HomeMy Public PortalAbout08-20-09c A Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor Daniel J. Reiman at 6:00 P.M., Thursday, August 20,2009, Council Chambers, Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. Upon individual roll call vote the following were noted present: Councilmember Vincent Bellino " Iris Colon " Jorge Diaz " Randy Krum " Susan Naples " Joseph W. Sitarz Noted Absent was Municipal Clerk Kathleen M. Barney. Also noted present was Linda A. Rivera, Assistant Municipal Clerk and Borough Attorney Robert Bergen. The meeting was opened with a minute of silent prayer and the Pledge of Allegiance led by Mayor Daniel J. Reiman. The Assistant Clerk stated that the 2009 Annual Notice was mailed to The Home News Tribune, The Star Ledger and posted on the Bulletin Board on January 5. 2009. It was published on January 8, 2009. -1- AUGUS1' 20, 2009 REGUlAR MEETING August 20, 2009 ROLL CALL Minute of Silent Prayer/Pledge of Allegiance STATEMENT OF MEETING NOTICE AUGUST 20, 2009 MINUTES FOR APPROVAL DIANE.GRUSKOWSKI SCHOLARSHIP AWARD PUBLIC HEARING 2009 Budget Amendment Public Hearing Upon MMS&C by Councilmembers Sitarz and Naples and unanimous affirmative vote of the full Council! present, the Minutes of August 6, 2009, were approved, transcribed and engrossed by the Clerk. Diane Gruskowski Scholarship Award: Meghan McFadden Mayor Reiman then asked Diane Gruskowski to come forward .explaining this scholarship award is part of the Mayor's Children Charity Trust Fund, given in Daniel's memory. He then introduced Meghan McFadden as the recipient of this years award and asked her to come forward. Diane Gruskowski spoke highly of Megan McFadden and of her accomplishments in working with the Carteret Specials. Mayor Reiman the presented Megan McFadden with a meritorious award and a scholarship check for $500.00. Mayor Reiman then asked for a motion to open to the public the 2009 Budget Amendment. Upon MMS&C by Councilmember Sitarz and Naples and unanimous affirmative vote of the full Council present, the public hearing was opened on the 2009 Budget Amendment. Mayor Reiman said this basically had to do with the insertion of various grants and final numbers fi'om the state relative to Pension and other items. There were no questions or comments from the public. -2- Upon MMS&C by Councilmembers Diaz and Sitarz and unanimous affirmative vote of the full Council present, the public hearing on the 2009 Budget Amendment was closed. ORDINANCE #09-12 was introduced and adopted on First Reading and the Assistant Clerk authorized and directed to advertise same for Public Hearing to be held on September 10, 2009, upon MMS&C by Councilmembers Sitarz and Diaz. Upon individual roll call vote Councilmembers Bellino, Colon, Diaz, Kmm, Naples and Sitarz voted in the Affirmative. "VACATING A PORTION OF SALEM AVENUE IN THE BOROUGH OF CARTERET" The Assistant Clerk stated that Ordinance #09-08 was introduced and adopted on First Reading at an Agenda Meeting of the Borough Council of the Borough of Carteret held on June II, 2009. It was duly published in The Home News Tribune on August 12, 2009 with notice that it will be considered for final passage after Public Hearing to be held on August 20, 2009 at approximately 6:00 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. Upon MMS&C by Councilmembers Diaz and Krum and unanimous affirmative vote of the full Council present, the Mayor declared the Public Hearing to be open. There were no comments fi'om the public. -3- AUGUST 20, 2009 Public Hearing Closed ORDINANCE #09-12 "Vacating a Portion of Salem Avenue in the Borough of Carteret First Reading ORDINANCE #09-08 "Amending the Redevelopment Plan for the West Carteret Minue Street Retail Redevelopment Area- Phase II" Public Hearing AUGUST 20, 2009 ORDINANCE #09-08 Cont: Public Hearing Closed Adopted PUBLIC PORTION ON RESOLUTIONS/ AGENDA ITEMS AND NEW BUSINESS Edward Hill There being no further comments or objections to the Ordinance the Mayor declared the Public Hearing to be closed upon MMS&C by Councilmembers Sitarz and Naples and unanimous affirmative vote of the full Council present. Upon MMS&C by Councilmembers Diaz and Krum ORDINANCE #09-08 "ORDINANCE OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, AMENDING THE REDEVELOPMENT PLAN FOR THE WEST CARTERET MINUE STREET RETAIL REDEVELOPMENT AREA, PHASE II" was finally Adopted. Upon individual roll call vote, Councilmembers Bellino, Colon, Diaz, Krum, Naples and Sitarz voted in the Affirmative. APPROVED AND ADOPTED: AUGUST 20.2009 INTRODUCED: JUNE 11. 2009 Advertised as Adopted on First Reading with notice of Public Hearing: AUGUST 12.2009 Hearing Held: AUGUST 20. 2009 Approved By: MAYOR DANIEL J. REIMAN Adveltised as Finally Adopted: AUGUST 26. 