AN ORDINANCE OFTHE CITY OF JEFFERSON,MISSOURI, RELINQUISHING A CERTAIN
EASEMENT FOR SANITARY SEWER PURPOSES IN LOTS 58 AND 59 OF THE TRAILS
OF KAUFFMAN HILLS SECTION THREE.
WHEREAS, by an easement recorded in Book 12, Page 593, of the Records of the Cole
County, Missouri, a sewer easement was granted to the City of Jefferson, a
Municipal Corporation, to excavate within, install, construct, maintain and
repair structures for the routing and conveyance of sewer in, under and
through the lots, tracts or parcels of land described in Section 1.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council finds that the following described easement is surplus property
of the City and is no longer needed for any public purpose:
BEGINNING at the southwest corner of said Lot 58, also being the southeast
corner of said Lot 59, thence N04 019'31"E, along the westerly line of Lot 58,
also being the easterly line of Lot 59, 63.02 feet; thence N22 041'33"W, 65.97
feet; thence easterly, along a curve to the left having a radius of 70.00 feet,
an arc length of 30.55 feet, (the chord of said curve being N85 039'42"E,
30.31 feet), to a point on the aforesaid westerly line of Lot 58, also being the
easterly line of Lot 59; thence SO4 019'31"W, along the westerly line of Lot 58,
also being the easterly line of Lot 59, 30.31 feet; thence S22 041'33"E, 78.19
feet; thence N79 022'35"E, 22.35 feet; thence S26 002'34"E, 22.56 feet to a
point on the southerly line of said Lot 58; thence S83 050'11"W, along the
southerly line of said Lot 58, 69.69 feet to the point of beginning.
Bearing Base: The Trails of Kauffman Hills Section Three, as per plat of
record in Plat Book 12, page 593, Cole County Recorder's Office, Cole
County, Missouri.
Section 2. The easement described in Section 1 is hereby relinquished, and the City
does hereby release and abandon whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to execute any
necessary legal document relinquishing all of the City's interest in the tract of ground
described in Section 1 .
Section 4. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.
