RESOLUTION ASSESSING CERTAIN
COSTS AGAINST THE PROPERTY
LOCATED AT 2835 ARDMORE AVENUE
WHEREAS, the property located at 2835 Ardmore Avenue in Medina (the
Property) , which is legally described as follows:
Lots 1 to 4 inclusive, Block 31, "Independence Beach," Hennepin County,
Minnesota, including that part of the adjoining East Half of Brook Avenue,
vacated, lying between the extensions across it of the North and South lines
of said Lot 1, according to the recorded plat thereof
has been declared a hazardous building within the meaning of Minnesota Statutes
Section 463.15 , et seq . by means of an Order adopted by the city council on
September 4, 1990; and
WHEREAS, the City has incurred certain expenses in demolishing the
hazardous building on the property and administrative costs associated therewith
since the date of adoption of the Order ( the Costs) ; and
WHEREAS, the owner of the Property has not reimbursed the City for the
Costs and as requested that they be certified to the county auditor and specially
assessed against the Property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota as follows:
1. The council finds that the Costs stated in the assessment roll attached hereto
are a true and correct listing of the out-of-pocket costs incurred by the City
in removing the hazardous building at 2825 Ardmore Avenue.
2. The assessment shall be paid in five equal annual installments and interest at
a rate of eight percent per annum shall be added to such assessment.
3. The clerk -treasurer is hereby authorized and directed to certify the Costs to
the county auditor and to take any and all actions necessary to have the Costs
specially assessed against the Property.
