MINUTES OF THE REGULAR MEETING AND PUBLIC HEARING HELD BY THE
ARCHITECTURAL REVIEW AND PLANNING BOARD OF THE TOWN OF GULF STREAM,
FLORIDA ON THURSDAY, SEPTEMBER 27, 2007 AT 8:30 A.M., IN THE TOWN HALL,
100 SEA ROAD, GULF STREAM, FLORIDA.

III. Minutes of the Regular Meeting and Public Hearing of 7-26-07.
Mr. Ganger moved and Mr. Frankel seconded that the minutes be approved
as circulated and all voted AYE.

The Chairman asked if there were any exparte communications to declare.
Mr. Ganger disclosed that he had driven by the Pugliese and Sargeant
sites. All the other board members disclosed that they had driven by
the Pugliese site.

The Chairman asked that all persons who intended to speak please stand
to take the Oath.
Town Clerk Taylor administered the Oath to Mr. Marsh, Ms. Hudson, Mr.
Parker, Mr. Pugliese, Mr. Talley, Mr. Carter, Mr. Marek and Mr. Carleen.
vI. PUBLIC HEARING.
C' A. Applications for Development Approval
1. An application submitted by Mark Marsh, as Agent for Harry
& Deborah Sargeant III, the owners of property located at
1420 N. Ocean Blvd., Gulf Stream, Florida, which is
legally described as Lots 11, 11A, 12 & part of Lot 1A,
MCLouth Subdivision.
Mr. Marsh displayed a color rendering and a site plan. He explained
that this is a small pavilion addition on the east side of the house,
which would connect to the main house. He stated that he is having
difficulty obtaining matching roof tiles and he proposed a copper roof,
which would eventually blend, and patina to match the existing roof
tile. However, because the addition is over 300 sq. ft., and copper
roofs are only permitted on accessory structures, which are structures
up to 300 sq. ft., a variance is required to allow this. He asked Ms.
Hudson to present the criteria for the variance.
Ms. Hudson asked if the Board would like her to read and address all
eight criteria.
Chairman Kent asked if everyone had a chance to review the variance and
if there were any questions. The Chairman added Urban Design Studio was
consulted for direction on this application and their report was
favorable. However, approval of this variance is based upon whether all
eight standards, as defined in the Code, have been met.
Mr. Ganger questioned the 300 sq. ft. minimum for the accessory
structure. He added that the addition would complement the existing
structure.
Town Clerk Taylor explained that the code does not allow metal roofs.
However, metal roofs are allowed on minor accessory structures. The
Code provides that a minor accessory structure be a maximum of 300 sq.
O ft.
Mrs. White asked why the window on the addition is different from the
main house.
Mr. Marsh explained that given that the addition is symmetrical, he
tried to create some contrast in the windows. He added that the muntins
would match the existing.
Town Manager Thrasher asked Ms. Hudson if the written explanations to
the variance questions on the application were her responses.
Ms. Hudson confirmed the responses were hers.

a. VARIANCE from the provisions in Section 70-99(3) to
allow a copper roof on the proposed 900 Sq. Ft.
pavilion that exceeds the maximum size of a minor
accessory structure, on which copper roofs are
allowed, by 600 sq. ft.
Mr. Ganger moved and Mr. O'Neal seconded to recommend approval of the
Variance based on a finding that all eight criteria for a Variance have

AYE, Mr. O'Neal; AYE and Chairman Kent; AYE.
b. LEVEL 3 ARCHITECTURAL/ SITE PLAN REVIEW to permit the
construction of a 900 sq. ft. pavilion addition with a
copper roof to an existing Anglo -Caribbean style
single family dwelling.
Mr. Ganger moved and Mrs. White seconded to recommend approval of a
Level 3 Architectural/Site Plan Review to permit the construction of a
900 sq. ft. pavilion addition with a copper roof to an existing Anglo -
Caribbean style single-family dwelling based on a finding that the
improvement meets the minimum intent of the Design Manual and applicable
review standards. Roll Call: Mrs. White; AYE, Mr. Ganger; AYE, Mr.
Frankel; AYE, Mr. O'Neal; AYE and Chairman Kent; AYE.
VIII.A. Anuroval of Final Landscape at 3145 N. Ocean Blvd
Mr. Carter, landscape architect, advised that there are some changes in
the landscape material. However, the tiering effect would still be
achieved across the front of the property. At the entrance, canary
palms were substituted and Italian cypress and roses is installed on the
interior of the property.
Mr. O'Neal asked if the hedge on the interior of the property would be
maintained to the level so as the property cannot to be seen from the
street.
Mr. Carter confirmed that the hedge would be maintained at 12 to 14 ft.
The Board members complimented the landscape design.
Attorney Randolph advised that a motion be made to approve the revised
landscaping and include the declaration of usage to maintain the
approved landscaping in the motion.
Mr. Marek objected to the motion of the declaration of usage. He stated
that there is nothing on record to support this and there is no mention
of it on the certificate of occupancy checklist.
Town Clerk Taylor reminded that there were two occasions where a deed
restriction was placed as a condition of approval. One was to maintain
the approved landscaping and the other was that the wall height not
exceeds a certain height.
Mr. Pugliese stated that he did not want a deed restriction on his title
and he could not recall agreeing to a deed restriction.

