RESOLUTION NO.
RESOLUTION GRANTING AN AMENDED
CONDITIONAL USE PERMIT TO
KENNETH DOBOSZENSKI AND PHYLLIS DOBOSZENSKI
DBA DANNY'S CATERING
WHEREAS, Kenneth Doboszenski and Phyllis Doboszenski, dba Danny's
Catering (Applicants) previously have been granted a conditional use permit to
operate a bakery, restaurant and catering business at 4425 T.H. 55 by resolution
no. 88-13 dated March 15, 1988, and by resolution no. 89-58 dated August 15, 1989;
and
WHEREAS, the Applicants have applied for an amendment to their conditional
use permit to allow a 24' X 24' cooler room addition; and
WHEREAS, this matter has been reviewed by the planning commission on
October 8, 1991, and by the City Council on November 5, 1991; and
WHEREAS, it has been determined that granting an amended conditional use
permit will not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that an amended conditional use permit be granted to the
Applicants for the stated purpose, subject to the following terms and conditions:
1. There may be no exterior storage on the site;
2. The exterior building materials of the existing structure must remain
unchanged and the proposed additional must comply with all city
requirements;
3. The sign must be as proposed by the Applicants and meet city code;
4. The exterior trash container must be screened from view with materials which
are compatible with those used on the exterior of the principal structure;

5. The Applicants must install landscaping as required by the city's ordinance,
work with staff regarding the type and location of the landscaping, and take
a cash deposit to the City of $400 to ensure completion of the landscaping;
6. Hardsurface coverage may not exceed the 60/40 ratio as shown on the plan
submitted the City;
7. The hours of operation may extend to 24 hours per day, 7 days per week;
8. The number of employees on site may not exceed 12;
9. All exterior lighting must be designed and installed in accordance with the
plans submitted by the Applicants and so that the globe is recessed and
enclosed on all sides except the bottom and that no light is cast directly on any
other property or right-of-way;
10. The cooler room addition to be built on the building may not exceed 24' X 24'
and must meet all codes;
11. The on -site septic system and drainfield are subject to approval by city staff;
12. A11 food handling operations must be approved and licensed by Hennepin
county;
13. The Applicants must utilize grease traps in the kitchen and low water use
toilets as required by city staff;
14. The Applicants must screen all rooftop mechanical equipment to the
satisfaction of city staff, including the equipment located on top of the cooler
room addition which must be screened by a parapet on top of the north wall or
by increasing the pitch of the roof;
15. There may be no overnight parking of vehicles on site;
16. The existing shed must meet city setback requirements from the principal
building and all property lines;
17. The Applicants must comply with all plans and drawings submitted to the City
and upon which City review has been conducted;
18. The Applicants must pay to the City a fee in the amount determined by the
staff to represent the actual cost to the City of reviewing this conditional use
permit application;
h 19. The Applicants must dedicate to the City the right-of-way for County Road 19
and T.H. 55 as determined by the city engineer; and
IN
20. Any violation of the terms and conditions of this conditional use permit or of
any related section of the City's ordinance code shall be grounds for
revocation of this conditional use permit.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the
City of Medina, that Resolution No. 88-13 and 89-58 are hereby revoked.
