ORDINAriCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LL'HITS

WHEREAS, the Local Government Cap Law, N.I.S. 4OA: 4-45.1 et seq., provides that in th.::

WHEREAS, N.J.S.A. 40A: 4--4-5.15a provides that a municipality may, when authorized by oroi.n=,
appropriate the difference between the amount ofit!l actual final appropriation and the ).5% percentage
rat:e as anexceptioo to its fioaIappropriations ineitherofthe two 5UCCeeding years; and,
WHEREAS, !he Mayor and 8<Jrough Council of tile Borough. of Cartet"t in the County of Middlesex
finds it advisable andneces.sary to increase its CY 2009 budg"tby up to ).5 % over the previous year's
final appropriations-, in th>; interest ofprornoling the health, safety and wclfllfe of the citizeus; and,
WHEREAS, the Mayor and Borough Ccuncit hereby determines that a).5 % increase in the budget
for said year, amounting to S263,355.70 in excess of the ~ ill final appropriatiollS otherwise

Carterct, in the County af Middlesc:x a majority of the full authorized membership of this gov"ming
body affirmatively concurring. that, in the CY 2009 budget year, the final appropriations of die
Borough ofCartecet shall, inaccordan<<: with this ordinance and N.J.S.A. 40 A: 4-45.t4, be inqeascd
hy 3.5 %, amounting to $921.144.95 and that the CY 2009 municipal budget for the Borough of
Carteretbe approved and adopted inaccordancev.itb this ordinanc.e; and,
BE IT FURTHER ORDAINED, that any arnnunt authorized hereiDahove that is not appropriated as
part of the finaI budgetsballbe retained as an exception to fmal appropriationi!leith<:rnfthenexttv.u
