RESOLUTION GRANTING FINAL PLAT APPROVAL FOR TUCKBOROUGH FARM FOURTH ADDITION WHEREAS, Hunterland Corporation (Applicant) has requested final plat approval for an area of approximately 40 acres located south of Tuckborough Farm Third Addition; and WHEREAS, the planning commission and city council have reviewed the plat submitted by the Applicant for compliance with city ordinances and with the terms and conditions of preliminary plat approval. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Medina, Minnesota that final plat approval is granted to Tuckborough Farm Fourth Addition, subject to the following: 1. The Applicant must must pay park dedication fees for all lots within the subdivision; 2. It is acknowledged that Outlot A will be combined with land to the west when such property is platted; 3. The Applicant agrees to remove the existing house located on what will be Lot 6, Block 2 within two years of the date of final plat approval. After the house is removed, access to the lot must be from the new subdivision road to the west and not from Medina Road. In order to assure compliance with these conditions, the Applicant must post with the city a letter of credit in the amount of $10,000 in a form acceptable to the city attorney; 4. The Applicant must comply with the requirements of the city engineer regarding ponding and drainage easements over Lots 3 and 8, Block 2; 5. The Applicant must submit adequate title evidence regarding the property within the subdivision for review by the city attorney. The final plat shall not be released until receipt of the city attorney's plat opinion letter and verification that the final plat is in compliance therewith; 6. It is acknowledged that Lots 1 and 2, Block 3 will gain access from Medina Road; 7. The Applicant agrees to pay the City $3,000 per lot as a contribution towards the cost to upgrade Medina Road. The fee will be payable upon issuance of a building permit for each of the lots within the subdivision. In order to assure payment of this fee, the Applicant must enter into a Petition and Waiver Agreement in a form acceptable to the city attorney; 8. The Applicant must obtain approval of the plat from the appropriate watershed district; 9. The Applicant must post with the city a letter of credit in the amount of $ to assure completion of the subdivision roads. 10. The Applicant must pay to the city a fee in the amount determined by city staff to represent the actual cost to the city of reviewing this plat application; and 11. The Applicant must file the final plat with Hennepin County within 60 days of the date of the adoption of this resolution. Failure to file the plat within said period of time shall render this fin.1 plat approval null and void. DATED: , 1991.