2009 Upon MMS&C by Councilmembers Sitarz and Naples and unanimous affirmative vote of the full Council present, the Public Portion on Resolutions/Agenda Items and New Business was opened to the public. Mr. Edward Hill, 37E1m'rrd Avenue then addressed the Goveming Body. He explained for the last eighteen (18) months -4- every time it rains he gets a push back from the sewer system, the last occurrence being July 28th. He said the storm sewers are not overflowing, but, the sewer sy~tem is. He spoke about flooding on Lewis Street and he handed out pictures to the Mayor and Council showing damage in his home. He said he met with John DuPont and discussed the problem. He asked for relief. Mayor Reiman told Mr. Hill that is something they wil! evaluate with Engineering, explaining that the sanitary sewer system and the storm water system are two separate distinct systems, of which the storm water system has been upgraded over the last twenty (20) years, and over the past few years we have added significant pumping ability to the point where we can pump fifty-five (55) thousand gallons per minute of storm water out of the city. He said the problem with the most recent event was that it was a one hundred and fifty (150) year storm, which should not occur again for another one hundred and fifty (150) years, causing flooding in areas of Carteret and throughout the state where there normally they would not have experienced it. Mayor Reiman and Mr.Hill spoke briefly about this problem and then Mayor Reiman told Mr. Hil! they will address the problem with the Engineering Department and get back to him. Constance Foley then addressed the Goveming Body. She first thanked the Mayor and Council for their service in the town and then she went on to inform them that she had been accosted by a beggar on Pershing Avenue. She went on to describe conditions on Thomal Street, explaining the parking is horrible and there are boats and commercial vehicles illegally parked on the street. Mayor Reiman explained to her there are specific ordinances for that and informed her that he and Captain McFadden had recently been out there and agreed there was some illegal parking and it wil! be addressed. -5- AUGUST 20, 2009 Edward Hill Cont: Constance Foley AUGUST 20, 2009 Christine Kilyk . MEETING CLOSED TO PUBLIC Christine Killik: then addressed the Goveming Body. She told them she had many complaints regarding Thomal Street in reference to parking and property maintenance. She questioned what one had to. do to get someone to enforce these issues, commenting that she had made calls and sent emails. Mayor Reiman explained to her there had been some issues on Thornal Street in regard to property maintenance and Owen Ravion, our Health Inspector and Gary D'Onofrio, our Property Maintenance Inspector had been out there. He explained the first thing they want to do is approach the homeowners because you would not want to issue a summons to a resident of Carteret who trys to maintain their property, especially in these economic times and if that is to no avail, they wil! issue a warning notice, which they have thirty (30) days to abate. Then if they stil! do not remedy the situation a summons is issued and they would have to appear in court in front of the judge. He told her if after the meeting she has specific addresses she can give them to him and post this meeting he and some of the Councilmembers will take a ride out there. He also explained to her that esthetics are completely different from property maintenance and they have no control over esthetics. Christine Kilyk then asked if they would be puttng a Duncan Donuts on this side of Carteret. Mayor Reiman said he would try to get one over there. Upon MMS&C by Councilmember Diaz and Naples and unanimous affirmative vote of the full Council present, the public portion of the meeting was closed. -6- Mayor Reiman then read the Resolutions into the record: "Resolution #09-180, Directing the Issuance of Various Raffle Licenses. Resolution #09-181, Accepting a Grant from the Hazardous Discharge Site Remediation Fund Public Entity Program through the New Jersey Economic Development Authority and the Depmtment of Environmentall Protection." Mayor Reiman explained that this is a part of the Brownfields Redevelopment Area; a grant reimbursing us for monies that we have spent over the last six (6) or seven (7) years on certain Brownfields cleanup, on certain Borough owned properties. "Resolution #09-182, Authorizing a subordination and Non- Disturbance Agreement with or on Behalf of Titan-PDC Carteret Urban Renewal, LLC and its Tenants." Mayor Reiman eXplained that this guarantees the tenant of the IPort 12 Project, because they have a lease for a portion of the building, that if the property owner does not pay their taxes the tenant wil! pay the taxes in lieu of their lease. It guarantees that the city will receive its pilot and tax