HomeMy Public PortalAbout1991-53r Member R/77/fe`/ introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. C /- _ _1 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ST. ANNE'S CHURCH WHEREAS, St. Anne's Church (Applicant) has applied for a conditional use permit to construct a 45' x 36' addition to the church located at 200 Hamel Road; and WHEREAS, the City's zoning ordinance requires conditional use permit under such circumstances; and WHEREAS, the request was reviewed by the planning commission at its meeting on July 12, 1990 and by the city council on August 6, 1991; and WHEREAS, it has been determined that granting a conditional use permit to the Applicant for the proposed addition to the church will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of The City of Medina that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following conditions: 1. The hard surface coverage of the Applicant's property may not exceed the maximum percentage permitted under the city's zoning ordinance; 2. Exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property; 3. The Applicant must ensure that the existing drainage pattern will be retained to the northeast; 4. There shall be no exterior loud speakers on the property; 5. The fire department shall review the site for compliance with relevant codes and requirements; 6. There shall be no outside storage allowed on the property; 7. The exterior building materials used in construction of the church addition must be compatible with the exterior materials on the existing church; 8. Any trash containers on site must be stored within a building; 9. Landscaping meeting code requirements and satisfactory to the zoning administrator must be installed and maintained by the Applicant; 10. No new on -site parking is authorized by this conditional use permit; and 11. The Applicant must pay to the city a fee in the amount determined by the staff to represent the actual cost to the city for reviewing this conditional use permit application. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of Medina that a front yard setback variance be granted to the Applicant to permit construction of the church addition 37' x 2" from the right-of-way of Hamel Road rather than the required 50'. Granting the variance is justified by the need to construct the addition at the same setback as the existing church and the compatibility of the setback with general neighborhood standards.
