AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A CONCEPT PUD PLAN FOR PROPERTY LOCATED IN THE 1600 AND 1700 BLOCKS OF HIGHWAY 179; CONSISTING OF PART OF THE WEST HALF OF THE SOUTHEAST QUARTER OF SECTION 15, TOWNSHIP 44 NORTH, RANGE 12 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI. WHEREAS, FAL Investments, LLC, owners of the real estate hereinafter described, having submitted to the City Council a Concept PUD Plan of said real estate, being located in Jefferson City, Cole County, Missouri, and being described as follows: A tract of land located in the west half of the Southeast Quarter of Section 15, Township 44 North, Range 12 West, Jefferson City, Cole County, Missouri, being a part of the tract described by warranty deed recorded in Book 448, Page 241 of the records of Cole County, Missouri and being more particularly described as follows: Beginning at the center of said Section 15, thence with the east-west quarter section line of said section, N89°12'25"E, 1294.27 feet to the westerly right-of-way line of Missouri State Highway 179 as described in Tract No. 21 of the report of Commissioners in Cole County Circuit Court Case No. OOCV323336 and recorded in Book 428, Page 765 and corrected by the Quit-Claim Deed recorded in Book 494, Page 455; thence leaving the quarter section line and with said right-of-way line, S1°59'05"W, 390.36 feet; thence S20°18'55"E, 211.51 feet to the east line of the Northwest Quarter of the Southeast Quarter of Section 15; thence leaving the right-of-way line and with said east line, SO°53'20"W, 32.20 feet to said westerly right-of-way line of Missouri State Highway 179; thence leaving said east line and with said right-of-way line, S12°31'35"W, 313.10 feet; thence S2°35'55"E, 493.21 feet; thence S12°31'30"W, 418.23 feet; thence S12°16'50"E, 421.75 feet; thence S16°45'35"W, 306.06 feet; thence S1°32'55"W, 195.30 feet to the section line between Sections 15 and 22; thence leaving said westerly right-of-way line and with said section line, S88°49'15"W, 1224.70 feet to the South Quarter Corner of said Section 15; thence leaving said section line and with the North-South Quarter Section Line of said Section 15, NO°03'15"E, 1371.92 feet; thence NO°24'20"E, 1363.10 feet to the point of beginning and containing 80.74 acres. and; WHEREAS, it appears that the procedures set forth in the zoning code relating to PUD Concept Plans have in all matters been complied with, as said property owners submitted to the Planning and Zoning Commission and City Council a Concept PUD Plan for the above referenced property. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. The Concept PUD Plan submitted by Commons Development Company LLC, on file as Case No. P10008 in the Jefferson City Planning Division is hereby approved for the land referenced above. SECTION 2. The Concept PUD Plan includes the following density and land use mix. A. Permitted uses shall be as follows: All permitted uses of the RA-2 and C-2 zoning districts specifically including but not limited to; single family detached, single family attached, multi-family, assisted living, residential care facilities, nursing homes, long term acute care hospitals; retail sales and services typically allowed in the C-2 zoning district, restaurants, medical offices, professional offices, churches, indoor athletic clubs, hotels, farmer's markets, and amphitheaters. B. Maximum density/FAR shall be as follows: a maximum combined residential and non- residential floor area ratio of 0.5 with a maximum of 565 residential units. SECTION 3. The Concept PUD Plan reflects the existence of an interchange at Highway 179 (to be constructed in conjunction with the new St Mary's Health Center) and local roadway improvements to provide access within the site as well as to connect to a future roadway west of the site. Application filed by Elmer Senevey, authorized representative, Senevey Building Company LLC, property owner, for a final plat of 30.77 acres on land zoned RS-3 Medium Density Detached Residential. This proposed final plat includes 67 residential lots plus two reserved tracts. The property is located on the eastern side of London Way approximately 1000 feet south of Fairgrounds Road and borders the Covington Gardens subdivision on the south. The property is described as part of the Southeast Quarter of the Southwest Quarter of Section 17, Township 44 North, Range 12 West, Jefferson City, Cole County, Missouri. (Central Missouri Professional Services, Consultant) Mr. Barron