for both sides were preparing Findings of Fact for the Judge who
will rule the end of November. He said that our attorneys and

COUNCIL MINUTES
November 24, 1981
The Council of Bad Harbour Village met Tuesday, November 24, 1981
at 9:30 A.M. in the Village Hall
Present: Messrs. Beatty, Printup, Sherman, Taplin and Miss Gray
Also present weir Fred W. Maley, Village Manager; Mary T. Wetterer,
Village Clerk and Alan S. Gold, Village Attorney.
On motion of Mr. Beatty, seconded by Miss Gray and voted the minutes
of October 27, 1981 were approved as submitted.
Mr. Alvin Cassel, attorney and Mr. Mike Cornwall, architect, for the
conversion of the Camelot Hall Apartments to "The Plaza of Bal Harbour"
condominium, appeared to request a variance to construct an entrance canopy
12 feet into the front set -back area and to construct patio canopies into
the rear set-backarea a distance of 42 feet. Sketches of the proposed con-
struction were presented. Mr. Maley explained that the new owners have made
every effort to provide landscaping in the front set -back area to try to
conform to the new zoning regulations. He also stated that the adjoining
pLvperty owners were contacted and they have no objections. After dis-
cussion it was moved by Mr. Taplin, seconded by Mr. Beatty and voted that
the variances be approved subject to final plans to be approved by the
Building Departrent and the Village Manager.
November 24, 1981
Mr. Maley reported that after last months' meeting he requested
Trade County to stripe out the right hand lane on Collins Avenue adjacent
to the Sheraton Hotel. However, he does not feel this will solve the tour
bus parking problem. The Council discussed with Messrs. Dan Williams
and Elliot Hector from American Bus Lines, the policy of the Police
Department ticketing bus drivers who park for over five minutes on
Collins Avenue and the inability of the busses to negotiate the Sher-
aton driveway. It was moved by Mr. Taplin, seconded by Miss Gray that
the Village Manager proceed with the design and development of a bus
bay on Collins Avenue. In the meantime the police are to continue to
help with traffic problems that might arise from loading and unloading
busses.
Mr. Maley said that the engineers for the Collins Avenue s h eet
lighting project would be ready to present plans for the next council
meeting.
The council discussed the proposed redistricting ordinance pre-
pared by Mr. Gold. Mr. Gold read Ordinance No. 235 in full. The ordi-
nance provides for three council districts on the oceanfront, one dis-
trict for the apartments west of Collins Avenue, and one district for
the single family area. It was moved by Mr. Taplin, seconded by Mr.
Sherman and voted that Ordinance No. 235 be adopted on first Lading.
The council and Mr. Maley discussed a proposed noise ordinance
based on Mr. Voyce's report on sound readings in Bal Harbour. It was
the council's decision that Mr. Gold should take Mr. Voyce's informa-
tion and incorporate it into an ordinance to replace our present noise
ordinance which is out of date.

Mr. Maley reported that counsel in the Great Lakes Dredge and
Dock Co. suit have presented their Finding of Fact and Conclusions of
Law. Final arguments will be made on December 4th. Members of the
council are invited to be present.
Mr. Maley said that the engineering firm the Village appointed
as Engineer of Record for the past 35 years is not as active as in the
past It is with great reluctance that he feels the village should
solicit a new engineering firm. It was moved by Mr. Beatty, seconded
by Mr. Sherman and voted that Mr. Maley advertise for a new Engineer
of Record.
Due to the holidays at the end of December it was moved by Mr.
Beatty, seconded by Miss Gray and voted that the December meeting be
held on the alternate meeting date of December 8th.
Mr. Maley informed the council that Bal Harbour Village is a
party to litigation brought by the Balmoral Condominium Association,
against the builder. We are charged with being negligent in our build-
ing inspections. He said he has given the notice to our insurance
carriers and will talk to Mr. Gold about the matter.
Mr. Milton Ftadberg said he lives next to the Tiffany con-
struction job and does not believe two cranes are properly muffled.
Mr. Maley said he and Mr. Gold will check into it.
On motion of Mr. Beatty, seconded by Mr. Sherman the meeting
was adjourned at 11:15 A. M.

December 8, 1981
The Council of Bal Harbour Village met Tuesday, December
in the Village Hall.

Mr. Beatty, seconded by Miss Gray and voted the minutes of

Mr. Maley reported that proposed Ordinance 235, regarding council redistrict-
ing, has been advertized for final reading at this meeting. Mayor Printup asked
for any comments on the ordinance. As there were no comments from those present,
Mr. Gold read the ordinance by title. On motion of Mr. Beatty, seconded by Mr.
Sherman and voted
Ordinance No. 235
was adopted.
Mr. Printup said that he, Mr. Maley and Mr. Sherman attended the final
hearing on the Great Lakes Dredge and Dock suit last Friday. It was the opinion
of those who attended that our attorneys had done an outstanding job. It is
anticipated that a final ruling will be made in a week.
Mr. Pedro Martinez, the electrical engineer for the Collins Avenue street
lighting project, presented sketches from Mr. Howard Brandston, lighting de-
siner, Mr. Martinez explained the new bracket arm and street lighting fixture.
Also illustrated was a second fixture 10' above the sidewalk which will provide
the pedestrain lighting. Mr. Maley said the engineers would have the final plans
ready in January for bidding. The job is estimated at approximately $350,000.
It was moved by Mr. Taplin, seconded by Mr. Sherman and voted that plans be
finalized and put out for bids to be awarded at the February meeting.
Mr. Printup explained that the Florida League of Cities is spearheading
a drive to levy an additional le state sales tax to be used for property tax
relief and localgovernment assistance. Mr. Maley said several different Bills
have been prefiled pertaining to an increase in sales tax. It was moved by Mr.
Beatty, seconded by Miss Gray and voted to pass a Resolution supporting the
League's position.
Mr. Gerry Gutenstein of the Sheraton Bal Harbour and Mr. Gary Cook of Sky
Show Productions appeared to request permission to operate a parasail operation
