ARCHITECTURAL REVIEW AND PLANNING BOARD OF THE TOWN OF GULF STREAM,
FLORIDA ON THURSDAY, FEBRUARY 23, 2006, IN THE TOWN HALL, 100 SEA ROAD,
GULF STREAM, FLORIDA.
I. Call to order.
8:30 A.M.

III. Minutes of the Regular Meeting and Public Hearing 11-16-05.
Mr. Frankel moved and Mr. Ganger seconded that the minutes be
approved as circulated and all voted AYE.
IV. Additions, withdrawals, deferrals, arrangement of agenda items.

Vice Chairman Kent welcomed Mrs. White, Mr. Ganger and Mrs. Jones to the
ARPB and announced the meeting dates. He advised that he would not be
`J available for the July meeting.
Vice Chairman Kent asked if there were any exparte communications to
declare. Mrs. Jones disclosed that she visited the site and spoke with
a contractor on site. Mr. Ganger and Mrs. White advised that they had
driven by the site and spoke with Staff. Mr. Kent stated that he had
driven by the site and spoke with Commissioner Devitt and Staff.
The Vice Chairman asked that all persons who intended to speak please
stand to take the Oath. The Clerk administered the Oath to Mr. Weiner,
Mr. Pugliese, Mr. Carter, Mr. Carleen and Mr. Adams.

VI. PUBLIC HEARING.
A. Applications for Development Approval
1. To consider amendments to an application, originally
considered on May 19, 2005 and reconsidered on November
16, 2005, submitted by Dan Carter of Carter & Associates
Landscape Architects, Inc., agent for Anthony Pugliese
III, owner of the property located at 3145 N. Ocean Blvd.
Gulf Stream, Florida, legally described in metes and
bounds in Government Lot 2, Section 3, Township 46 South,
Range 43 East, for the following:
Mr. Weiner stated that given that Mr. Ganger voiced his opposition as a
private citizen at a previous meeting, he requested that he recused him-
self from the proceedings.
Attorney Randolph advised that this is a quasi judicial hearing and if
Mr. Ganger believes that he can base his decision on what is presented
and not be impartial, he did not have to recuse himself.
Mr. Ganger stated that previously, he represented himself as a private
citizen, not as a part of the ARPB. He stated that he could base his
decision on the application presented today, pointing out that this is
a revised plan from the one that was previously considered.
Mr. Weiner stated that he did not believe the standards for quasi
judicial and due process have been met but he would move forward.
Mr. Weiner explained that this is an original Phipps estate with 315 ft.
of frontage, almost twice as large as any other lot along AlA. This is
a Spanish Mediterranean style house, which incorporates several different
style elements. In complying with the Town's Code, his client has made
several modifications by lowering the entry feature to 17' 11", setting
it back more than 30' from the property line, reducing the height of the
wall, including the caps to under 8 ft., removing the chains, faces on
the wall trim and fountain and adding extensive landscaping. The entry
feature has been moved back behind the accessory setback and separated
from the front wall by 4". He added that all lightning now conforms to
code. Mr. Weiner stated that because this is a historic home, and the
largest home along AlA in Gulf Stream, the entry feature is appropriate
for the style of the house. He added that his client meets 80% of the
requirements and he felt that due to the changes that were made, the
application meets the requirements of the code.
Mr. Adams was recognized. He explained that this is a Spanish
Mediterranean Revival style home and it incorporates several different
architectural elements. He believes, in his professional opinion, the
proposed entry feature is appropriate for the size of the house.
Mr. Kent requested that the new changes be pointed out for the benefit of
the new ARPB members.

