RESOLUTION GRANTING A VARIANCE FOR JEFFREY RUCHTI WHEREAS, Jeffrey Ruchti (Applicant) has requested a variance to reduce the required front yard setback from 150' from the center line to 50.8' to construct an addition to his house at 3102 Highway 55; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.457 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicants' request and has recommended approval thereof; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for the above variance is granted, conditioned upon construction of the house addition in strict accordance With the plans, specifications and drawings submitted by the Applicant and reviewed by the City. NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of Medina that the variance hereby granted,subject to the following condition: 1. The Applicant shall pay to the City a fee in the amount determined by city staff to represent the cost to the City for reviewing the application. BE IT FURTHER RESOLVED that the variance hereby approved is justified by the following circumstances which are unique tc the property: 1. The location of the well and septic system; 2. The slope of the property; and 3. The addition will not be closer to the road than the existing house.
