HomeMy Public PortalAbout05 09 06 MinutesMINUTES OF THE FINE ASSESSMENT/STATUS HEARING HELD BY THE SPECIAL C; MASTER OF THE TOWN OF GULF STREAM ON TUESDAY, MAY 9, 2006, AT 10:00 A.M., IN THE COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. Special Master Lara Donlon called the hearing to order at 10:01 A.M. and administered the Oath to Charles Sununu and William Thrasher, Town Manager. She instructed that the Town would first present their case and then the defendant could present their case and cross-examine if, so desired. Case No. CEI -06; Charles Sununu, 820 Canary Walk Failure to Comply with Order of Special Master William Thrasher, the Town Manager, presented the following exhibits: 1) Copy of delivery of Article 162, Notice of Fine assessment and the return receipt showing the notice was received on April 21, 2006, by Mr. Sununu. 2) A copy of a police report dated April 20, 2006, stating the pool was still in violation. Mr. Sununu verified both exhibits. Mr. Thrasher explained that there is still stagnant water in the swimming pool and a police officer verified that there was still stagnant water in the pool one hour prior to the hearing. The Special Master asked Mr. Sununu to respond regarding these violations. Mr. Sununu stated that he has been unemployed since March and his primary concern was finding employment. He stated that he has contacted 20 swimming pool contractors and no one did that kind of work. He bought a pool pump at Home Depot on May 8, 2006 but it drains very slowly. He stated that he would be contracting with Summerland Pools to drain and pressure/acid wash the pool. He added that he has complied with some of the violations by installing a temporary pool barrier and removing the loose aluminum. He stated that he would be starting to clean the pool next week. Special Master Donlon asked Mr. Thrashser what he would recommend on behalf of the Town to adjudicate this matter. The Town Manager sympathized with Mr. Sununu's situation but believed that the Town gave him an adequate amount of time to fix the violation. He requested that the respondent be fined $50.00 per day from April 11, 2006, until the violations are corrected and a two weeks extension be given to the respondent to remarcite the pool. Special Master Donlon asked Mr. Sununu he had any other comments. Mr. Sununu objected to the $50.00 per day fine and stated that the town should not dictate that he has to remarcite his pool. Town of Gulf Stream Code Enforcement Hearing March 28, 2006 Page 2 Special Master Donlon ordered that the swimming pool be drained, pressure/acid wash and be in working order and a fine of $25.00 per day be assessed for the violation that has existed from April 22, 2006, and will continue to acru at $25.00 per day for each day the violation continue to exist.
