ARCHITECTURAL REVIEW AND PLANNING BOARD OF THE TOWN OF GULF STREAM,
FLORIDA ON THURSDAY MAY 28, 1998, AT 8:30 A.M., IN THE TOWN HALL, 100
SEA ROAD, GULF STREAM, FLORIDA.
I. Call to Order. Chairman Wilson called the meeting to order at
8:30 A.M.

III. Minutes of the Regular Meeting and Public Hearing of 4-22-98.
Mrs. Anderson pointed out a typo on page 3, paragraph 4 that was
noted. Mrs. Anderson moved and Mr. O'Neal seconded that the minutes be
approved with the correction and all voted AYE at roll call.
IV. Additions, withdrawals, deferrals, arrangement of agenda items.
There were no additions, withdrawals, deferrals or arrangement of
the agenda items requested.

These dates were announced by Chairman Wilson. Mrs. Winston, Mrs.
Anderson and Mr. O'Neal said they would not be available for the July
meeting. Chairman Wilson questioned if they would have a quorum with
three Board members for the July meeting. Town Manager Garrison said
she would confirm with the Town Attorney.
VI. PUBLIC HEARING.
A. Applications for Development Approval
Chairman Wilson asked all who intended to speak to stand and take the
oath whereupon the secretary administered the oath to Charles Toth,

Hewlett Kent, John Conway, Patrick Seagraves and Peter Lampl. The
Chairman then asked if any of the board members had spoken to anyone
about any of the applications to be heard, or had visited any of the
sites. There were no ex -parte communications disclosed.
1. An application submitted by Mr. John Conway, as agent
for Mr. David Grissom, the owner of the property located
at 1535 N. Ocean Boulevard, Gulf Stream, Florida, which is
legally described as the South Half of Lot 1, Section 10,
Township 46 South, Range 43 East.
a. To permit placement of two 8 -foot -tall masonry piers
and aluminum gate at driveway entrance, for a nearly
completed residence.
Mr. John Conway, representing Mr. and Mrs. David Grissom, displayed a
rendering of the proposed plans and explained the design of the gates
would be simple black iron that will be screened with a hedge and
landscape. Mr. Conway stated that the plans were modified to add
quoined caps on top of the piers.
Chairman Wilson asked if there were any questions, and then asked for
the Manager's report.
Town Manager Garrison stated the plans were consistent with all the
regulations and compatible with the AlA Landscape project. The materials
of the entry feature are consistent with the nearly completed home.
Mrs. Anderson moved to approve the AIA Vegetation Permit, to allow the
addition of entry piers and gate, based on a finding that the
application meets all applicable code requirements, and will be
consistent with the AlA landscaping project. The motion was seconded by
Mr. O'Neal. Roll Call: Mrs. Anderson; AYE, Mr. O'Neal; AYE, Mr.
Hornberger; AYE, Mrs. Winston; AYE; and Chairman Wilson; AYE.
2. An application submitted by Mr. Patrick Seagraves, as
agent for Mr. Peter Lampl, the owner of the property
located at 3545 N. Ocean Boulevard, Gulf Stream, Florida,
which is legally described as Gulf Stream Ocean Tracts,
Lots 6 & 7.
a. Level 2 Architectural/Site Plhn Review to permit
renovations to restore home's original features and
architectural character, landscape improvements,
relocation of entry gate from central location to
Northern location.
b. AIA Vegetative Disturbance permit for modifications
within The 50 foot North Ocean Boulevard corridor.

Patrick Seagraves, agent for Mr. Lampl, displayed a rendering of the
proposed renovation and explained that the home was remodeled in 1989
and the owner would like to restore the home to•its original state. Mr.
Seagraves stated they plan to move the existing gate 45' to the North,
to make driveway access easier. The pavement area will be reduced and
there will be a loose gravel drive. The house will be repainted a
similar shade, the arch head windows that are not consistent with the
style of the home will be replaced with French doors. On the east side
a fountain will be added. The railings will be replaced on the smaller
balconies and the blue roof will be repaired or replaced with the same
material.
Chairman Wilson stated he was not sure regarding the policy of replacing
a non -conforming roof with another non -conforming roof.
Town Manager Garrison advised that the Town Attorney is on vacation.
However, if the Architectural Review and Planning Board is supportive of
replacing the roof, justification should be placed in the record, such
as its consistency with the owner's efforts to restore the house to its
original style, she said. The Board does not want this to set a
precedent for replacement of other less justifiable non -conforming
features on other homes in Town, Mrs. Garrison added.
Mrs. Anderson asked, if there was not a blue roof existing, what would
be consistent with the style of the house.
Mr. Seagraves stated a flat tile would be consistent with the
guidelines.
Chairman Wilson stated he is biased against a blue roof but commented
that the blue roof is not offensive to him considering the style of the
house, as long as a precedent of allowing a non -conforming item is not
being set.
Mr. Hornberger asked if a flat tile roof fits with the home's old style
and if they needed a decision now.
Town Manager Garrison stated this was not something the Board needed to
make a decision on today, since there is not an urgent need to replace
the roof and that it could go to the Town Commission for input.
Mr. Lampl stated the roof has been patched in a few places and he
prefers to replace the entire roof with the same material as the
existing.

