RESOLUTION ORDERING IMPROVEMENT OF PIONEER TRAIL
FROM T . H . 55 TO A POINT 1500 FEET SOUTHEAST THEREOF;
PREPARATION OF PLANS AND SPECIFICATIONS; AND
THE ASSESSMENT OF THE COSTS THEREOF
WHEREAS, a public hearing was held on September 3, 1991, on the
improvement of Pioneer Trail from T . H . 55 to a point 1500 feet southeast thereof by
constructing a roadway with stabilization fabric, 12 inches of aggregate base and 4
1/2 inches of bituminous paving, 24 feet with 6 foot gravel shoulders and
reconfiguring the intersection with T . H . 55, at which hearing all persons having an
interest in the proposed improvement project were heard; and
WHEREAS, a public hearing was held on October 1, 1991, on the assessment
of benefitted properties for the cost of the Pioneer Trail improvement project, at
which all persons desiring to be heard were given an opportunity to be heard
thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota as follows:
1. The improvement of Pioneer Trail as described above is hereby ordered.
2. Bonestroo, Rosene, Anderlik & Associates is hereby designated as the
engineer for this project and shall prepare the necessary plans and
specifications.
3. It is the judgment of the city council that the improvement of Pioneer Trail
described above has no relationship to the city's comprehensive plan.
4. The proposed assessment, a copy of which is attached hereto and made a part
hereof, is hereby accepted and shall constitute the special assessment against
the lands named therein, and each tract of land therein included in hereby
found to be benefitted by the improvement in the amount of the assessment
levied against it.

5. The assessment shall be payable in equal annual installments extending over
a period of _ years, the first of the installments to be payable on or before
the first Monday in January, 1992, and shall bear interest at the rate of _
percent per annum from the date of the adoption of this assessment resolution.
To the first installment shall be added interest on the entire assessment from
the date of this resolution until December 31, 1992. To each subsequent
installment when due shall be added interest for one year on all unpaid
installments.
6. The owner of any property so assessed may, at any time prior to certification
of the assessment to the county auditor, pay the whole of the assessment on
such property, with interest accrued to the date of payment, to the city
clerk -treasurer, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of this resolution; and the
owner may, at any time thereafter, pay to the clerk -treasurer the entire
amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must
be made before November 15 or interest will be charged through December 15
of the next succeeding year.
7. The clerk -treasurer shall forthwith transmit a certified duplicate of this
assessment to the county auditor to be extended on the property tax lists of
the county. Such assessments shall be collected and paid over in the same
manner as other municipal taxes.
