GAS SUPPLY CORPORATION WHEREAS, Angel Perez, d/b/a L.P. Gas Supply Corporation (Applicant), has requested permission to operate a repair service for L.P. tanks at the property located at 3575 Kilkenny Lane; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, the planning commission and city council have reviewed the Applicant's request and have determined that granting a conditional use permit to the Applicant for the stated purpose will not adversely affect the development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina that a conditional use permit for a repair service for L.P. tanks at 3575 Kilkenny Lane be granted to the Applicant, subject to the following conditions: 1. Exterior storage must be limited to the 54' X 40' area to the west of the propane tank and may only include two trailers, two trucks and one backhoe, all of which vehicles must be operable and currently licensed; 2. Exterior building material must meet all performance standards by September 30, 1995; 3. All signs must meet city requirements; 4. The Applicant must screen the parking area from adjacent properties to the satisfaction of the city staff; 5. All trash containers must be located inside or must be screened to the satisfaction of the city staff; 6. The Applicant must install sufficient landscaping to the satisfaction of city staff, particularly on the west side of the property; 7. The parking requirements of the code are currently satisfied and the Applicant must eliminate the two spaces outside of the fenced area as shown on the site plan; 8. The blacktop surface must be constructed to a 9-ton capacity by July 31, 1992, and must be installed to the satisfaction of the city engineer; 9. The hard cover percentage of the property is in compliance with code requirements; 10. The hours of operation are limited to 6 a.m. to 9 p.m., Monday through Saturday; 11. There may not be more than eight employees on the property at any time; 12. Any exterior lighting must be designed and installed so that the globe is recessed and enclosed on all sides except the bottom and no light is cast directly on any other property; 13. No outside loudspeakers or telephone bells are allowed on the property; 14. The fire department will review the property and the propane tanks; 15. The L.P. tank must meet all setbacks and be in a suitable location so it meets fire department regulations; 16. Tanks which are brought to the site for repair must be properly purged before they are allowed on site. No more than two tanks may be on site at any time and only one of these will be allowed in the outside storage area; and 17. The Applicant must pay to the City an administrative fee in an amount sufficient to reimburse the City for its costs in reviewing this application. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of Medina that violation of any of the terms and conditions of this conditional use permit shall be deemed to be material and that the City may revoke this conditional use permit upon the Applicant's failure to remedy such violation.
