CALL TO ORDER: 1 1 CITY OF TEMPLE CITY CITY COUNCIL MINUTES APRIL 21, 1981 Mayor Atkins called the regular meeting of the City Council to order at 7:32 p.m. on Tuesday, April 21, 1981, in the Council Chamber of the City Hall. 2. The invocation was given by Dr. Ed Linberg, Temple City Christian Church, 9723 Garibaldi Avenue. 3. The Pledge of Allegiance was led by Mayor Atkins. 4. ROLL CALL: Present: Councilmen - Dennis, Gillanders, Merritt, Tyrell, Atkins Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Kimbrough, Director of Parks and Recreation Kobett, Associate Planner Chris Peterson, and Julie Estrada, Temple City Times 5 REORGANIZATION: Mayor Atkins thanked the Ministerial Association for their cooperation in providing an invocation for the Council meetings and also for inviting him to participate in the Easter Sunrise service. Mayor Atkins also expressed his thanks to the City Manager and staff for their support in the past year, and to the Council members who have helned make his year as Mavor a good experience. At this time Mayor Atkins turned the gavel over to the City Clerk. City Clerk Koski assumed the Chair and opened nominations for the Office of Mayor for the coming year, Councilman Dennis stated there is a gentleman on the Council who has dedicated many years of his life in service to the City, and has indicated this will be his last term on Council and he feels it would be appropriate as a parting gesture on the part of the Council to honor him and ask him to serve as 1981 -82 Mayor. Council- man Dennis nominated Councilman Merritt for the Office of Mayor, seconded by Councilman Tyrell. Councilman Tyrell stated it has always been a policy that a Council- man who would be running for election would not serve as Mavor and this would be an exception, and asked Councilman Merritt his in- tentions. Councilman Merritt stated he would not be seeking another term on the City Council. Councilman Gillanders called for a roll call vote, Councilman Merritt was elected Mayor by a roll call vote: ROLL CALL: AYES: Councilmen - Atkins, Dennis, Merritt, Tvrell NOES: Councilmen - Gillanders Mayor Merritt accepted the gavel, stated he annreciated the privilege of serving as Mavor this final year on the City Council, and called for nominations for the Office of Mavor Pro Tem. Councilman Dennis moved to nominate councilman Gillanders for the Office of Mayor Pro Tem. seconded by Councilman Tvrell. Councilman Tvrell moved that nominations be closed and a unanimous ballot be cast for Councilman Gillanders, seconded by Councilman Atkins and carried. On behalf of the City Council, Mayor Merritt presented a plaque to Councilman Atkins in appreciation for a job well done. Dennis Councilman Tyrell moved to adopt Resolution No. 81 -1975 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, APPOINTING A MEMBER OF SAID COUNCIL OF SAID CITY TO THE RTD CITY SELECTION COM- MITTEE PURSUANT TO PART 3 OF DIVISION 10 OF THE PUBLIC UTILITIES CODE, seconded by Councilman Atkins and carried. Councilman Tyrell moved to adopt Resolution No. 81 -1976 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING AN ALTERNATE DIRECTOR OF COUNTY SANITATION DISTRICT NO. 15, seconded by Councilman Dennis and carried. 6. CONSENT CALENDAR: On motion by Councilman Tyrell, seconded by Councilman Dennis, Items A through K were approved as recommended. A. APPROVAL OF MINUTES - Regular Meeting of April 7, 1981 Approved as written. B. ORDINANCE NO. 81 -504: 2nd read. RELATING TO PRICINNG CONSUMER COMMODITIES Waived further reading and adopted by title only; Ordinance No. 81 -504= AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADDING NEW SECTION 4821 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO PRICING CONSUMER COMMODITIES. C. PLANNING COMMISSION ACTION - Meeting of April 14, 1081 Received and filed memo relating to action taken by the Planning Commission at their regular meeting held April 14, 1081. RECOMMENDATION FROM PARKS & RECREATION - Meeting of April 15, 1981 REQUEST FOR USE OF LIVE OAK PARK, TEMPLE CITY YOUTH FOOTBALL Approved recommendation from Parks & Recreation Commission that the request received from the Temple City Youth Football for use of Live Oak Park June 6, 13 and 20, 1981 for registration and from August 10 through December 4, 1981 for league practice and use of the Con- cession Stand be approved, subject to the required Certificate of Insurance. E. REQUEST FOR AUTHORIZATION TO RECRUIT FOR SUMMER RECREATION Authorized recruitment for necessary personnel to conduct the Summer Recreation Program based on the Department's need to recruit com- petent part -time staff, F. DISPOSAL OF SURPLUS PROPERTY Declared certain items to be surplus and authorized disposal pursuant to Section 2512 of the Municipal Code. G. AWARD OF CONTRACT: RESTRIPING OF SELECT SYSTEM STREETS: PAVEMENT MARKINGS IN MAINTENANCE AREAS 1, 2 AND 3 Waived formal bid procedures and accepted bid and awarded contract to Safety Striping Services, Inc. in the amount of $14,497.45. H, STREET RESURFACING PROJECT: FY 1980 -81 - LONGDEN AVENUE, ROSEMEAD BOULEVARD TO BURTON AVENUE AND OLIVE STREET, TEMPLE CITY BOULEVARD TO BALDWIN AVENUE Approved Calendar of Events, approved specifications for resurfacing streets and authorized the advertising and receiving of bids. I, RESOLUTION NO. 81 -1977: SUPPORTING REPEAL OF SECTION 301 OF THE POWERPLANT AND INDUSTRIAL FUEL USE ACT Adopted Resolution No. 81-1977 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY IN SUPPORT OF LEGISLATION REMOVING THE RE- STRICTIONS AND PROHIBITIONS ON THE USE OF NATURAL GAS IN UTILITY POWERPLANTS, J. RESOLUTION NO. 81 -1978: EMPLOYMENT OF PERSONNEL Adopted Resolution No. 81 -1978 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL. K, RESOLUTION NO. 81 -1979: WARRANTS AND DEMANDS Adopted Resolution No. 81 -1979 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $226,917.29, DEMAND NOS. 1773 THRU 1833. 7. UNFINISHED BUSINESS: A. ENGINEER'S REPORT FOR ANNEXATION NO. 1 TO THE CITY -WIDE LIGHTING DISTRICT City Manager Koski presented background information stating City Council, at their regular meeting held April 7, Resolution No. 81 -1973 ordering the Engineer's Report for Annexation No. 1 (Annexation 80 -1) to the city -wide lighting district. The Engineer's report has been submitted for Council review establishing the same formula for lighting district charges which has been applied to the rest of the City; the cost for areas with only intersection lighting is $3.50 per residential unit and for lighted residential areas the cost is $11.50 per residential unit. There are no commercial properties within the annexation area. Councilman Tyrell moved to adopt Resolution No. 81 -1980 A RESOLUTION OF THE CITY COUNCIL OF TEMPLE CITY APPROVING THE ENGINEER'S REPORT Council Minutes, April 21, 1981 - Page 4 FOR ANNEXATION NO. 1 TO THE CITY -WIDE LIGHTING DISTRICT, seconded by Councilman Dennis and carried. Councilman Tyrell moved to adopt Resolution No. 81 -1981 A RESOLUTION OF THE CITY COUNCIL OF TEMPLE CITY DECLARING ITS INTENTION TO ORDER THE ANNEXATION NO. 1 TO THE CITY -WIDE LIGHTING DISTRICT, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO, the public hearing to be held Tuesday, May 19, 1981, seconded by Councilman Dennis and carried. 8. NEW BUSINESS: A. APPLICATIONS FOR FIREWORKS STANDS , 1981 City Manager Koski presented 10 applications for fireworks stand permit, stating all 10 were filed and completed prior to the dead- line March 31, 1981, and recommended approval of'l through 10. Councilman Atkins moved to approve applications 1 through 10, seconded by Councilman Dennis and carried, Councilman Gillanders abstaining on applications land 6. City Manager Koski presented a letter from Kare Youth requesting permission for late filing. Councilman Gillanders moved to extend filing deadline for Kare Youth for 15 days, seconded by Councilman Atkins. Councilman Tyrell felt that 10 days was sufficient time for Kare Youth to file their application and City Manager should be author- ized to approve. Councilman Gillanders modified his motion for a 10 day extension to Kare Youth only, seconded by Councilman Atkins, and carried on a roll call vote: ROLL CALL: AYES: Councilmen- Atkins, Gillanders, Tyrell, Merritt NOES: Councilmen- Dennis 9. COMMUNICATIONS: There were no communications. 10. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. RECESS TO CRA: City Council recessed at 7:56 p,m. to meet as the Community Redevelopment Agency; approved the minutes of the regular meeting held April 7, 1981; and confirmed reorganization pursuant to the bylaws, The minutes are set forth in full in the records of the agency. RECONVENE AS CITY COUNCIL: 11. ACTION ON REQUEST BY CRA: There was no action to be taken. 12. MATTERS FROM CITY OFFICIALS: A. City Manager Koski stated AB 104 which would require the owner of a vehicle to furnish the Department of Motor Vehicles with proof of insurance prior to registration has been introduced. Councilman Tyrell moved to support AB 104, seconded by Councilman Dennis and carried, Councilman Gillanders abstaining. B. Transfer of Funds from Account 2384 City Manager Koski presented a memo stating staff proposes trans- ferring funds from account 2384 to several accounts to cover the cost of furnishings and eauipment for the E.O.C. Also Planning Department has a need for 3 two- drawer file cabinets to accommo- 1 1 1 Council Minutes, April 21, 1981 - Page 5 date maps and staff proposes to transfer funds to a Planning account. Councilman Tyrell moved to authorize the purchase of file cabinets for $609, appropriate additional funds and amend the budget accordingly, and to approve the transfer of funds as set forth in memo dated April 17, 1981, seconded by Councilman Gillanders and carried. C. Personnel Item City Manager Koski presented a request for mileage allowance in recognition of the additional responsibilities assigned to the Associate Planner for an interim period. Councilman Atkins moved to authorize a temporary mileage allowance for the Associate Planner in the amount of $100 per month for an interim period, effective January 1, 1981, seconded by Councilman Gillanders and carried. D. Appointment of Deputy City Treasurer City Manager Koski presented a memo from the City Treasurer recom- mending Nadean Tubbs be appointed Deputy City Treasurer to permit the Deputy to assist in the daily management of City funds. Councilman Atkins moved to confirm the appointment of Nadean Tubbs as Deputy City Treasurer effective April 22, 1981, seconded by Councilman Gillanders and carried. E. Councilman Dennis stated he would like to take the opportunity to thank former Mayor Atkins for his excellent leadership in the past year. F. Councilman Atkins directed Council's attention to a letter received from the City and County Engineers' Association regarding SB 215 which would increase the motor vehicle fuel tax revenues to cities, and requested staff to investigate and advise the Council. G. Councilman Tyrell directed Council's attention to a memo from City Manager Koski regarding improvements to the E.O.C.; namely a toilet and washstand and lockers and blankets for a total cost of $6,950. Councilman Gillanders moved to approve the immediate purchase of the items, appropriate additional funds and amend the adopted budget accordingly, seconded by Councilman Tyrell and carried. H. Mayor Merritt thanked former Mayor Atkins for the time and efforts he spent on the Council's behalf for the past year. I. City Manager Koski stated that, speaking on behalf of the entire staff, it has been a pleasure working with past Mayor Atkins. 13. ADJOURNMENT: On motion by Councilman Tyrell, seconded by Councilman Gillanders, meeting adjourned at 8:08 p.m. Next regular meeting of the City Council will be held Tuesday, May 5, 1981, 7 :30 p.m. in the Council Chamber of the City Hall.
