APPROVING FINAL PAYMENT ESTIMATE NO. 11
AND CLOSE OUT CHANGE ORDER.
ROOSEVELT AVENUE STREETSCAPE-PHASE II
WHEREAS. the Governing Body of the Borough of Carteret has previously awarded a
contract to Green Construction, Inc. in the amount of$3,287,794.95 for Roosevelt
Avenue Streetscape-Phase II; and
WHEREAS, the Borough's Consulting Engineer for the project, GME Associates, has
advised the Governing Body that a modification of the contract is reasonable and
necessary and has recommended that the aforesaid contract be modified in accordance
with Final Pay Estimate and Close Out Change Order (see attached); and
WHEREAS, Final Pay Estimate and Close Out Change Order includes a change in the
scope of the contract work to include additional and supplementary work ordered and
required to perform the required improvements to the Borough and satisfactorily
complete the work; and
WHEREAS, Final Pay Estimate and Close Out Change Order provides for a net
increase in the contract price in the adjusted amount of$19,987.45, resulting in a final
adjusted contract price of$3,307,582.20 including all previously approved change orders;
and
WHEREAS, the Borough's Consulting Engineer, CME Associates has advised that the
above described changes and/or modifications to the project were unforeseen at the time
of the award of the original contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret as follows:
1. That the Final Pay Estimate and Close Out Change Order attached hereto
and made a part hereof, resulting in a net increase of$19;987.45, and
resulting in a (mal adjusted contract price of$3,307,582.20 is hereby
approved.
2. That the appropriate l?orough Officials are hereby authorized to execute
the Final Pay Estimate and Close Out Change Order based upon the
recommendation of the Borough Engineer.
3. That the Borough Purchasing Department is hereby authorized to issue
any payment on the above described contract pursuant to Final Pay
Estimate and Close Out Change Order (see attached).
4. A copy of this resolution and a fully executed copy of Final Pay Estimate
and Close Out Change Order shall be forwarded to C11E Associates for
distribution to Green Construction, Inc.