described the proposal and explained that the Preliminary Plat was approved by the Planning and Zoning Commission on January 14, 2010. He stated that the Final Plat for Section Two consists of 67 lots and two reserve tracts on 30.77 acres. Mr. Barron explained that the first reserve tract is a stormwater detention basin located on the southeast corner of the property that will be dedicated to the City and the second reserve tract is a greenway connection located on the northeast corner of the property. Mr. Paul Samson, Central Missouri Professional Services, 2500 E. McCarty Street, spoke regarding this request. Mr. Samson distributed a visual depicting the layout of the proposed subdivision. He explained that this subdivision plat is the second and final section of a new residential subdivision. No one spoke in opposition to this request and no correspondence was received. Excerpt of Unapproved Minutes /Jefferson City Planning & Zoning Commission Page 2 April 8, 2010 Mr. Wade gave the Engineering Division staff report and explained that four foot sidewalks are proposed on both sides of all roadways. He stated that five foot sidewalks are proposed on the east side of London Way. Mr. Wade explained that no parking will be allowed on London Way whereas parking will be allowed on one side of all interior streets within the proposed subdivision. Mr. Barron gave the Planning Division staff report and explained that the Final Plat conforms to the approved Preliminary Plat. Mr. Samson stated that he concurs with staff comments and recommendations. Mr. Jordan inquired whether the extension of Paige Drive needs to be labeled on the Final Plat. He stated that he realizes that the Preliminary Plat will show that, however the Final Plat is the only document that is recorded. In response, Mr. Barron stated that staff will look into that and ensured Commission members that will be corrected if necessary. Mr. George moved and Mr. Jordan seconded to recommend approval of the Final Subdivision Plat of Fairground Acres, Section Two, to the City Council, subject to compliance with the comments and technical corrections of the Engineering Division. Riley Court (approximately 1600 feet of right-of-way) Morgan Court(approximately 1000 feet of right-of-way) Sidewalks: Sidewalks are indicated on the improvement plans along both sides of all of the new streets and along the eastern side of London Way. Jefferson City Planning & Zoning Commission Meeting Engineering Division Staff Report Thursday, April 8, 2010, 5:15pm Item 7. - Other New Business Case No. P10010 -Final Subdivision Plat, Fairground Acres Subdivision Section Two (2), 1700 Block London Way (RS-3) ENGINEERING STAFF RECOMMENDATION- Support approval of the subdivision plat. Existing Infrastructure Summary * Infrastructure exists in the vicinity. New sidewalk is planned along London Way and all proposed roadways. Storm water detention is not a specific requirement in this development, as all drainage is planned into the existing basin constructed with the Covington Gardens development upon the subject property. Sanitary sewer exists to serve this property from Covington Gardens and is proposed to be extended to serve all proposed lots. Improvements Summary Roadway, Storm Water 1 Erosion Control * Roadway, storm water and erosion and sediment control plans have been submitted and reviewed. Enclosed systems and engineered channels have been proposed throughout the subdivision, in accordance with City design standards. Sanitary Sewer * The proposed development is served by existing sanitary sewer mains in Covington Gardens Subdivision. Sewer main extension is proposed to serve the lots within the subdivision. Sanitary sewer main extension plans have been submitted and reviewed. Sidewalk * Four (4) feet sidewalk is proposed along all proposed roadways, on both sides of the streets. A five (5) feet sidewalk is proposed along London Way along the east side. Street Access /Traffic Impact * A specific traffic impact study is not required for this proposed subdivision. * London Way would be considered a minor collector, serving not only adjacent residential property, but adjacent industrial property also. * London Way is a forty (40)feet wide roadway no parking allowed. * Parking will be allowed on one (1) side of all roadways within the subdivision with the widths proposed. Fire Hydrants / Street Lights * Facilities are proposed along London Way and within the subdivision in accordance with City standards.
