HomeMy Public PortalAboutr 09:159 2Re.znh1tinn nf t4e ~nrn:UB~ nf illcrderd? ~ - W ~ NoC9-159 D," of Adop"o" July 9, 2009 RESOLUTION OF THE BOROUGH OF CARTERET AUTHORIZING MID DIRECTING THE CARTERET PLANNING BOARD TO UNDERTAKE AN INVESTIGATION OF CERTAIN PROPERTY LOCATED IN THE BOROUGH TO DETERivllNE WHETHER SUCH PROPERTY CONSTITUTES AN~ AREA IN NEED OF REDEVELOPMENT UNDER THE NEW JERSEY LOCAL REDEVELOPMENT AND HOUSING LAW (N.J.S.A. 40A:12A.l et seg.) WHEREAS, the governing body of the Borough of Carteret (the "Borough") is interested in determining whether certain properties located within the Borough are in need of redevelopment under the New Jersey Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-l et seq. (the "Redevelopment Law); and WHEREAS, the Borough desires to authorize and direct the Borough's Planning Board to undertake an investigation to determine whether the properties located at Block 149, Lots 1, 2 and 4 (the ('Study Area"), also known as 128 Washington Avenue and 130~136 Washington Avenue, in the Borough constitutes an area in need of redevelopment under Section 5 of the Redevelopment Law (N.l.S.A. 40A: 12A-5); and NOW, THEREFORE, BE IT RESOLVED as follows: Section 1. The Planning Board is hereby authorized and directed undertake a preliminary investigation and conduct a public hearing(s) to determine whether the Study .A.rea, or portions thereof. is an area in need of redevelopment pursuant to the Redevelopment Law. Section 2. That the Planning Board is hereby authorized to utilize the services of Beacon Plahning and Consulting Services, LLC, as previously authorized, to assist the Board with the preparation of the Amendment(s) to the Redevelopment Plan. Section 3. The Planning Board, following said preliminary investigation and hearing(s), shall make a recommendation to the governing body of the Borough, pursuant to N.J.S.A. 40A:12A-6, as to whether the Study Area should or should not be determined by the governing body to be an area in need of redevelopment. Section 4. This resolution shall take effect immediately upon its adoption. Section 5. A copy of this Resolution shall be forwarded to the Planning Board for action consistent herewith. d d h. 9'" d . fJ 1 2009 ..
