AWARDING ANNUAL SEWER SYSTEM EMERGENCY SERVICE CONTRACT
WHEREAS, the Borough of Carteret ("Borough") authorized the preparation of bid
specifications and contract documents and advertisement for receipt of bids for the Annual Sewer
System Emergency Service Contract; and
WHEREAS, B & W Construction submitted the lowest bid for the selected contract options
identified by the Borough's Engineering Department; and
WHEREAS, the Borough Engineer has reviewed the above referenced bid proposal and has
recommended an award of a contract for said work to B & W Construction; and
WHEREAS, the Borough's Chief Financial Officer has certified that funds are or will be
available for the award of a contract for said work.
NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of
Carteret, County of Middlesex and State of New Jersey as follows:
I. That the Borough hereby awards the bid for the Annual Sewer System
Emergency Service Contract to B & W Construction in the amount not to exceed
$396,498.40 for the one year period, including the overtime option, identified as
bid item lA.
2. That the appropriate Borough Officials are hereby authorized and directed to
enter into a contract with B & W Construction in accordance in all respects with
the request for proposals and bid on the same.
3. That a copy of this Resolution shall be forwarded to the Borough's Purchasing
Department, the Borough's Director of Engineering and B & W ConstnlCtion.

We have received bids for the Annual Sewer System Emergency SelVice Contract. We have reviewed
the bids and are recommending award for a 1 year period (with the overtime option - bid 1A), to B&W
Construction Co. The bids for this contract option were as follows:
. B&W Construction -
$396,498.40
. Montana Construction -
$404,090.30 (Corrected amount)
. Kurtis Excavation -
$488,950.00
The Montana Construction bid had an error in the calculations, and when the bid was corrected as per
the specifications, their bid increased from $394,090.30 to $404,090.30. The error and correction was
reviewed with the Borough Attorney to ensure the modification was made in accordance with the bid
specifications

IB.6.2. INCOMPLETE OR INFORMAL PROPOSALS
No bids will be considered in which all of the items given in the
Proposal are not filled out. Bidders are cautioned not to revise nor
attach any conditions, limitations, or provisos to the Proposal as such
conditions, limitations or provisos will render their bid informal and may
cause its rejection.
IB.6.3. COMPLETION AND SUBMISSION OF PROPOSALS
All prices and amounts must be ",Iritten in ink or, preferably,
typewritten. All erasures or corrections must be initialed by a signatory
to the Proposal.
Bids must be enclosed in sealed envelopes, addressed to the OWNER,
bearing on the outside the name and address of the bidder and must be
delivered at the place and time set in the advertisement. Bids received
after the hour herein named or in unsealed envelopes or without the
bidder's name on the outside thereof will not be considered.

-IB; 6. 4 . ERRORS IN PROPOSALS
In the event there is a discrepancy between the unit prices and the
extended totals, the unit prices shall govern or if between the correct
sum of the extended totals and the total bid submitted, the correct sum
shall govern. Amounts written in words shall govern over the amounts
given in numerals.
IB.6.5. MATERIALS TO BE BID IN PLACE
Unless otherwise specified, the price bid for each of the items in
the Proposal shall be for the material in place. Any and all costs
. necessary to construct, erect or place such material in the work shall be
estimated and included in the unit price of each item.
IB.6.6. ESTIMATED QUANTITIES
It has been the endeavor to estimate the approximate quantity of
each item in the Proposal to cover the requirements of the Contract.
However, it is usually expected that the quantity finally paid for "ill be
different than that quantity estimated for bidding purposes. In case a
greater or lesser quantity than those estimated in the Proposal is
required. to. finally complete the work, or in case an i~em scheduled is not
.'used, the CONTRACTOR agrees to make no claim for the variation, but will
accept final payffient based on the actual amount of work performed at the
unit price bid.
IB.7 PROPOSAL SECURITY
IB.7.l. SECURITY REQUIRED
Each proposal must be accompanied by a bid guarantee in accordance
"ith N.J.S.A. 40A:ll et seq. Said guarantee may, at the bidder's option,
be in. the form of a cashier's check or a certified check dra~'m on a New
Jersey bank or trust company or a bid bond from a surety company holding a
Certificate of Authorization to do business in the State of New Jersey and
~omplying with P.L. 1995, c. 384, and, if so required and noted in Notice
to Bidders and Special provisions, listed in the current U.S. Treasury
Department Circular 570, in the amount of at least ten percent (10%) of
the amount of the bid, but not in excess of $20,000.
IB.7.2. RETURN OF PROPOSAL SECURITY
Such Proposal Security "ill be returned to all except the three (3)
lowest formal bidders, unless otherwise requested by the bidder, within

As per Resolution Number 09-165.
THE CONTRACTOR does hereby agree to perform the following:
AWARD OF BID CONTRACT ANNUAL SEWER SYSTEM EMERGENCY
SERVICE CONTRACT.
NOT TO EXCEED: $396,498.40
According to the terms set forth in the Resolution & Bid.
THE BOROUGH does hereby agree to pay the Contractor the sum set forth in
Resolution.
IN WITNESS WHEREOF, the patties hereto have hereunder set their hands and seals or
caused these presents to be signed by their proper corporate officers and their corporate
seals to be hereto affixed, the day and year written above.
