HomeMy Public PortalAbout1991-57Member 714 /1�C' // introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 9/5-7 RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO CAROLYN SMITH WHEREAS, Carolyn Smith (Applicant) has applied for a conditional use permit for a residential dog kennel at her property at 2752 Hamel Road; and WHEREAS, the City's zoning ordinance requires a permit whenever more than three dogs are maintained on a property; and WHEREAS, the matter was reviewed by the planning commission on July 9, 1991, and by the city council on August 6, 1991; and WHEREAS, it has been determined that the existence of the dog kennel at the Applicant's house will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. It is acknowledged by the Applicant that the three existing dog kennels are for the private use of the Applicant and are not to be used for breeding dogs or any other commercial activity related to dogs; 2. The maximum number of dogs permitted on the property is four; 3. All waste material must be disposed of in accordance with the ordinances of the City and the regulations of the Minnesota pollution control agency; 4. The Applicant must take immediate and appropriate action to abate any nuisance caused by barking dogs on the property. For this purpose, a nuisance shall include, but not be limited to, ten or more minutes of continuous barking; 5. The Applicant must submit an accurate site plan of the property acceptable to the zoning administrator which shows all structures, fences and dog runs on the property. Because of the proximity of the dog kennels to the property lines, conditions on the property must be monitored closely; 6. Westerly kennel area, which is 50' from the west property line, to be removed when no longer used as a kennel or prior to the sale of the property, whichever comes first; 7. The Applicant must maintain all dogs in accordance with the standards of the Minnesota Purebred Dog Breeders Association; 8. The Applicant agrees to take whatever steps may be necessary to reduce outside visual stimuli for the dogs in the kennel if excessive barking becomes a problem on the site; 9. The City shall conduct an annual review of the property to ensure continued compliance with the terms and conditions of this permit; 10. The City reserves the right to modify or amend the terms and conditions of this permit as development occurs on adjacent properties if necessary to prevent the occurrence of a nuisance; 11. The Applicant agrees to reimburse the City for all costs, including legal expenses, involved in enforcing any term of this conditional use permit or any ordinance related thereto; and 12. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this application.
