I1. CALL TO ORDER:

CITY COUNCIL
MINUTES
MARCH 3, 1981
Mayor Atkins called the regular meeting of the City Council to order
at 7:35 p.m. on. Tuesday, March 3, 1981, in the Council Chamber of
the City Hall.
2. INVOCATION:
The invocation was given by Father Paul Montoya, St. Luke's Catholic
Church, 9451 E. Broadway.
3. The Pledge of Allegiance to the Flag was led by Mayor Atkins.
4. ROLL CALL:
Present: Councilmen- Dennis, Gillanders, Merritt, Tyrell, Atkins
Absent: Councilmen -None
Also Present: City Manager.Koski,.City Attorney Martin, Assistant
City Manager_Kimbrough,.Associate Planner Chris
Peterson, and Julie Estrada, Temple City Times.
5. CONSENT CALENDAR:
Councilman Dennis requested Item 6.B be corrected to reflect that
Councilman_Gillanders moved. to. continue the matter to. the next
regular. meeting_ and_ request: the. Planning. Commission to consider
minimum lot width for apartment construction.
On motion by..Councilman Merritt., seconded by Councilman Gillanders
the Consent.Calendar., Items A. through C.were approved, Item A as
corrected and Councilman Tyrell abstaining as to that item.

Approved as corrected.
B. PLANNING COMMISSION ACTION - Meeting of February 24, 1981.
Received and filed.
C. RESOLUTION NO. 81 -1966: WARRANTS AND DEMANDS
Adopted Resolution No. 81 -1966 A. RESOLUTION OF. THE CITY COUNCIL OF
THE CITY OF. TEMPLE CITY ALLOWING.CLAIMS.AND.DEMANDS IN THE SUM OF
$121,573.65, DEMAND NOS, 1554 THRU 1609.
6. UNFINISHED BUSINESS:
A. PUBLIC HEARING,. VACATE_PORTION OF NORTHEAST CORNER ELM AVENUE
AND MUSCATEL AVENUE
City Manager.Koski.presented background. information, stating the
City Council, . at: their. regular.meeting.held February 3, 1981,.. adopted
a resolution.of:intention to vacate.a.portion.of the northeast corner
of Elm _Avenue.and..Muscatel.Avenue. Various. agencies who. could have
some interest in. the proper:ty.have.been.notified and letters have
been received from.. them. Public.hearing was published and posted
pursuant to state law requirements.
Staff has recommended_several items not required as a part of the
vacation; that. is, relocating_: the chain link fence and installation
of a 5 -foot wide sidewalk.

Councilman.Tyrell.inquired why. staff. is recommending moving the
fence., stating. he_ feels- the: City should. just allow the property
owner to use the property and vacate the easement.
City Manager_ Koski_ responded, . stating. staff felt that from the
standpoint of encouraging maintenance, it was desirable.
Mayor Atkins declared the public hearing open and invited anyone
wishing to speak to come forward.
Michael_, Hoffman 8838..E1m_ Avenue, _stated he is in support of the
vacation,; that..pbrtion having been a maintenance problem for a
number of'years.

There being no one else: come forward to speak, Councilman Tyrell
moved .to._ close .the public hearing, seconded by Councilman Gillanders
and carried.
Councilman.Tyrell felt the property owners.. have the Use of the land
and can.do.what they want, but that the City should not fence it
for theme
Councilman:Tyrell moved to certify the Categorical_Exemption
from . the.: requirements. of: the- California. .EnvironmentalT.. Quality Act
o.f 1970, as amended, seconded by Councilman Dennis and carried.
Councilman Tyrell moved to adopt Resolution No. 81 -1967 A RESOLUTION

