I. Call to Order. Vice Chairman Kent called the meeting to order at 8:30 A.M. in the absence of Chairman Wilson. II. Roll Call. Minutes of the Reaular Meetina and Public Hearina of 1-28-99. Mrs. Anderson moved and Mr. Hornberger seconded that the minutes be approved as circulated and all voted AYE. IV. Additions, withdrawals, deferrals, arrangement of agenda items. There were no changes to the agenda requested. V. Announcements. A. Meeting Dates 1. Regular Meeting & Public Hearing 3-25-99 at 8:30 A.M. Town Manager Garrison advised that there have been no applications for development submitted and it will not be necessary to hold the March meeting. 2. No meeting will be held in August 1999 The Vice Chairman asked if there were any conflicts with the remaining dates and there were none at this time. Vice Chairman Kent asked that all persons who intended to speak at the Public Hearing please stand to take the oath. The Town Clerk administered the oath to Randall Stofft, Rustem Kupi, Jack Hank, and Mr. Lewis. Mrs. Anderson stated that she had met with the architectural board of the Place Au Soleil Association regarding the proposed construction of the Lewis home, and later had spoken with Commissioner Lynch. Applications for Development Approval 1. Continued from the meeting of January 28, 1999 An application submitted by Randall Stofft, Architect, as Agent for Turner and Linda Dean, the owners of the property located at 3430 Oleander Way, Gulf Stream, Florida, which is legally described as Lot 48, Replat of Gulf Stream Properties No. 2 Subdivision. Vice Chairman Kent reminded that this application had been reviewed at the February Public Hearing and the application had been found to be deficient in that the applicant had failed to file for one of the Special Exceptions and a Variance in connection with the proposed development, making it necessary to re -advertise the project. He stated that the project was well received at the previous hearing and asked if there had been any correspondence or contact from the neighbors. The Clerk replied that there had been no contact. Mr. Kent then asked if there was any comment from the Board or the public. a. SPECIAL EXCEPTION to permit a north side setback of 10 feet as opposed to the usual 15 foot. Mrs. Anderson moved and Mrs. McGraw seconded to recommend that a Special Exception be granted to permit a 10 foot setback on the north side as opposed to the required 15 foot setback. Roll Call: Mrs. Anderson; AYE, Mrs. McGraw; AYE, Mr. Hornberger; AYE, and Vice Chairman Kent; AYE. b. SPECIAL EXCEPTION to permit the construction of a covered, unenclosed 230 square foot porch that would exceed the maximum permitted floor area of 3,096 square feet by 230 square feet. Mrs. Anderson moved to recommend approval of a Special Exception to permit construction of a 230 square foot unenclosed porch that exceeds the maximum permissible FAR. The motion was seconded by Mr. Hornberger. Roll Call: Mrs. Anderson; AYE, Mrs. McGraw; AYE, Mr. Hornberger; AYE and Vice Chairman Kent; AYE. c. VARIANCE, in relation to Special Exception #2, from one of the Special Exception Review Standards which provides that for each one square foot of roof projection over the maximum permissible FAR, 2 additional square feet of roof projection must be Q� provided that are within the maximum permissible FAR, and all shall remain forever unenclosed. Mr. Hornberger moved to recommend that a Variance be granted in relation to Special Exception b., from one of the Special Exception Review Standards which provides that for each one square foot of roof projection over the maximum permissible FAR, 2 additional square feet of roof projection must be provided that are within the maximum permissible FAR, and all shall remain forever unenclosed. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to permit construction of a two-story single family Bermuda style dwelling consisting of 3,326 square feet. Mr. Hornberger moved to recommend the approval of a Level 3 Architectural/Site Plan Review to permit construction of a two-story single family Bermuda style dwelling consisting of 3,326 square feet and the motion was seconded by Mrs. Anderson. Roll Call: Mrs. Anderson; AYE, Mrs. McGraw; AYE, Mr. Hornberger; AYE, and Vice Chairman Kent; AYE. 1. An application submitted by Rustem Kupi, as agent for Fred and Maria Devitt III, the owners of the property located at 3030 N. Ocean Blvd., Gulf Stream, Florida, which is legally described as the South 25' of Lot 37 and all of Lot 38, Gulf Stream Properties Subdivision. Rustem Kupi, Agent for Mr. & Mrs. Devitt, displayed a color