Mr. Gold said he was concerned about a possible violation of our ordinance restricting motor boats near the shore line. It was moved by Mr. Beatty, seconded by Mr. Taplin and voted that subject to the approval of the Village Manager and Village Attorney on Sky Show Productions liability and the indemnification of Bal Harbour,that he be allowed to operate on January 12, 1982 only during the Sheraton Hotels' Sales Meeting. Mr. Maley said he contacted Dade County to sift the beach from the water line to the dune to pick up rocks. Mr. Gutenstein outlined the Tourism Department's schedule of events for the holidays, including pony rides, Santa, caroling, kite flying and a water show. Mr. Maley was excused from the meeting and the council on motion of Miss Gray, seconded by Mr. Taplin and voted was awarded a $1,000 Christmas bonus as he does not share in the Employees Christmas Fund. Mayor Attest: --- 6 }` r te Village Clerk December 8, 1981 COUNCIL MINUTES January 19, 1982 The Council of Bal Harbour Village met in special session, Tuesday, January 19, 1982, in the Village Hall to consider several pending items. Present: Miss Gray and Messrs. Beatty, Printup, Sherman and Taplin Also present were Fred W. Maley, Village Manager, and Mary T. Wetterer, Village Clerk. Mr. Maley reported that we have received the permit from the Florida Department of Transportation to construct the bus pull-out bay, as shown on the plan presented to the council, and that the job will be put out for bids this Thursday. The contract provides that the bidder will have thirty days to complete the work. He said that the Sheraton is having Edward D. Stone and Associates draw plans for landscaping and a possible wall between the bay and their property. Mr. Maley told the council that he has not had any word from Dade County regarding the restriping of Collins Avenue to channelize traffic in the vi- cinity of the Sheraton, and is still concerned about the traffic flow with the new striping. After discussion it was the council's opinion that Mr. Maley should contact Dade County and ask them to delay work until the bus bay is constructed. January 19, 1982 The Village Manager explained the design of the new street lighting brackets for the Collins Avenue and 96th Street lighting, pointing out the three voltages on the poles for highway, sidewalk and decorative displays. After the plans are completed next week they will be ready for bidding. It will take between sixty to ninety days for the successful bidder to aSs mble all the parts so the job can be completed without delay. It was moved by Mr. Taplin, seconded by Mr. Sherman, that Mr. Maley be authorized to ad- vertise for bids on the lighting project. Mr. Maley said that the Village received twenty proposals from Engineering firms in response to our ads for a new Engineer of Record. He will reduce the list to about five this week and would like their representative to come to the next meeting. It was suggested by the council that Mr. Maley condense their qualifications to a few pages so that they could review them before the meeting. As soon as the Engineer is choosen their first project will be to prepare plans, specifications and cost estimates of the single family dis- trict street resurfacing project. Mr. Maley said the State of Florida is requesting applications for Water Resource projects to be submitted by February l7th for fiscal year 1984. Zurwelle-Whittaker did a survey during the summer of 1980 which showed a nine percent loss to our restored beach over the past six years. To preserve our beach, he believes a renourishment request should be included in the 1984 allocation. He said he took the Zurwelle-Whittaker survey and a November, 1980 State of Florida survey and profiles to Mr. von Oesen last week and his firm will review the plans, make an estimate of renourishment needed and file the application with the State for a fee of $1,500 to $2,000. It was moved by Mr. Taplin, seconded by Mr. Beatty and voted to have the work done by Henry von Oesen. Mr. Maley reviewed the single family district storm drainage project and said the engineers have changed the type of construction and the job would now be done all at one time. He feels that the cost should be more favorable than the bids that were rejected last fall. It was moved by Miss Gray, seconded by Mr. Sherman and voted that the revised plans be put out for bids so the work can be completed before the street resurfacing project. (Mr. Beatty was not present for part of the discussion and the vote.) Mr. Maley reported that Mr. Hart had called Judge Hoeveler's office and was advised that a decision on the Great Lakes Dredge and Dock suit will be made within 10 days. He said after the decision is made that Messrs. Hart and von Oesen and Miss Visavitch would like to appear and explain the case and the costs involved. Mr. Maley said that Mr. Gold and our sound engineer, Mr. Voyce, were meeting with the sound engineer from the Sheraton this afternoon to work on the proposed ordinance. Mayor Printup said that Mr. Logan, attorney for Mr. Lang, had approached him in regard to a possible variance to permit a garage to extend fifteen feet into the front set back on Park Drive on a proposed residnece. It was the council's opinion that this variance would not be allowed. Mr. Maley said the landscaping on the Collins Avenue median strip should be rejuvenated before the new lighting is installed. He said the firm of Douglas Ruth and Associates have updated our plan last summer and the cost should be around $25,000 in view of some informal bids Mr. Maley had received. Mr. Maley was asked to get three bids on the relandscaping for the next meeting. January 19, 1982 2nd by Mr. Maley said that the South Florida Water Management District would be meeting in the area to discuss proposed water conservation regulations and that someone would attend. The Council reviewed the statements from Security Trust Company for the Employees Pension Trust as of December 31, 1981. The council noted that the Dade County Planning Department will hold a meeting on the future land use in the Sunny Isles area on February 3rd. Mr. Sherman reviewed some of the items the Planning Department is con- sidering. Mr. Taplin suggested that a uniform sign ordinance should be adopted for the area. Miss Gray asked if anyting could be done to keep people from fishing in front of the apartment building west of Bakers Haulover bridge. Mr. Maley said Mr. Gold was preparing a "No Fishing" ordinance for this area. Mr. Printup reported that he had attended a Florida League of Cities meet- ing in Tallahassee last week and the League is pushing the 1% additional sales tax for tax relief to cities and counties. Present: Messrs. Beatty, Printup, Sherman, Taplin and Miss Gray Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney. On motion of Mr. Beatty, seconded by Miss Gray and voted the minutes of December 8, 1981 and January 19, 1982 were approved as submitted. Mr. Maley reported that he had visited the five engineering firms selected by himself, our Building Inspector and our Public Works Super- intendent to interview their personnel. He said that he had just finished the visits and was not ready to make a recommendation. It was moved by Mr Beatty, Mr. Taplin and voted that a special meeting would be held one week from today, February 2nd. to interview the firm to be recommended by Mr. Maley. January 26, 1982