money and said there is basically nothing for us to do except authorize the signing of it. It is really between the two (2) private property owners. Mayor Reiman then asked for a motion on the Consent Agenda. Resolutions #09-180 thru #09-182 were introduced by the Mayor and referred to the Council for action. Upon individual roll call vote Councilmembers Bellino, Colon, Diaz, Krum, Naples and Sitarz voted in the Affirmative. Upon MMS&C by Councilmembers Diaz and Sitarz, all bills appearing on the prepared list, properly audited and signed, were ordered to be paid. Upon individual roll call vote, Councilmembers Bellino, Colon, Diaz, Krum, Naples and Sitarz voted in the Affirmative. COMMITTEES BUILDINGS & GROUNDS - Committee Chairperson Naples repOlted no major projects at this time, just seasonal work. She said they have been fortunate to be able to utilize workers in her depmtment and other departments through the County, who are paid by the Workforce Investment Act, for some extra summer assistance. FINANCE AND ADMINISTRATION: Committee Chairperson Diaz repOlted continued progress in Finance. -8- FIRE & DOMESTIC PREPAREDNESS: Committee Chairperson KIum congratulated Firefighter Mark Hurshka and Sam Goddess who successfully completed their training certification as Fire Inspectors. He went on to say three (3) members, Captain Rich Bonner, Firefighter Brendan Rhodes and Jason Lombardi, have joined the newly established Middlesex County Urban Search and Rescue Team and are cIUTently in training with thirty (30) other members throughout Middlesex County. PARKS, RECREATION & PUBLIC PROPERTY - Committee Chairperson Bellino repOlted seasonal work and the last concert in the park would be Friday night and Sunday. Progress. POLICE - Committee Chairperson Sitarz reported one of the cars have been replaced and m'e in a quandary of what kind of cars they will be buying. Mayor Reiman directed his response to Captain McFadden, who was present at the meeting, that the only kind of cars they would be buying for the Police Depmtment would be hybrids. PUBLIC WORKS: Committee Chairperson Colon reported the New Jersey Tumpike Improvements are scheduled to be completed by the end of October. She went on to say paving will be stmted on Roosevelt Avenue and will be completed about two (2) months ahead of schedule, with a starting cost of about seven (7) mil!ion dollars. She said the project will increase toll plaza capacity, a direct connection to Industrial Road and a fly over ramp to handle the volume of traffic from West Carteret. She said the Borough is trying to have the bridge widened, but, the Turnpike is resisting and we are also trying to get the bridge renovated with new paving and fencing and guard rails. Progress. BOARD OF EDUCATION: Committee Chairperson Naples repOlted school will be stmting September 2nd and the schools will be launching a special website with the purpose of having greater communication between the schools and the homes, with a lot of information and some parent training. -9- AUGUST 20, 2009 COMMITTEES Cont: AUGUST 20, 2009 Mayor Reiman Meeting Recessed Clerk I S Note Meeting Renconvened ROLL CALL Mayor Reiman then said what he was about to do, he was sure, has never been done before in the State of New Jersey. He explained that they will be taking a recess and he will reconvene this meeting at the comer of Randolph and Thomal Street. He directed the Assistant Clerk, Linda Rivera, that she was to come along and take notes and they will re-open the meeting on the street as they do a walk through of this block and they wil! conclude our Council Meeting on ThornaI Street. At approximately 6:15 P.M., upon MMS&C by Councilmembers Naples and Colon and unanimous affirmative vote of the full Council present the meeting will be recessed and reconvened on Thomal Street. Please note at this point the meeting will be transcribed solely by the notes taken by the Assistant Municipal Clerk. At approximately 6:30 P.M., the meeting was reconvened on the corner of Randolph and Thomal Street. Sitarz Also noted present was Assistant Municipal Clerk Linda Rivera and Borough Attorney Robert Bergen and Police Captain Dennis McFadden. -10- As all present walked through Thomal Street Mayor Reiman asked the Clerk to make notes of certain violations. Mayor Reiman asked the Clerk to make a note of celtain homes on Thomal Street in need of propelty maintenance. He noted that the street needed sweeping and Public Works would be sent out for street sweeping and the Fire Depmtment for a hose down. He noted that the corner of Thomal and Maple Street needed sidewalks and curbs. He also noted that there were trailers parked in the streets that were against code. As the walk tlu'ough was completed Mayor Reiman then asked the Assistant Municipal Clerk to call roll, at approximately 6:38 P.M.