Mrs. Winston inquired as to how visible the home would be from AlA.
Chairman Wilson commented that it is more visible from the ocean than
from AlA, and if there could be justification, it would be preferred to
replace the roof now while they are doing work. Chairman Wilson also
Cinquired as to how the railings match each other.
Mr. O'Neal inquired if the railings were part of the original house.
Mr. Seagraves stated the boxes on the railings should be removed as they
are too bulky and he circulated pictures of the railings that were added
when the house was renovated in 1989. Mr. Seagraves said he can come
back to the Board with additional railing details if this would be
acceptable.
Chairman Wilson stated he liked the design except for the railings.
Town Manager Garrison agreed that the railing design causes conflict
with the existing house. Regarding the roof, she reminded the Board
that this is a Level 2 review and that they have the option of sending
the application to the Town Commission for further review, as a Level 3.
Chairman Wilson stated that he saw no need to hold up the application.
Mrs. Ireland advised that she was concerned for the safety of the Gulf
Stream School children who use easement for beach access.
Mr. Seagraves explained that by moving the gate they are 30 to 40 feet
from easement and he does not foresee any safety problems.
Mr. O'Neal moved and Mrs. Winston seconded that a Level 2 Architectural
Site Plan Review be approved based on a finding that the proposed
renovations are consistent with applicable review criteria and restore
the home to its original design character, subject to the following
conditions: 1) Design of balcony railings to be brought back to the
Architectural Review and Planning Board for approval prior to
installation of the railings. 2)Replacement of grandfathered roof tile,
subject to confirmation from the Town Attorney that it is consistent
with the Design Manual and will not set an undesirable precedent. Roll
Call: Mrs. Anderson; AYE, Mr. Hornberger; AYE, Mrs. Wilson; AYE, Mrs.
Winston; AYE, and Chairman Wilson; AYE.
Mr. O'Neal moved and Mrs. Winston seconded the approval of an AlA
Vegetative Permit to allow the entry gate relocation and new landscaping
within the 50' North Ocean Boulevard Corridor, based on finding that the

application meets all applicable code requirements, and will be
consistent with the AlA Landscape project subject to the following
condition: 1) A DOT Driveway permit shall be secured prior to new
driveway construction. Roll Call: Mrs. Anderson; AYE, Mr. O'Neal; AYE,
Mr. Hornberger; AYE, Mrs. Winston; AYE, and Chairman Wilson, AYE.
3. An application submitted by Mr. Daniel Hess, as agent for
Mr. and Mrs. Hewlett Kent, owners of the property located
at 520 Middle Road, Gulf Stream, Florida, which is legally
described as Lot 19 and part of Lot 20 on the plat of Gulf
Stream Cove.
a. Level 2 Architectural/Site Plan Review to permit
demolition of 696 sq. ft. that will be replaced with a
2098 sq. ft. one-story addition to rear of home, and
the addition of a new 351 sq. ft. covered porch, also
added to the rear (south side) of the home. The
additions will connect the garage with the main house
and will expand the Loggia/Family area and kitchen.
Charles Toth, agent for Mr. Kent, displayed a rendering of the proposed
addition and explained the plans to remove the existing kitchen and
loggia structure to create a curved area, increase the height of the
room and replace sliding glass doors with French doors with fan lights.
Mr. Kent explained that by creating a gently curved room there is a
better view of the pool and waterway. Mr. Kent then showed photographs
displaying doors similar to those he proposes to the Board. He stated
that a curve minimizes the visual impact of the windows.
Mrs. Anderson commented she felt the design was beautiful and had no
concerns. She inquired if the neighbors were notified.
Town Manager Garrison stated all the neighbors within 25 ft. of the
property were notified but not the ones on the other side of the cove.
Mrs. Garrison commented that a lot of thought and creativity had gone
into the design of the project. The rounded shape of the wall is not
mentioned in the Design Manual so she conferred with Mr. Hank Skowkowski
from Urban Design Studio, (who helped create the Design Manual) for
suggestions on how to make the project a more traditional Gulf Stream
Bermuda style.
Mr. Hornberger commented that a few homes on Old School Road and Gulf
Stream Road have similar fan light features and have been in existence
for some time.

Chairman Wilson said he liked the design and asked if the Town Manager
was comfortable with the consistency of fan lights with the Design
Manual.
Town Manager Garrison replied that a number of Gulf Stream Bermuda style
Chomes have been approved with fan lights, so this would not be setting a
precedent.
Mr. O'Neal moved and Mr. Hornberger seconded that a Level 2
Architectural Site Plan Review be approved based on a finding that it is
consistent with Article V Section 8 and Article VII, Section B.3
(Windows), Article VII, Section B.1 (Building Form), and Article V,
Section A.11(Additions and Rehabilitations),and other applicable
requirements, with the following condition: 1) Health Department
approval of the septic system shall be secured prior to issuance of a
building permit, unless the home is connected to the private sewer

VII. Items by Staff.
A. Definition of Soli $ Fence - Mrs. Garrison explained that she
placed this item on the agenda to gain input on what constitutes a solid
fence. Chairman Wilson, who participated in the drafting of the Design
Manual, remembered clearly the intent was that a shadow box is not a
solid fence, but that a straight stockade type fence is considered a
solid fence.
