IN THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. Call to Order. The meeting was called to order at 8:30 A.M. by the Chairman, Howard Wilson. II. Roll Call. Minutes of the Regular Meeting/Public Hearing of September 27, 1995 Mrs. Souder Moved and Mrs. Winston seconded that the minutes be approved as circulated and all voted AYE. IV. Additions, withdrawals, deferrals, arr There were no changes requested. items. V. Announcements. A. Meeting Dates 1. November 29, 1995 at 8:30 A.M. in the Town Hall 2. December 27, 1995 at 8:30 A.M. in the Town Hall These announcements were made by Chairman Wilson. 3. January, 1996 to be confirmed The Town Clerk advised that the regular meeting date for January, 1996 would be Wednesday, January 24, 1996 at 8:30 A.M. The members of the Board agreed to -hold the January meeting on this date and time. VI. PUBLIC HEARING. A. Applications for Development Approval 1. Randall Stofft, Architect and Richard Mulhern, the contract purchaser, as Agents for William B. Bradbury, Tetrand Limited, owner of the property located at 24 Hidden Harbor Drive, Gulf Stream, F1., legally described as Lot 4 in Hidden Harbour Estates Subdivision. The Oath was administered to Mr. Stofft, the Agent, by the Town Clerk..after which Mr. Stofft displayed an amended color rendering of the structure as proposed.. He pointed out that they have held to the required setbacks on the major portion of the structure and that the setbacks are in line with existing structures in this subdivision. Mr. Stofft then calledattention to 9 recommendations that were made by Mr. Harrington in his memo of October 13, 1995. He stated that the revised design being presented at this meeting has addressed 8 of the 9 that were listed, as follows: a. With two exceptions, the eaves of the house and guest house should be at a uniform height of no more than 12 feet (and preferable less). The two exceptions are the center portions of the front and rear elevations, which may rise to a height of no more than 15 ' (and preferable less), but in no case should they be more than 3' higher than the other eaves. The step back located on the front elevation between the garage and the center area should be eliminated and a single hip roofing system used to cover this portion of the house. C. The projection from the master bath on the front elevation should be eliminated. C d. The eave heights for the master bedroom and family room should be the same. All of these recommendations were incorporated in the revised design. e. The number of wall and roof line breaks on the rear elevation should be reduced by giving further thought to the relationships between the covered patio, bedroom #4 and the cabana bath. Mr. Stofft believed Mr. Harrington intended to suggest extending the covered patio westward to cover the breakfast room and advised that this would then extend the covered patio into the 10' rear setback. In view of this analysis, no changes were made in this area. f. The front entry feature should be scaled down by eliminating two columns and using a simple gabled roof with the eaves set at the uniform height suggested for most of the house. Mr. Stofft stated no change had been made in this area as the owner wanted the entrance to "make a statement" and be a little.more formal than the rest of the structure. He then presented a photograph of an existing entrance like the one that is proposed for Mr. Mulhern. He believed that the rendering did not accurately represent what the entrance would look like. g. Paneled wood front doors should be.used. h. The roof spires should be eliminated. i. Layered foundation landscaping should be added in front of the west wall of the house and consideration given to adding more windows. Mr. Stofft advised that the owner agreed to change the door to a wood paneled door even though he prefered the glass and iron and that the roof spires have been eliminated. Regarding the layered foundation landscaping, he introduced Mr. Turner, Landscape Architect, and advised that Mr. Turner would furnish detail on the additional landscaping. He then pointed out that the small round window on the west end had been eliminated and an additional window added. Mr. Lynch asked for a description of adjacent properties and was advised that the Wildlife Preserve is adjacent to the private road on the south, common landscaped property is adjacent on the east, the yacht basin is on Cthe north and the property on the west,'owned by Catherine Wallace, is a lot with a single family dwelling. Chairman Wilson asked if the increased elevation of the property would create a drainage problem to the neighbor on the west and was advised by Mr. Stofft that both the drainage and septic system had been carefully engineered so that the property to the west will not be impacted. The Town Clerk then read two letters into the record at the direction from Chairman Wilson. The first was