rendering of the proposed structure and explained that the project meets all of the guidelines of the Design Manual. He called attention to the two story existing structure and advised that this will remain and a new parking court would be installed off Gulf Stream Road with the landscaping on that side to be the same as what was approved on the previous submission made by the previous owners of the property. Mr. Kupi pointed out that the new structure is a Gulf Stream Bermuda style with a partial second story. The total square footage of the new structure is 6,168 square feet, and when adding the existing building of 2,112 square feet, the total floor area will be 8,280 square feet which is 1,272 square feet under the maximum permitted. Mr. Kupi closed by reviewing the floor plan and pointing out that the second floor is much smaller than the first floor of the new structure, and advised that the existing front driveway surface would be covered with Old Chicago brick. Town Manager Garrison reminded that there had been a previous approval for a new structure on this property that had been requested by the previous owners of the property. She advised that the landscape plan is the same as was approved for the previous owners, that the design is well balanced and there are no conflicts. Mrs. Garrison recommended approval as submitted provided that the previous approval, File #97-15, is hereby superceded, and that the driveway along the north side of the property shall be designed so that stormwater run-off is directed away from the property to the north (with swale or slope to the south). Vice Chairman Kent noted that there are exposed rafter tails on the new structure that are absent on the existing structure. Mr. Kupi advised that they expect to add these to the existing structure and added that the existing building would be painted to match the new building. a. AlA VEGETATIVE DISTURBANCE PERMIT to allow the removal of undesirable species and add new landscape beds and features within the Historic Corridor. Mrs. Anderson moved to recommend approval of an AlA Vegetative Disturbance Permit, based on a finding that the proposal is consistent Regular Meeting & Public Hearing Architectural Review & Planning Board February 25, 1999 page 4 with the Landscape Enhancement Project and Mr. Hornberger seconded the motion. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to permit the ^ Construction of a 2 -story, single family Gulf Stream Bermuda style dwelling with pool and cabana consisting of 6,168 square feet. Mr. Hornberger moved to recommend approval of a Level 3 Architectural/ Site Plan Review based on a finding that the proposed home is consistent with applicable review standards, with the conditions recommended by the Town Manager. Mrs. McGraw seconded the motion. Roll Call: Mrs. Anderson; AYE, Mrs. McGraw; AYE, Mr. Hornberger; AYE, and Vice Chairman Kent; AYE. 2. An application submitted by Jim Fulwider and Jack Hank, as agents for Karin Lewis TTEE, the owner of the property located at 925 Emerald Row, Gulf Stream, Florida, which is legally described as Lot 63, Place Au Soleil Subdivision. Jack Hank, Agent for Karin Lewis, called attention to individual color renderings in each packet. He then distributed a revised east elevation. Mr. Hank advised that the proposed structure is an English/ Georgian style which Mrs. Lewis prefers. Mr. Hank closed by advising that the total floor area for the structure is 5,821 square feet, the maximum permitted being 5,839 square feet. Mrs. Anderson reported that the Place Au Soleil Association Architectural Board had given unanimous approval of the project with the condition that the existing fence be replaced with chain link fence concealed with ficus hedge. Mrs. McGraw complimented Mr. Hank on the treatment of the garage doors that face the street. Mr. Hank advised that they had tried to have the garage doors face the side but that it was not possible due to the odd shape of the lot. The Board Members agreed this is an attractive home with the revised east elevation. a. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW to permit the Construction of a 2 -story single family dwelling consisting of 5,821 square feet. Mrs. Anderson moved that approval of a Level 3 Architectural/Site Plan Review be recommended for the project as submitted with the modified east elevation, based on a finding that the proposed home is consistent with applicable review standards, with the condition that the wooden fence is to be replaced with a fence that is more compatible with the shape of the lot and architecture of the home, with such installation being made in coordination with the neighbor to the west as much as possible. Accent color for Williams's residence at 3288 Gulf Stream Rd. C Town Manager Garrison called attention to a picture of the Monterey Style home at 3288 Gulf Stream Road. She advised that the home has been sold recently and that the new owner is changing the color of the exterior of the home and would like to use the following color combinations: a. Primary color -Mushroom b. Trim -White (shutter, etc.) c. Accent -Pink (front door, awning) Mrs. Garrison reported that she had looked through several architectural books to try and determine what colors are traditional with this style of architecture and had found no references to color. She further reported that she had taken a windshield survey that revealed there are no pink accents present in the Town. In addition she found that there were awnings on the front of only three homes, and they were on structures of a design on which awnings have been traditionally acceptable. The Town Manager explained that a valance (scalloped) is proposed to be hung under the front balcony a depth of 2' in order to cover the view of a copper roof on a bay window on the front of the first floor. Mr. Hornberger did not feel that either the awnings or the pink colors belonged on a Monterey style of architecture. He further pointed to the fact that there are no pink accents in the area. Mrs. McGraw stated that the color bothered her. She felt awnings should be functional and if this was to cover the bay window, the window could be modified so that the awning would not be necessary. Mr. Kent stated that he had reservations about this and did not feel this would be in keeping with the Manual. It was unanimously agreed that an awning valance would not be acceptable and the pink door would not be in keeping with the Monterey style or be compatible with the area. B. Review of Design Manual and Related Codes 1. Floating Boat Docks Town Manager Garrison reminded that floating docks are currently prohibited in the Zoning Code. She advised that Chris Wheeler, a resident in Hidden Harbour who was present, has asked that the Code be amended to permit a certain type of floating dock that is detailed in the material that was included in the agenda packet. She pointed out that this type of dock is designed to accommodate small watercraft that drive onto the surface of the dock. She pointed out that the type of watercraft that would utilize this dock would often be suspended from a Regular Meeting & Public Hearing Architectural Review & Planning Board February 25, 1999 page 6 davit. Mr. Wheeler had pointed out that davits are somewhat unsightly and that this floating dock would be an option for small craft. Mrs. Garrison advised that Mr. Wheeler had offered to prepare some language to amend the Code that would be a subsection to Section 66-369 r) as follows: Subject to level one site plan approval, a maximum of one floating platform may be permitted for the purpose of storing small watercraft. The floating platform shall be constructed of non-ferrous material, be black or dark earth tone in color, and may not rise more than 12" out of the water. No more than two watercraft of a maximum length of 14' shall be stored on the floating platform. The platform dimensions shall not exceed 8' in width or 16' in length. All watercraft shall be stored parallel to the seawall. A floating platform must be removed after three month of disuse. This suggested language was well received by the members of the Board. During discussion it was determined that language should also be included to place a limitation on davits if a floating platform is present and eliminate the dock attached davit if there is a platform. Town Manager Garrison advised she would determine the proper location in the Code for these amendments. 2. Color a. Accent Colors (e.g. shutters) The Town Manager reported that she had done a windshield survey of the entire Town with regard to shutter accent colors and found that out of a total of 211 observations, there were 82 homes with white shutters, 17 with forest green, 15 with black green, 12 with black, 12 with taupe and 11 with gray and slate gray. The remaining 62 were of various other colors and shades. It was agreed that the following amendments be made in the Areawide Standards Article V: 1) Add "/Awnings" in the title of number 6. following the word "Shutters". 