Middlesex Superior
Court decision, favorable to the Commission, from Lippman, 32 North Mill Street (188-
1393). Mr. Waldron made a motion to submit to the Town Manager’s Office a request for
legal services authorizing the Commission to utilize up to $10,000.00 under its 53E1/2
account to retain legal consulting from Town Counsel in response to the appeal to Appeals
Court. The motion was seconded by Mr. Barnes and it was passed by everyone except Mr.
Nation who opposed and Mr. D’Urso and Ms. Recos who abstained.
• Mr. Barnes made a motion to ratify the Enforcement Order issued by Mr. MacAdam to
Davies, 2 Michael Way (188-1092). The motion was seconded by Waldron and it passed
unanimously.

Request for Determination of Applicability
The hearing was legally opened and immediately continued to 10 January 2011 at the written
request of the applicant.

Notice of Intent
Joseph P. Marquedant, J.D. Marquedant & Associates, Inc.; Daniel Aho, applicant
Mr. Marquedant presented and provided an overview of the Notice of Intent and engineered plans
entitled “Sketch Plan of Land Wild Road Hopkinton, MA”, and dated 02 November 2010. A
discussion was held regarding the proposal to construct a single family home on a parcel with
grandfathered setbacks under the Hopkinton Wetlands Bylaw Regulations. Mr. Lucas provided
an overview of his site review and noted that the parcel showed signs of site disturbance
approximately 30 or 40 years ago. A discussion was held about conditioning the portion of the
foundation drain greater than ten feet away from the house foundation to be perforated to provide
groundwater recharge and installing a permanent immovable barrier at the location of the erosion
control barrier.
Mr. Barnes made a motion to close the hearing and issue an Order of Conditions with the
standard and noted special conditions. The motion was seconded by Mr. Waldron and it was
passed by everyone except Mr. D’Urso who abstained.
The Commission signed a signature page for the Order of Conditions.

Mr. Frey presented and provided an overview of the proposed minor design changes to the
stormwater management design as identified on his memo dated 06 December 2010.
Mr. D’Urso made a motion to approve, as an insignificant project change, the proposed
stormwater management design changes as reviewed by Mr. Frey and identified in his memo
dated 06 December 2010 subject to the submittal of electronic detail plans. The motion was
seconded by Mr. Nation and it passed unanimously.

Mr. D’Urso recused himself from the discussion.
Mr. Marquedant presented and provided an overview of the proposed project change to install a
sidewalk as identified on the survey plans entitled “Proposed Sidewalk Plan of Land Hopkinton,
Massachusetts” and dated 26 November 2010.

Mr. Barnes made a motion to approve, as an insignificant project change, the proposed
installation of a sidewalk as reviewed by Mr. Marquedant and identified in the letter dated 30
November 2010 and the survey plan dated 26 November 2010. The motion was seconded by Mr.
Nation and it passed unanimously.

Abbreviated Notice of Resource Area Delineation

Mr. Marquedant presented and provided an overview of the Abbreviated Notice of Resource Area
Delineation application and resource plans entitled “Sketch Plan of Land Hopkinton,
Massachusetts” and dated 08 November 2010. Mr. Lucas stated that the intermittent streams
were not identified on the plan and that a site review should be scheduled between him and the
applicant’s wetland consultant to review the location of some of the wetlands flags.
The hearing was continued to 10 January 2011.

• Mr. D’Urso made a motion to cancel the public meeting scheduled for 20 December 2010.
The motion was seconded by Mr. Nation and it passed unanimously.
