AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT
CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED AT 4211
PINEHURST COURT; DESCRIBED AS LOT 45A OF THE REPLAT OF LOTS NOS. 45
AND 46, THE MEADOWS BY THE CLUB, SECTION THREE, IN THE COUNTY OF
COLE, STATE OF MISSOURI; AND AMENDING SECTION 1-17 OF THE CODE OF
THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY
BY ADDING ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo, the City Council of the City of
Jefferson desires to annex the unincorporated area of land described in
Section 1; and
WHEREAS, the property is owned by Jodi and Rex Hardman; and
WHEREAS, the property is adjacent to the City; and
WHEREAS, a public hearing concerning the annexation was advertised in advance of
the hearing in the Jefferson City News Tribune; and
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The City Council intends to and shall proceed to annex, as provided
by law, the unincorporated area of land described as follows:
Lot No. 45A of the Replat of Lots Nos. 45 and 46, The Meadows by the Club,
Section Three, per plat of record in Plat Book 11, Page 895, Cole County
Recorder's Office; The Meadows by the Club, Section Three, being a subdivision
of part of the Southeast Quarter of the Northwest Quarter and part of the
Northeast Quarter of the Northwest Quarter of Section 8, Township 44 North,
Range 12 West. Subject to easements and restrictions of record. Containing
approximately 0.63 acres.
Section 2. The City Council finds and declares that the land described in
Section i is contiguous to the City boundary; that the annexation is reasonable and
necessary to the proper development of the City; and further, did determine the City has
an ability to furnish normal municipal services to this area.
Section 3. A public hearing was held on April 5, 2010 as provided by law,
concerning the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned RS-1 until such time
as the zoning may be changed in the manner provided for by State Statute and City
Code.
Section 5. Section 1-17 of the City Code of the City of Jefferson, Missouri is
hereby amended by adding one new subsection which shall read as follows:
( ) The City's boundaries shall also include the following parcel: Lot No.
45A of the Replat of Lots Nos. 45 and 46, The Meadows by the Club, Section Three, per
plat of record in Plat Book 11, Page 895, Cole County Recorder's Office; The Meadows
by the Club, Section Three, being a subdivision of part of the Southeast Quarter of the
Northwest Quarter and part of the Northeast Quarter of the Northwest Quarter of Section
8, Township 44 North, Range 12 West.
Section 6. The annexed area shall be in Ward 4 of the City.
Section 7. The effective date of this Ordinance and the annexation of the area
described in Section 1 will be immediately upon passage, provided that no written
objections to the proposed annexation are filed with the City Council. If sufficient
objections are filed, this ordinance shall not become effective until such time as the
annexation issue has been resolved pursuant to the provisions of Chapter 71 RSMo.

The City Council of the City of Jefferson, Missouri, will hold a public hearing on Monday, April 5,
2010 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal Building, 320 East
McCarty Street, to consider voluntary annexation by the City of Jefferson and zoning plan of
RS-1 Low Density Detached Residential for the following described real estate, owned by Rex
and Jodi Hardman: Lot No. 45A of the Replat of Lots Nos. 45 and 46, The Meadows by the
Club, Section Three, per plat of record in Plat Book 11, Page 895, Cole County Recorder's
Office; The Meadows by the Club, Section Three being a subdivision of part of the Southeast
Quarter of the Northwest Quarter and part of the Northeast Quarter of the Northwest Quarter of
Section 8, Township 44 North, Range 12 West. Subject to easements and restrictions of record.

Case No. P10006 — 4211 Pinehurst Court; Voluntary Annexation. Application filed by Jodi and Rex Hardman,
property owners, for a voluntary annexation pursuant to Section 71.012 RSMo and zoning plan of RS-1 Low Density
Residential. The property contains 0.63 acres of land generally located on Pinehurst Court approximately 250 feet west
of the intersection of Turnberry Drive. The property consists of Lot 45A of the Replat of Lots Nos. 45 and 46, The
Meadows by the Club, Section Three,Cole County, Missouri.
Nature of Request
The purpose of the request is to incorporate the subject property into the city limits of the City of Jefferson with a
single family residential zoning designation. The property owners have petitioned the City for voluntary
annexation.

Staff Analysis and Recommendation
Voluntary Annexation and Zoning Plan:
The property owner has submitted a petition to annex the property into the city limits of the City of Jefferson.
The property sits adjacent to an existing RS-1 single family residential zoning district and the property meets the
lot standards for the RS-1 district. The property is contiguous to the current city limits and the property lends
itself well to incorporation. Staff recommends approval of the annexation petition and designation of the property
as RS-1 Single Family Residential on the Zoning Map.
Form of Motion:
Approval of the annexation petition and zoning plan for the property to be zoned RS-1 Low Density Detached
Residential.

This application authorizes the City to prepare a Petition for Voluntary Annexation of Contiguous Property
or Agreement for Future Voluntary Annexation of Non-Contiguous Property
Instructions: Property owners requesting annexation by the City of Jefferson should complete this form and attach copies of the
following: (1)property deeds (2) list of all property owners if not listed on the deeds and (3)location map. For applicants requesting
sanitary sewer services,this application should be submitted with a copy of the subdivision plat and/or improvement plans.After receipt by
the Department of Community Development,the application will be forwarded to the Law Department where the Petition orAgreement,
as appropriate, will be prepared.Please note that all owners of the subject property must sign the actual Petition orAgreement.Aftera
Petition has been signed, annexation of contiguous property(property that already touches the city boundary) may be processed
immediately. Annexation of non-contiguous property(property that does not touch the current city boundary)will be held until such firne
as the property does become contiguous. In all cases,City staff will contact the property owner to complete the process.Please return
this form and supporting documentation to:

Application filed by Jodi and Rex Hardman, property owners, for a voluntary annexation
pursuant to Section 71.012 RSMo and zoning plan of RS-1 Low Density Residential. The

The processing of this application involves the following steps:
Y The Jefferson City Planning and Zoning Commission will meet at 5:15 p.m. on Thursday, March 11,
2010 to consider zoning the property as RS-1 Low Density Residential.
Y The City Council's public hearing is tentatively scheduled for Monday, April 5, 2010 at 6:00 p.m.,
after which the annexation petition may be accepted by the Council.
Y Both meetings will be held in the Council Chamber of the John G. Christy Municipal Building (City
Hall), 320 E. McCarty Street, Jefferson City, Missouri 65101.