2) Add under "Preferred", classic shutter colors (for example: white, black, dark greens, subtle greens, taupe, stained mahogany, dark slate blue, slate gray) 3) add under J "Discouraged", non-traditional colors (for example: teal, peach, mustard yellow, bright blues, bright orange) and as a second item, add, cloth or vinyl awnings on the front elevation except on Mediterranean style homes. 4) Add a "Prohibited" title and under that, yellow-orange and bright pinks and a second item, add, extremely bright or florescent colors. 5) Add to the last line following "trim color(s)" under "Preferred" in number 10. d., "and accent colors". 6) Under the title "Discouraged" in number 10.d. add to the last line following "trim color(s)", "and accent colors" and add an additional line to read "non- traditional accent colors". 7) Under the title "Prohibited" in number 10.d. change the second line to read "purples, red (except doors), magenta, lime green and fluorescent colors or other extremely bright as Regular Meeting & Public Hearing Architectural Review & Planning Board February 25, 1999 page 7 trim or accent" and add two more lines, the first to read "accent colors that overwhelm the homes appearance" and the second to read "quoins painted a darker shade than the principal building". b. Consistency with architectural style It was also agreed that amendments be made to Article VII, "Predominant (� Architectural Styles" as follows: 1) In the first line under "Preferred" in Section A.5. the word "smooth" be added after "troweled". 2) In Section A.5. under "Prohibited" change the fourth line to read "shades of purples, red (excluding doors), and fluorescent or other extremely bright colors, bright yellow and bright pink as trim or accent". 3) In Section B.4. "Shutters" under "Preferred" add "traditional shutter color (for example: white, black, dark green, subtle greens, dark slate blue, dark taupe, stained mahogany, slate gray). 4) Under "Discouraged" in Section B.4. add "non-traditional colors for Bermuda style architecture (for example, painted brown)". 5) Add a "Prohibited" title in Section B.4. and a line under that to read "extremely bright colors (for example: magenta, lime green, traffic -sign orange, chartreuse, fuchsia, bright aqua blue, florescent colors). 6) In Section B.6. under "Prohibited", change the eighth line to read "shades of purples, red (excluding doors), and fluorescent or extremely bright colors as trim or accent". 3. Wall and Fence Height a. Measurement It was agreed to change the second line in the "Prohibited" designation of Article VI. number 7 to read "Any wall or fence over 8' (as measured from the lowest existing grade adjacent to the wall) b. Walls within setbacks vs. outside setbacks The following changes to Article VI. District Standards were agreed on: 1) In the "Prohibited" designation in the Gulf Stream Core in number 6. FENCES, after the word "Solid" add ",i.e. stockade". 2) The title for number 7. in Article VI. is amended to read WALLS AND FENCES: ALONG SIDE AND REAR PROPERTY LINES AND LOCATIONS NOT VISIBLE FROM STREET. 3) In number 4. WALLS in the "Required" designation the following is to be added under the Beachfront District: Substantial plantings in front of any walls or hedges along AlA. c. Height of hedges near ICWW It was agreed that in the "Prohibited" designation in number 7. in Article VI., the last two lines would be changed to read "Walls and fences over 4' located between minor accessory setback line and waters connected to the Intracoastal Waterway or 1978 Coastal Construction Control Line". d. 5' pool enclosure -exception for enclosures within 15' of ICWW or on ocean? It was agreed that this exception would be added in number 7. of Article VI. where it is shown that a minimum 5' enclosure is "Required". It was further agreed that in Article V., Areawide Standards, Section C., General Landscape Standards, a third "Discouraged" item be added which would read "Hedges over 4' within 15' of the ICWW, or if located seaward of the 1978 Coastal Construction Control Line". Discussion of Design Manual Items for March Meeting Town Manager Garrison reminded that there will be no March meeting and therefore the items planned for review in March will now be considered at the meeting on April 22, 1999. ('-) The list as prepared by the Town Manager was acceptable to the Board and �J there were no requests for a special documentation related to the list. D. Construction in Progress on February 16, 1999 The report showed that on February 16, 1999 there was $5,912,268 worth of construction in progress in Gulf Stream, generating $18,172.22 in revenue from fees. VIII. Items by Board Members. There were no items from the members. IX. Public. There was no comment from the public. X. Adjournment.