B. ORDINANCE NO 81- 501:.. 2nd. read... AMENDING. TEMPLE CITY ZONING CODE
SECTION 9278.1 RELATING TO ADDITIONS TO NON - CONFORMING STRUCTURES
City Attorney Martin. presented. Ordinance No.. 81 -501 AN ORDINANCE OF
THE CITY OF TEMPLE CITY. AMENDING. SECTION. 9278.1 OF THE TEMPLE CITY
ZONING CODE for second reading by title only.
Councilman Merritt moved to waive further reading and adopt, seconded
by Councilman Gillanders and carried.
C. PROPOSED :ORDINANCE: _.AMENDMENT_TO.TEMPLE CITY ZONING CODE SECTION
9563 RELATING. TO. DESIGN CRITERIA. REGARDING. MINIMUM. LOT AREA FOR
CONDOMINIUM. DEVELOPMENT.AND..MINIMUM LOT WIDTH FOR 2 -STORY
CONDOMINIUMHDEVELOPMENT
City Manager. Koski. stated the: Planning. Commission received Council's,
request.to.review apartment development.with.respect to the same
lot width standards.as apply to condominiums and felt.that.the
lesser. restrictions. for.apartmen.ts.would make it possible to develop
them on smaller. lots: and. that there. should be options available to
people.to build..either.:.apartments or.condominiums but conversion of
apartments. to. condominiums..is.not. -desirable and would be difficult
if built. to apartment standards only. Planning.Commis.sion, did,
however,.review.the.change in.wording.Council had made in the condo -
minium. ordinance. and agreed. that. four or fewer units in a one -story
structure.could be built on a lot with 50 feet or more of street
frontage.
Councilman. Gillanders.felt that.if_apartment development has a more
stringent.set.of.standards they. would conform to condominium standards
and as.it_now.stands.they could not..convert to condominiums, however,
he does.not feel.the.City should have. lesser standards for apartments
than for.condominiums-. He.feels.this.would be an open invitation to
build apartments rather than owner occupied condominiums.
Mayor_Atkins reminded the Council the agenda item to be considered
is criteria for condominium development.

Councilman_Merritt stated he is satisfied with the wording for
condominium . development .- and ..that Council_should consider apartment
development at a future study session.
Councilman: Dennis.. stated. expressed concern that the language. is
still.confusirig, although the Council has agreed on the intent.
City Attorney: presented. the- clarification that Section 9563.4(a)
should_ read : for. four. or less units. in a. one -story building: not
less than 50 feet;.and.(b).for five or more units or for any two-
story building: not less than 80 feet.
Councilman,.- Tyrell. expressed concern. that. the Council's philosophy
was that for. narrow_ lots. people_ would. get_ together. and consolidate
and build_.on.wider. lots; - that many. of the..R -.2_ lots.. are single family
developments..and- nobody wants a,two -story building next to them. We
will have:lost- the.concept to Temple City and felt Council should
have a study session.
Mayor_Atkins:stated.that_unless the.City_down zones they can't
expect people to develop R -2 lots as R -1.
Councilman_Merri.tt stated a lot of zoning. was predicated.on usage
and a. lot of 4-2. usage is. being. utilized on. R -1 zoned properties.
He feels. Council should_have a. study session. with_ the Planning
Commission to discuss lot widths for apartment development.
Councilman_Dennis stated_he feels lot width requirements should be
eliminated altogether.
Councilman Gillanders.moved to. instruct- the.City Attorney to pre-
pare the appropriate.ordinance.amending lot width requirements for
-c.ondominium..development.as clarified to be brough back for first
reading February 17, 1981, seconded by- Councilman_Merritt and
carried, Councilman Tyrell noting his objection.
D. AWARD BID: UNDERGROUND UTILITY DISTRICT NO. 4
City Manager. Koski. stated that.City-Council, at their regular
meeting_held.December.16, 1980,_authorized. advertising and re-
ceiving.of bids for.construction of underground utilities to
connect the.. service. to businesses and residences in Underground
Utility District No. 4.. City received four bids ranging from
$77,790.00.to $107,900.00,. .Staff_recommends Council accept the
low bid _from.Edwards.Eiectric.in.the. amount of $77,790.00 and
appropriate $61,290_as.t.he City's share of this contract and amend
the adopted budget accordingly.
Councilman Dennis inquired whether there...are going to be additional
costs_to the City.for the.13 services already completed.- City
Manager Koski., advised they would-be evaluated and negotiated under
the same policy as those included in the bids.
Councilman.Merri.tt.moved to.accept the low bid from Edwards Electric
in the. amount of $77, 790. 000,.appropriate..an.additional $61,290 as