Mr. Carter was recognized and explained that the fountain, pagoda and zen
garden has been moved back behind the 30 ft. accessory setback area. He
stated that the entry feature and wall would be screened on both sides
with a variety of vines and staggered tiered landscaping. He added that
the south property line design will remain the same but there would be
some changes on the interior of the property.
GMr. Ganger asked what impact the landscaping would have on what would be
seen driving by.
Mr. Carter stated that the landscaping would significantly buffer and
soften the entry feature.
The Board complimented the landscape design.
Town Clerk Taylor advised that Mr. Carter informed her that the previous
landscape design for the rest of the property would be changed and
submitted to the Board for approval.
Vice Chairman Kent asked if there were any comments.
Mr. Carleen was recognized as the principal for Urban Design Studio. He
explained that he helped develop the manual for the town and the homes in
town are not true Mediterranean or true Bermuda style; they have elements
of the design. The intent of the code is to permit maximum flexibility
and encourage variety. However, the elements should match the character
of the neighborhood. He referred to a report from 10/17/05 stating that
the entry feature is a discouraged element and is not harmonious with
the character of the district or the town.
Attorney Randolph suggested that the report Mr. Carleen referred to from
10/17/05, his curriculum vitae as well as the photo composite of other
entry features in the district, be made a part of the official record.
There were no objections.
Attorney Weiner requested that Mr. Adams curriculum vitae be made a part
of the record also.
There were no objections.
Town Manager Thrasher commented that the applicant made several changes
that are acceptable to the town and pointed out sections of the code
that address the North Ocean Overlay Corridor and the inconsistency
with neighborhood character. He read Section 66-144(b)(9)(a) into the
record, which states that "in a Level 2 or 3 Site Plan Review, all
elements of a plan shall be organized harmoniously and efficiently in
relation to topography, the size and type of the property affected, the
character of the adjoining property, and the type and size of buildings."
Mr. Frankel commented that Gulf Stream is very understated and the
feature is excessive but he had no objections to the changes.

Mr. Ganger stated that the entry feature and the house is out of
character with the town but the applicant has made several modifications
as requested by the town and the house is being significantly restored.
However, he had no objections to the changes and felt the applicant met
the criteria.
Mrs. Jones agreed with Mr. Ganger and she had no objections.
Vice Chairman Kent commented that the entry feature did not meet the
criteria of the town but he had no objections.
Mrs. White felt that the entry feature is not harmonious with the
surrounding neighborhood and character of the town.
a. NORTH OCEAN BLVD. OVERLAY PERMIT to construct an 8'
wall, entry gates, accessory structure (arch),
fountain/statuary, pagoda and re -landscaping within
the first 50' easterly of the west property line.
Mr. Frankel moved and Mr. Ganger seconded to recommend approval a North
Ocean Boulevard Overlay Permit based on a finding that the proposed 8
ft. wall, entry gates, accessory structure (arch), fountain/statuary,
pagoda and relandscaping within the first 50' easterly of the west
property line meets the minimum intent of the Design Manual and
applicable review standards. Roll Call: Mrs. White; NAY, Mr. Frankel;
AYE, Mr. Ganger; AYE, Mrs. Jones; AYE and Vice Chairman Kent; AYE.
b. LEVEL 3 ARCHITECTURAL/SITE PLAN REVIEW requesting
approval for construction of an 8' wall, entry gates,
accessory structure (arch), fountain/statuary, pagoda
and re -landscaping the area.
Mr. Frankel moved and Mr. Ganger seconded to recommend approval of a
Level 3 Architectural/Site Plan based on a finding that the proposed
construction of an 8' wall, entry gates, accessory structure (arch),
fountain/statuary, pagoda and re -landscaping the area meets the minimum
intent of the Design Manual and applicable review standards with the
following conditions: 1) Prior to the issuance of a building permit,
DEP coastal construction review and Permit for all construction,
including walls, seaward of the 1998 CCCL and a copy of the approved
construction drawings shall be provided to the Town. 2) Prior to the
issuance of a Certificate of Occupancy, FDOT Driveway Permits and a
complete copy of the FDOT approved construction drawings shall be
provided to the Town. 3) As built survey and elevation drawings
indicating locations of all principle and minor accessory items,
elevations and final design drawings shall be provided to the town prior
to the issuance of a Certificate of Occupancy. Roll Call: Mrs. White;
NAY, Mr. Frankel; AYE, Mr. Ganger; AYE, Mrs. Jones; AYE and Vice
Chairman Kent; AYE.
VII. Request for extension of approval to construct a conservatory
extension to the existing dwelling at 4 Driftwood Landing.
Mr. Ganger asked if it would help to put a timeline on the extension.

Mrs. Mellon stated that the contractor is awaiting approval from the
State and to set a date would be unrealistic.
Mr. Frankel moved and Mrs. Jones seconded to approve extension of one
year, as provided in the code, of the original approval to construct a
conservatory. Roll Call: Mrs. White; AYE, Mr. Frankel; AYE, Mr.
Ganger; AYE, Mrs. Jones and Vice Chairman Kent; AYE.

IX. Items by Board Members. There were none.
X. Public. There were no comments from the public.
XI. Adjournment. Vice Chairman Kent adjourned the meeting at 10:30
