CITY COUNCIL
MINUTES
MAY 5, 1931
III VITIATION:
. CALL TO ORDER:
Mayor Merritt called the regular meeting of the City Council to
order at 7:31 p.m. on Tuesday, May 5, 1981, in the Council
Chamber of the City Hall,
2. The invocation was given by Reverend Harvey Booher, First Southern
Baptist Church, 4856 N. Golden West Avenue.
3. The Pledge of Allegiance to the Flag was led by Mayor Merritt.

5. CONSENT CALENDAR:
On motion by Councilman Atkins, seconded by Councilman Dennis,
IIIItems A through G on the Consent Calendar were approved as
recommended,
A. APPROVAL OF MINUTES - Regular Meeting of April 21, 1981
Approved as written,
B. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of April 28, 1981
(1) PROPERTY NUISANCE CASE NO. 81 -62, 10628 Hallwood Drive
Adopted Resolution No. 81 -1982 ordering abatement of property
nuisance at subject location within 30 days,
(2) PLANNING COMMISSION ACTION
Received and filed memo relating to action taken by the Planning
Commission at their regular meeting held April 28, 1981.
C. ACCEPTANCE OF SANITARY SEWERS: TRACT NO. 35584, 6351 TEMPLE
CITY BOULEVARD
Approved the work completed and accepted for public use; released
the Sanitary Sewer Agreement and Faithful Performance Bond.
I D. RENEWAL OF AGREEMENTS: LOS ANGELES COUNTY
A. GENERAL SERVICES AGREEMENT - 5 YEARS
B. TRACT MAP AND PARCEL MAP CHECKING - 5 YEARS
Approved the General Services Agreement and Agreement for Tract
Map and Parcel-Map:Checking for-an .additional five years effective
July 1, 1981, and authorized the Mayor and City Clerk to sign.
E. ACCEPTANCE OF WORK: SLURRY SEAL PROJECT - MAINTENANCE AREA NO. 5
Accepted the work performed and authorized payment in the amount of
$2,400; authorized filing of Notice of Completion and release of
the 10% retention at the end of the 35 -day lien period.

F. RESOLUTION NO. 81 -1983: SETTING PUBLIC HEARING TO ESTABLISH
ASSESSMENT RATES PURSUANT TO 1972 LANDSCAPING AND LIGHTING ACT
Adopted Resolution No. 81 -1983 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY DECLARING ITS INTENTION iT0_ORDER THE
1981 -82 FISCAL YEAR LEVY FOR THE CITY -WIDE LIGHTING DISTRICT,
PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING
A TIME AND PLACE FOR HEARING OBJECTIONS THERETO, setting public
hearing June 2, 1981.
G. RESOLUTION NO. 81-1984: WARRANTS AND DEMANDS
Adopted Resolution No. 81 -1984 A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF
$78,410,73, DEMAND NOS. 1834 THRU 1886.

9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK;::
Tom Snyder, 7014 Encinita, spoke on behalf of. the Hunger Project
stating they have gotten approval from the Parks and Recreation
Commission to use facilities at Live Oak Park on Saturday, May 16,
from 12 noon to 7. p.m. for the purpose of showing films pertaining
to world hunger-and accept donations from the public. Donations
received will go to The Hunger Project,
Councilman Atkins stated that the Commission, in recommending
approval of the use of facilities at Live Oak Park, felt the
rental fees should not be waived.
Councilman Tyrell expressed concern .that their financial summary
did not indicate that any portion of their revenue goes to food
for the hunger'and that it appears to be only a promotional
operation.
City Attorney Martin-advised. the Council that no evidence has been
presented that this organization has a qualified non - profit status
and Council can deny on the basis there is inadequate showing of
a non - profit status.
Lee Hedge, 98 W. Sandra Avenue, Arcadia, spoke on behalf of the
Hunger Project and stated she would have brought the organizations
federal ID'relating to non - profit status if she had known it would
be required.
City Attorney Martin stated the problem is one of procedure. The
Hunger Project has bypassed the Parks and Recreation Commission,
coming directly to City Council with a request on May 5 for a
permit on May 16 with no evidence of the charitable nature of the
organization. Without judging the organization on its merits,
they have imposed a time problem.
Councilman Tyrell- moved to deny on the basis of insufficient
evidence of non - profit status, seconded by Councilman Atkins and
carried,
RECESS TO CRA:
City Council recessed at 7:43 p.m. to meet as the Community Redevelop-
ment Agency; approved the minutes of the regular meeting held

April 21, 1981; approved rental payment pursuant to Parking Lot Lease
Agreement on behalf of the City; adopted resolution approving warrants
and demands, accepted report of the Community Redevelopment Agency pre -
pared pursuant to California Health .& Safety Code Section 33838 and
adopted resolution transmitting the report to City Council. The minutes
are set forth in full in the records of the`Agency.

A. RESOLUTION NO, 81 -1985: LEVYING SPECIAL. ASSESSMENTS FOR CERTAIN
BENEFITED PROPERTIES WITHIN THE ROSEMEAD BOULEVARD REDEVELOPMENT
PROJECT AREA
City Council received the report of the Community Redevelopment
Agency prepared pursuant to California Health & Safety Code
Section 33838 and on motion by Councilman Atkins, seconded by
Councilman Gillanders and carried, adopted Resolution No. 81 -1985
A RESOLUTION OF THE CITY COUNCIL. OF THE CITY OF TEMPLE CITY LEVYING
SPECIAL, ASSESSMENTS FOR CERTAIN BENEFITED PROPERTIES WITHIN THE
ROSEMEAD BOULEVARD REDEVELOPMENT PROJECT AREA.
11. MATTERS FROM CITY' OFFICIALS:
A. California Contract Cities 22nd Annual Municipal Seminar -
Request Authorization to register City Officials.
Councilman Atkins moved to approve registration for those City
-Officials wishing to attend the Contract Cities Seminar in Palm
Springs, June 25 -28, 1981, and attendant expenses, seconded by
Councilman Tyrell and carried.
B. Mayor Merritt directed Council's attention to draft of the
summer Newsletter and stated any Council member wishing to make'
any additions should contact Patti Bates.
C. Mayor Merritt read a News Release from the Sheriff's
Department regarding their annual open house which will be
held Saturday, May 9.
12. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Dennis,
meeting recessed at 8:02 p.m. to an Executive Session. Next
regular meeting of the -City Council will be held Tuesday, May 19,
1981, at 7:30 p-.m. in the Council Chamber of the City Hall.