RENEWAL OF AGREEMENT. TO. CROSS. OVER.. PEDESTRIAN MALL lA - ZAGER -SMITH

Councilman. Dennis moved. to approve renewal of agreement for a period
of one year effective March 1, 1981, subject to all conditions set
forth in staff memo dated February 25, 1981, seconded by Councilman
Gillanders and carried,
7. NEW BUSINESS:
A. PROPOSED_ IMPROVEMENT -PROJECT.- .LONGDEN AVENUE BETWEEN BURTON
AVENUE AND ROSEMEAD BOULEVARD.

City Manager. Koski presented. background_ information., stating the
County. Road_ Department has proposed.a joint. City- County project for
the resurfacing_of.Longden.Avenue between Burton Avenue and Rosemead
Boulevard. which could .be_more_ec.onomically.combined in one bid with
the previously. scheduled. Olive. Street resurfacing project. The
County's proposed.agreement.provides they will prepare.the plans and
specifications and provide construction engineering.
Councilman ..Gillanders.moved...to approve the.proposed agreement
and authorize_the Mayor.and_City Clerk to..sign, and to appropriate
additional_funds_and.amend the adopted.budget accordingly, seconded
by Councilman Dennis and carried.
8. COMMUNICATIONS:
None
9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Bob Pitts, 5312 Degas. Avenue, requested clarification on the action
taken by Council: relating to condominium development and Mayor Atkins
explained the proposed ordinance.
RECESS TO CRA:
City Council recessed at 8:34 p.m.. to meet as the Community Redevelopment
Agency; approved..the minutes of the regular meeting held February 17, 1981,
concurred. with. Planning. Commission. resolution approving a zone variance
for parking. lot. for_ restaurant. at 8905.. Las Tunas. Drive, and adopted a
resolution approving.warrants. The minutes are set forth in full in the
records of the Agency.
RECONVENE AS CITY COUNCIL:
10. ACTION ON REQUEST BY CRA:
There was no action to be taken.
11. MATTERS FROM CITY OFFICIALS:
A. Councilman Gillanders stated that if newspaper reports are
accurate,.SB.33.has.gone the way of all other proposals for
inspection stations by the State.
Councilman .Gillanders.also.commented.on the success of the "Run
for Youth" held Sunday, despite the rain, in which 300.people
participated, and thanked Parks and Recreation Director Kobett
for his assistance with a public address system.
B. Councilman Merritt directed Council's attention to an article
in the newspaper by William Buckley about the decline in the death
penalty throughout.the.United States and stated he would provide a
copy for each Councilman.
C. Councilman Tyrell moved to approve the purchase of six handie-
talkie radios and amend the budget_ accordingly, seconded by
Councilman Merritt and carried.
D. City Manager. Koski stated the. staff. has been investigating a
deferred.compensation plan.for.City employees. Councilman Tyrell
moved to. instruct staff to pursue the. development of a deferred
compensation plan_and bring.a program.of action back to the City
Council.at their.regular.meeting.to be held March 17, 1981, seconded
by Mayor Atkins and carried.
E. City Manager_Koski stated a number of sample street name signs
have been.placed on display in the north meeting room for Council
to review.

12, ADJOURNMENT:
On motion by Councilman.Tyrell, seconded by- Councilman Gillanders,.
meeting_adjourned.at.8 :55 p.m. to a study session to review the
street name•signs.
Council convened. and instructed. staff to pursue a 9" sign, green
in color with letters in light cream with reflective beading.
Next regular_m2eting_of._the.City Council will be held Tuesday,
March.17,..1981,'7:30 p.m. in the Council Chamber of the City
Hall.
