In accordance with the Warrant, the meeting was held at the
Brewster Elementary School, Thursday evening, July 31 , 1969.
The meeting was called to order at 8:00 F. M. by the Moderator,
Grant W. Koch. A quorum was present. Serving as tellers were Paul Sylver
and Elisabeth Linnell. Registration checkers were Dorothea Dugan., Roland
Gallant and Jean Gage. A moment of silent meditation was observed.
The warrant was read by the Town Clerk, Donald P. Consodine,
with the exception of the Articles which were read as they were being
considered.
ARTICLE 1 .To see if the Town will vote to amend the Zoning By-
Law in the following manner:
(1 ) Amend Section IV, Establishment of Districts, by adding
thereto a new district, designated as I'D" Light Industry's
(2) Amend Section V, Use Regulations, by adding a new paragraph,
designated as I'D" providing as follows:
"D". In a Ligrit Industry, except as provided in Section 11 and Section
111 , no building shall be constructed or used and no building altered,
enlarged, reconstructed, or used and no land shall be used except for
one or more of the following purposes.
1 . Any use permitted or authorized in Section V-A:V-B: and V-C
2. Any industrial or manufacturing use or trade, except Junkyards
or other use, deemed by the Board of Selectmen as injurious,
noxious or offensive to the Meighborhood, within said district.
3. Any municipal use, including use as a Town disposal area, to
be operated by the Town, or under supervision by the Town.
This article was passed by a standing vote of 153 in favor and
20 opposed that the article be accepted as printed and the "Zoning
By-Law Map" referred to in Section IV., Establishment of Districts, be
amended and/or changed to show the location of the new district; de-
fining the new district on said map, as "being the Land bounded or, the
North and Northwest by the Ydd-Cape Highway, Route #6; on the South by
the Town Road, known as Freeman's Way; and on the East by the location
of the easement of the Cape & Vineyard Electric Company, and the center
line of an old wood road, as tentatively shown on said "Zoning By-Law
Map IT
It was voted to take up Article 3 at this time.
ARTICLE 3. To see if the Town will vote to authorize the School
Committee to rent St. Joan of Arc School facilities in Orleans for use
of Sixth, Seventh and Eighth Grades.
Voted by voice that the Town authorize the School Committee to rent
St. Joan of Arc School facilities in Orleans for use of Sixth, Seventh
and Eighth Grades. Mr. Paul Ellis, Superintendent of Schools was
granted the privilege of the floor.
ARTICLE 2. This article did not pass, 45 in favor, 52 opposed.

ARTICLE 4. To see if the Town will vote to transfer $7,000 (Seven
Thousand) Dollars appropriated under Article 34 of the 1969 Annual Town
Meeting to the Brewster Elementary School Operation.
This article was passed by voice that the Town transfer $7,000
(Seven Thousand) Dollars appropriated under Article 34 of the 1969 Annual
Town Meeting to the Brewster Elementary School Operation.
ARTICLE 5. To see if the Town will vote to transfer $1 ,740 (One
Thousand Seven Hunched Forty) Dollars from Cafeteria Salaries Account to
the Brewster Elementary School. Operation Budget.
Noted unanimously that the Town transfer One Thousand Seven Hundred
Forty Dollars ($1 ,740.00) from Cafeteria Salaries Account to the Brewster
Elementary School Operation Budget.
ARTICLE b. To see if the Town will authorize the 'Water Commiss-
ioners of the Town of Orleans to provide water service to certain tax v
paying inhabitants of the Town of Brewster residing within the following
boundary lines, to wit.-Northeasterly by the Town line of Orleans-Brewster,
a distance of about five hundred (500) feet; Easterly by Harwich Road
(Route 39) by the Town line, a distance of five thousand (5000) feet;
Southerly by land of Owners Unknown, a distance of about four hundred
(400) feet; and Westerly by a line parallel to and distant four hundred
fifty (450) feet westerly from the easterly side line of Harwich Road,
a distance of one (1 ) mile.
Voted unanimously that the Town authorize the :°jater Commissioners
of the Town of Orleans to provide water service to certain tax paying
inhabitants of the Town of Brewster residing within the following
boundary lines, to wit:-Northeasterly by the Town line of.Orl.eans-
Brewster, a distance of about five hundred (500) feet; Easterly by
Harwich Road (Route 39) by the Town line, a distance of five thousand J
(5000) feet; Southerly by land of Owners Unknown, a distance of about
four hundred (400) feet; and Westerly by a line parallel to and distant
four hundred fifty (450) feet westerly from the easterly side line of
Harwich Road, a distance of one (1 ) mile.
ARTICLE ?. To see if the Town will vote to adopt Section 20, of
Chapter 40A of the General haws.
Voted by voice that the Town adopt Section 20, of Chapter 40A of
the General Laws which reads as follows: After acceptance of this
section or corresponding provisions of earlier laws as provided in section
four of chapter four, no appeal or petition under paragraph three of
section fifteen for a variance from the terms of such an ordinance or
by-law with respect to a particular parcel, of land or the building
thereon, and no application under paragraph two of section fifteen for
a special exception to the terms of any such ordinance or by-law, which
has been unfavorably acted upon by the board of appeals shall be on its
merits by said board within two years after the date of such unfavor-
able action except with the consent of all of the members of the
planning board, or of the board of selectmen in a town having no
planning board.
ARTICLE: 8. To see if the Town will vote to transfer from free
cash in the treasury the sum of $2,503.01 ) Two Thousand Five Hundred
Three Dollars and One Cent to be paid to the Commonwealth of Mass.,
Dept. of Public Welfare to adjust a credit balance due on. Old Age
Assistance Account.
Voted unanimously that the Town transfer from free cash in the
treasury the sum.-of ($2,503.01 ) Two Thousand Five Hundred Three
Dollars and One Cent to be paid to the Commonwealth of-Mass., Dept. of
Public 1,elfare to adjust a credit balance due on Old Age Assistance
Account.
ARTICLE 9. To see if the Town will vote to install and maintain
two street lights on Swamp Road.
Voted unanimosuly that the Town install and maintain two street
lights on Swamp Road.
ARTICLE 10. To see if the Town will vote to authorize the School
Committee to sell surplus desks owned by the Town of Brewster.
Voted by voice that the Town authorize the School Co .ittee to
sell surplus desks oined by the Town of Brewster.
It was moved to reconsider Article 2 at this time by a vote of
80 in favor, 30 opposed.
ARTICLE 2. To see if the Town will vote to transfer a sum of
money from surplus overlays to the Brewster Elementary School Oper-
ation Budget ($8,500.00)
This article was passed 59 in favor, 49 opposed that the Town
transfer Eight Thousand Five Hundred Dollars ($8,500.00) from surplus
overlays to the Brewster Elementary School Operation Budget.
ARTICLE 11 .To act on any other business that may legally come
before said meeting.
There being no further business it was voted to adjourn at 10:15
P. M.