a letter from Hidden Harbour Estates Sub- division Central Committee that was addressed'to Ms. Barbara Whittaker which stated that the Committee has given formal approval of the transfer of this property to Mr. Mulhern and that the drawings of the proposed structures appear to conform to the requirements of the Association. Regular Meeting & Public Hearing Architectural Review and Planning Board October 25, 1995 page 3 The second letter was written by Attorney Michael Listick to Mrs. Catherine Wallace, the owner of the property to the west. Attorney Listick advised Mrs. Wallace that he believed that the variances are self-imposed in that Mr. Mulhern knew he was buying a lot that is of an irregular shape that would be difficult from a design aspect and therefore the variances should Cnot be granted. He further advised Mrs. Wallace that she should have professional advise to make certain that the roots from the proposed fichus hedge would not interfere with her septic tank and drain field and that storm drainage designs will assure that there will be no drainage onto her property. He further reminded that setbacks serve many purposes, including view and breeze, and encroachments of 10 feet into the front, side and rear setbacks may have an effect on the view and prevailing breezes. Mr. Stofft pointed out that the drainage has been carefully engineered and that this is only a single story structure which should not interfere with the breeze or the view. Mr. Devitt noted that the 3 sides of the structure that involve variance requests are adjacent to property that will not be developed in the future. Chairman Wilson then called for comment from the public and there was none. Chairman Wilson then asked Mr. Skokowski to comment on the revisions that are being proposed. Mr. Skokowski advised he was pleased with the response to the recommendations that had been made but was still concerned with the entrance presenting such a strong image. Chairman Wilson advised that he had also been concerned with the entrance, but after seeking an actual photograph of.the entrance he believed it would be acceptable. He stated that he does prefer the wood paneled doors over the glass and iron work. Mr. Lynch stated that the revisions had made a big improvement in the structure and the entrance does not bother him. Mrs. Winston asked the length of the structure and was advised that the entire length was approximately 1701. She then asked the location of the septic system and Mr. Stofft pointed to two areas on the site plan, adding that this had been worked out with the Palm Beach County Health Department. Mr. Devitt asked if the columns in the front are round or square and was r advised that they would be square like in the photograph, not round as they appear to be on the rendering, and they would be only l' off the wall. Chairman Wilson expressed the Board's appreciation to Mr. Stofft for his efforts to comply with staff recommendations. Mr. Devitt questioned if the Board members were comfortable with the variances that are being requested and was advised they were. Mr. Lynch moved and Mrs. Winston seconded that it be recommeded to the Town Commission that the Land, Clearing Permit be granted. Roll Call: Mr. Devitt; AYE, Mrs. Souder; AYE, Mr. Lynch; AYE, Mrs. Winston; AYE, and Chairman Wilson; AYE. b. LEVEL III ARCHITECTURAL/SITE PLAN REVIEW -To permit construction of a single story dwelling, guest house and other accessory structures. Mr. Lynch moved and Mrs. Winston seconded that it be recommended to the Town Commission that the revised site plan bearing the received date of October 24, 1995 be approved contingent upon final approval by the Town Commission of the revised landscape plan. Roll Call: Mr. Devitt; AYE, Mrs. Souder; AYE, Mr. Lynch; AYE, Mrs. Winston; AYE, and Chairman Wilson; AYE. C. VARIANCES (1). To encroach 10' into the required 35' front setback (2). To encroach 10' into the required 30' rear setback, with the principal structure (3). To encroach 19' into the required 50' interior side setback.on the east side (4). To encroach 11' into the required 20' rear setback with the pool Mr. Lynch moved that the four variances as requested be recommended to the Town Commission for approval in,that, based on the material provided by the applicant, all four requested variances meet all of the applicable criteria as established in Section 66-154 of the Code of Ordinances. The lot has a unique configuration that poses a hardship in developing the property using a standard building form and orientation to.the street. And further, the site plan, building orientation and surrounding features mitigate any adverse impacts on other properties that granting the Variances might otherwise impose. The motion was seconded by Mr. Devitt. Roll Call: Mr. Devitt; AYE, Mrs. Souder; AYE, Mr. Lynch; AYE, Mrs. Winston; AYE, and Chairman Wilson; AYE. VII. Items by ARPB members.
