(/2/ 7// RESOLUTION GRANTING PRELIMINARY APPROVAL FOR A LOT DIVISION TO DELANO DIETZ WHEREAS, Delano Dietz (Applicant) has requested preliminary approval of a proposed division of his property at 562 Medina Road into two lots; and WHEREAS, the proposed lot division was considered by the planning commission on August 13, 1991, and by the city council on September 3, 1991. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota, that preliminary approval is given to the Applicant for the proposed lot division, subject to the following: 1. The Applicant must pay a park dedication fee for Lot 2; 2. It is acknowledged that Lot 1 has room for an animal structure but that the existing shed on Lot 1 does not meet required setbacks and cannot be used as an animal structure; 3. Both lots must use the 60' X 60' easement to be conveyed to the city for access to Medina Road; 4. The existing drive and field road must be eliminated and relocated to the 60' X 60' easement to be conveyed to the city; 5. The Applicant must convey to the city the right-of-way along Medina Road required by the city engineer; 6. The Applicant must convey to the city the drainage easements and the 60' X 60' access easement required by the city engineer; 7. The Applicant must submit evidence to the city that there exists or will exist an easement over Lot 1 for the benefit of Lot 2 for purposes of access to Medina Road; 8. The Applicant must submit a current abstract of title or registered property abstract covering all of the property to be divided for review by the city attorney; and 9. The Applicant must pay to the city for administrative expenses the amount determined by city staff to represent the actual cost to the city of reviewing the lot division. DATED: C�J7�� yi /7 , 1991.