Attorney Randolph advised that as a conditional of approval, he was
directed at separate times to prepare a deed restriction to restrict the
wall height and a deed restriction to maintain the approved landscaping.
He stated that the landscape plan could be approved subject to any
previous conditions that were imposed on the project.
Mr. Frankel moved and Mr. Ganger seconded to approve the revised
Cl landscaping subject to any previous conditions that were previously
imposed on the project. Roll Call: Mrs. White; AYE, Mr. Ganger; AYE,
Mr. Frankel; AYE, Mr. O'Neal; AYE and Chairman Kent; AYE.
VII. Assignments from the Town Commission.
A. Code Review Items
1. Requesting to participate -Jeffrey Parker
Chairman Kent advised Mr. Parker that the multi -family code review items
would be lengthy. He further stated that the code review item
addressing boatlifts/docks would be discussed at a future meeting.
Mr. Parker stated that he would return for that discussion.
Mr. Carleen explained that the town retained the services of Urban
Design Studio to independently review the multi -family section of the
code, encouraging the integration of preferred single-family
characteristics. He stated that he conducted numerous site visits and
consulted the town manager and clerk. Mr. Carleen advised that these
proposed design guidelines apply only to multi -family structures.
Discussions between the Board and Mr. Carleen ensued and it was agreed
that new multi -family structures and renovations be harmonious in form
and scale of architecture in the town's single-family districts. Box
structures are to be avoided and buildings are to be designed to provide
relief, jogs and articulation that add interest and relate to
established single-family structures in the neighborhood. Any
additions, renovations and/or rehabilitation to multifamily structures
representing 25 to over 75 percent of the existing structure shall be
required to conform to the multifamily regulations for those
percentages.
Mr. Carleen suggested creating two multi -family districts, MF -East
Odistrict and a MF -West district to correspond to specific needs and
relate to adjacent single-family characteristics. Mr. Carleen stated
that in the building form required section "building forms with human
scale proportions", building forms respecting single family patterns in
the Town of Gulf Stream", "maximum building length not to exceed
district standard" and "maximum fagade length without jog or reduction
of number of stories do not exceed district standard" be added. He
advised that in the discouraged section he would revise the "use of
insubstantial or overly complex reliefs, jogs in walls, building
articulation" language to make it more definitive.
Attorney Randolph asked if there is a definition of a jog.

Mr. Carleen stated that the definition is in the design guidelines
section.
Mr. Ganger asked what percentages of residents reside in a single-family
verses multifamily property.
Town Clerk Taylor stated that she was unsure of the percentage.
01 However, she explained that in previous years there was talk of possible
annexation of some of the properties south of Woolbright on AlA. A
survey was sent out to Gulf Stream residents and the response was that
the ratio would be more multifamily controlled with the proposed
annexation and the town was not in favor of that.
Mr. Carleen stated that he believes the design guidelines are working
well in the town. However, the houses are starting to look alike, he
added "Anglo -Caribbean" architectural style to the preferred section of
the multi -family design guidelines, which he believed would be more
compatible with multifamily structures. Mr. Carleen advised that in the
prohibited section, "traditional styles uncharacteristic to South
Florida, e.g. English Tudor, Victorian, not typical due to size, shape
or color in the town" was added prevent misinterpretation.
Chairman Kent stated that he would prefer to place "Monterey, and
Vernacular" architectural styles in the discouraged category and
prohibit "contemporary, international and cracker" style.
With regard to roof design, slope and materials. Roof types, size,
slope, color and materials have a big impact on how well multi -family
building relates to adjacent single-family homes. Flat roofs and
partial roof treatments are not typical in town and do not contribute to
the single-family character of Gulf Stream. Most structures in town are
characterized by simple roof designs with low to medium eave and roof
heights. To perpetuate the single-family residential character roof
designs on multifamily structures should incorporated traditional sloped
roof configuration such as hip, gable or a combination of both.
It was suggested that in the prohibited section, the language for
"bright, unnaturalistic looking roof material" be revised to be more
clear and the language under the prohibited section "roof material,
0 color or shapes not typically found in Gulf Stream changed to
predominantly found in Gulf Stream. Mr. Carleen advised he included
"tiled roof material true to architectural style (white cement tile for
Gulf Stream Bermuda, barrel tile with color blends for Spanish -
Mediterranean Revival and metal roof for Anglo Caribbean style homes" in
the preferred section. He suggested defining a color for metal roof.
Chairman Kent requested that in the discouraged section for roof
material roof material uncharacteristic of architectural style or not
typically found in Gulf stream, S shaped tiles, shed roof and very low
pitched roofs (less than 18degrees or 4:12 slope be moved to prohibited
section and completely remove hip, gable or combination of both.

For single story structures, he requested to add gable entry features
greater than 6 ft. wide in the prohibited section.
Mr. Frankel suggested that Mr. Carleen explore whether once a
multifamily structure becomes single family, would it permanently stay
that way, and revise the language in the "bright, unnaturalistic looking
roof material" to make it more definitive.
Mr. Carleen asked if the Board would consider revising the 300 sq. ft.
limit on minor accessory structures.
Mr. Frankel stated that he does not believe it to be an issue and cases
could be heard on an as need basis.
Town Clerk Taylor suggested adding the definition of minor accessory
structures in the multi -family district.
Mr. Ganger voiced his concerns regarding building forms as it relates to
hurricane protection and best use of energy. He believes that in the
future, developers may be forced to design buildings that are energy
efficient and that protect inhabitants from catastrophic events, which
could argue the form issue.
Attorney Randolph advised that if a multi -family structure is proposed,
all the guidelines for multifamily would apply and the same apply for
single-family structure.
Chairman Kent advised the Board members to be prepared to stay until
11:00 A.M for future code review meetings.
