HomeMy Public PortalAbout12-8421 Litigation of Keith Cliett Sponsored by: City Attorney Resolution No. 12-8421 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, TO AUTHORIZE THE CITY ATTORNEY'S OFFICE TO REPRESENT THE CITY OF OPA-LOCKA IN THE LITIGATION OF KEITH CLIETT VS. CITY OF OPA-LOCKA; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Opa-locka is being sued by Keith Cliett for overtime compensation and other relief under the Fair Labor Standards Act; and WHEREAS, the League of Cities has declined representation because the subject litigation is a non-covered item; and WHEREAS, the City Attorney's Office is requesting authorization from the City Commission to go forward, in handling the litigation of the case; and WHEREAS, the City Commission of the City of Opa-locka desires the City Attorney's Office to represent the City of Opa-locka in the litigation matter involving Keith Cliett. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka authorizes the City Attorney's Office to represent the City of Opa-locka in the case of Keith Cliett vs. City of Opa- locka, Case No. 12-cv-21963-Leonard/O'Sullivan, in the United States District Court, for the Southern District of Florida.
