RESOLUTION GRANTING A VARIANCE
TO JOHN SAZENSKI FOR THE
PROPERTY AT 2380 HOLLYBUSH ROAD
WHEREAS, John Sazenski (Applicant) is the owner of the property located
at 2380 Hollybush Road which is legally described as Lot 1, Block 3, Hollybush
Hills, according to the plat on file in Hennepin County, Minnesota (Property); and
WHEREAS, the Applicant has requested a variance for the Property to place
a mound septic system in an area with a slope of up to 12 percent; and
WHEREAS, Section 720. of the City's individual sewage treatment and
disposal systems code (Code) limits the slope of the site of a septic system to six
(6) percent; and
WHEREAS, Section 721.03 of the Code permits granting a variance from the
above requirements under certain circumstances.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, that a variance from the Code be granted to the Applicant for the above
purpose, subject to the following conditions:
1. The mound septic system must be designed and installed as shown on the
plans and specifications attached hereto and under the inspection of the
city's building inspector;
2. The installation of the mound septic system must include construction of a
surface water and ground water diversion system approved by the building
inspector;
3. The Applicant must obtain and file an easement from the adjacent property
owner to the north permitting construction of the mound septic system on
such property;
4. The Applicant must obtain a letter from United Power Association (UPA)
agreeing not to operate heavy equipment over the mound septic system or to
make any other use of that portion of the UPA easement over the Property
which would interfere with the proper functioning of the mound septic
system.
5. The Applicant acknowledges that the Property is located in a portion of the
City which will never be served by sanitary sewer and that an on -site septic
system will forever be the only method of sewage disposal available;
6. The Applicant agrees to inspect and pump the mound septic system on a
regular basis and to maintain records of such, which records shall be
available for review by the City at reasonable times;
7. The Applicant agrees to fence the area of the mound septic system as
required by the building inspector;
8. The Applicant agrees to execute an agreement in a form satisfactory to the
city attorney holding the City harmless and indemnify the City in the event
the mound septic system fails or is damaged; and
9. The Applicant must pay to the City an administrative fee in an amount
sufficient to reimburse the City for its costs in reviewing the application.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of
the City of Medina that a violation of any of the terms and conditions of this
variance shall be deemed to be material and that the City may revoke this variance
upon the Applicant's failure to remedy such violation.
