HomeMy Public PortalAbout1991-94Member its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO._ %J/ ' r� RESOLUTION GRANTING A VARIANCE TO DAN AND ELIZABETH RICHARDSON WHEREAS, Dan and Elizabeth Richardson (Applicants) are the owner of the property which is legally described as Tract F,except road, Registered Land Survey No. 1049 on file in Hennepin County, Minnesota (Property); and WHEREAS, the Applicants have requested a variance for the Property to place a mound septic system in an area with a slope of up to 12 percent; and WHEREAS, Section 720.� of the City's individual sewage treatment and disposal systems code (Code) limits the slope of the site of a septic system to six (6) percent; and WHEREAS, Section 721.03 of the code permits granting a variance from the above requirements under certain circumstance,F. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, that a variance from the Code be granted to the Applicants for the above purpose, subject to the following conditions: 1. Number of bedrooms in house not to exceed 5; 2. Structure that is built is to use low water usage fixtures which is defined as stools that use a maximum of 2 gallons per flush and water softeners that use a water meter; 3. The mound septic system to be built according to the design by S-P Testing of September 27, 1991; 4. The downslope side of the mound is to extend as far as possible with a minimum of 30' from the rock bed; 5. The Applicant agrees to execute an agreement in a form satisfactory to the city attorney holding the City harmless and indemnify the City in the event the mound septic system fails or is damaged; and 6. The Applicant must pay to the City an administration fee in an amount sufficient to reimburse the City for its costs in reviewing the application. NOW, THEREFORE, HE IT FURTHER RESOLVED by the City Council of the City of Medina that the variance hereby granted is justified by the disturbed soils and there is no adjoining property owned by the Applicant.
