SPECIAL TOWN MEETING
May 1, 2000
In accordance with the Warrant, the Special Town Meeting was held in the
Brewster Elementary School Cafetorium, Monday, May 1 , 2000 .
The meeting was called to order at 7: 30 p. m. by the Moderator, Stephen L.
Doyle . The Tellers were Elizabeth M. Hardy, Sheila Gerhardt, Ruth Hanlon,
June Gallant, Kenneth Berbrick and Althea Alling. The Checkers were
Joanna Tabbutt, Mildred Unger, Janet Norton, Sherry Ryder, Germaine
Cummins, Dorothy Leone, Ann Golini and Nancy Berbrick
A quorum was present.
The Town Clerk, Joan K. Cole, read the Special Town Meeting Warrant and
the return of the Warrant. There being no objection, the Moderator
dispensed with the reading of all the articles.
ACCEPTANCE OF QUINN BILL
ARTICLE I. To see if the Town will vote to accept
the provisions of Chapter 41 Section 108L of the General laws, providing for
career incentive salary increases for regular full-time members of the police
department as a reward for furthering their education in the field of police
work and predicated upon the accumulation of points earned for semester
credits in an educational institution accredited by the New England
Association of Colleges and Secondary Schools or by the Board of Higher
Education, or to take any other action relative thereto.

MOTION: I move that the town vote to approve Article 1 as printed in the
Warrant.
ACTION: ADOPTED
IBPO COLLECTIVE BARGAINING AGREEMENT
ARTICLE 2. To see if the Town will vote to raise
and appropriate and/or transfer from available funds a sum of money to be
used to meet the terms and conditions of the proposed Collective Bargaining
Agreement, effective July 1 , 2000, between the Town of Brewster and the
International Brotherhood of Police Officers, or to take any other action
relative thereto .

MOTION: I move that the Town vote to approve Article 2 a printed in the
Warrant and to transfer the sum of $29 , 000 .00 from Free Cash, and to raise
and appropriate an additional sum of $25 , 480. 00 for this purpose .
ACTION: ADOPTED
ANY OTHER BUSINESS
ARTICLE 3. To act upon any other business that may
legally come before this meeting.
MOTION: To see if the Town will vote to adopt the following resolution:
Resolution of Support for Amendment of the Scenic Roads Act of 1992 for
Local Control Over State- Owned Portions of Route 6A
WHEREAS Chapter 61 of the Acts and Resolves of 1992 of the
Commonwealth of Massachusetts declared the state highway route 6A as a
scenic road under the jurisdiction of the Old King's Highway Regional
Historic District Committee of each town within Barnstable County abutting
the roadway; and
WHEREAS A recent decision of the Barnstable County Superior Court
related to roadway improvements to Route 6A in Sandwich determined that,
contrary to the special Act of 1992, because Chapter 40 Section 15C of the
Massachusetts General Laws specifically exempts state-owned or state-
maintained numbered roadways from benefiting from the protections of local
jurisdictional review provided by that law, State roadway work on Route 6A
(a numbered state roadway) is not subject to local review; and
WHREAS The Honorable Representative Thomas George representing
Brewster has filed H5216, an Act to amend Chapter 61 of the 1992 Acts and
Resolves to ensure that any "repair, maintenance, reconstruction,
realignment, reengineering, or paving of Route 6A. . . shall be subject to the
prior written consent of the local Old Kings Highway Regional Historic
District Committee"; and
WHEREAS It is feared that the amendment does not go far enough in
specifically eliminating the reference in paragraph one of the Massachusetts
General Laws Chapter 40 Section 15C that exempts state-owned and state-
maintained roadways from protection and control by the local authorities of
towns abutting Route 6A;
BE IT THEREFORE RESOLVED that the Town of Brewster supports the
Representative's efforts to restore local control and jurisdiction over Route 6A
as a cherished and valuable historic feature, the nature of which is an
integral part of each abutting Town's character, appearance, economy and
heritage , and further requests that Special Legislation should specifically
dictate that the all State agencies proposing repair, maintenance,
reconstruction, realignment, reengineering, or paving on or along Route 6A,
regardless of effects on trees and/or stone walls , should be required to
undergo the same local review processes that any other project of similar
scope or nature would, including that of the Corridor Overlay Protection
Bylaw and the Development Plan Review Bylaw.
