HomeMy Public PortalAboutORD14647 BILL NO. 2009-135 SPONSORED BY COUNCILWOMAN Carroll ` ORDINANCE NO. / 1,z7 0 -7 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER 2 (ADMINISTRATION) OF THE CODE BY ADDING A NEW SECTION 2-30 (PUBLIC HEARINGS). BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Chapter 2 (Administration) of the City Code is hereby amended by the addition of a new Sec. 2-30 (Public Hearings), as follows: Sec.2-30 Public Hearines Unless other procedures are prescribed,all Public Hearines shall be conducted according to the following rules and regulations: A. City staff shall present a brief overview of the issue before the hearing bodv, including a summary of any prior hearines and the staff's recommendation if any. B. If the hearine is being conducted as a result of an application filed with the Citv of Jefferson: 1. The applicant will be given a total of ten(10)minutes to present. This allotted ten(10) minutes may be apportioned between multiple speakers,however the total time may not exceed ten(10) minutes. 2. After the applicant speaks the first person to speak after the applicant shall speak in opposition to the proposal and will be given ten(10)minutes to speak. The opposition as a eroup may choose a person to speak or it may simply be the first person to speak after the initial proposal. This allotted ten (10) minutes may also be apportioned between multiple speakers,however the initial opposition response will only be ten(10) minutes. 3. After the initial proposal and opposition response,all others wishing to speak will be given five(5)minutes each to speak,in alternating fashion;five(5)minutes for support then five(5)minutes for opposition,continufne until all that wish to be heard have been heard. 4. After all who desire to speak have been given an opportunity to be heard,the applicant shall be given to opportunity for an additional five(5)minutes to speak. C. If the hearing is not being conducted as a result of an application filed with the City of Jefferson the officer conducting the hearing shall open the hearing and each person wishing to speak shall be given five(5)minutes to voice their opinion. D. No person shall be allowed to speak a second time without an affirmative vote of the maioritv Drafter's Note: Deleted text is shown thus. After evervone in attendance has been afforded the opportunity to be heard the presiding officer shall close the hearing. F. After the hearing has been closed: 1. The hearing may not be reopened for additional testimony unless there is a Proper motion and second for the same followed by an affirmative vote of two-thirds(2/3)of the members of the hearing bodv: and 20 The Staff shall recite any findings required to be made by the hearin body. Section 2.
